Lease of telecommunications links for the needs of organizational units of the Police in the Silesian Garrison.

Reference Number: ZP-2380-19 / 2020

1. The subject of the contract is the lease of telecommunications lines for the needs of organizational units of the Police in the Silesian garrison.

5. The contracting authority allows subcontractors. In the event that the Contractor uses a subcontractorin the Employer requests to indicate the part of the contract which he intends to entrust to them and to provide the names of subcontractors` companies if known and contact details if known (Annex 1 to the ToR). Provisions regarding subcontractors can be found in Chapter XVII of the ToR and in the model contract (Annex 2 to the ToR).

6. The Contractor declares that the delivered devices meet the service and warranty conditions presentede in Annex 3 and 4 to the ToR.

7. The Employer provides for the possibility for Contractors to carry out local visions within the time limit indicated in Annex 3 to the ToR.

8. Based on Article. 29 paragraph 3a of the Public Procurement Law, the Employer requires employment by the Contractor, subcontractor, further subcontractor of persons who perform all activities falling under the so-called direct costs for this order under contractfor a job with at least a minimum wage. Thus, this requirement applies to persons who perform activities directly related to the performance of the subject of the contract, i.e. physical workers.

9. The Awarding Entity does not allow the replacement of the employment contract by a civil law agreement, subject to the conditions of work performance specified in art. 22, - 1 of the Act on June 26, 1974 Labor Code (Dz.U. from 2018 item 917 with late d.).

10. Therefore, before signing the contract, the Contractor must provide the Employer with a statement by the Contractor, subcontractor, further subcontractor on employment under an employment contract with at least the minimum wage, persons performing activities directly related to the performance of the subject of the contract.

10.1. This statement should include inparticularities: the exact specification of the entity submitting the statement, the date of submitting the statement, an indication that the activities related to the implementation of the subject of the contract are performed by persons employed under an employment contract together with an indication of the number of these persons, names and surnames of these persons, type of employment contract, and statements that the remuneration of these persons is at least minimal and aftersignature of the person authorized to make the statement on behalf of the Contractor, subcontractor, further subcontractor.

10.2. With regard to subcontractors, further subcontractors, the statement referred to in Chapter I para. 10.1. ToR, should be submitted together with a copy of the subcontract, but further subcontracting no later than before the commencement of the activities of these persons.

12. The contracting authority may cancel the procurement procedure if the funds which the contracting authority intended to spend on financing all or part of the contract have not been awarded.

13. The contractor will provide protectionę personal data provided, in accordance with the Personal Data Protection Act and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter RODO). Obligation to inform subcontractors, third parties and the consortium member about the processingpersonal data rests with the Contractor.

14. The Contractor is obliged to submit on the offer form Annex 1 to the ToR a statement regarding: the offered transmission speed, the time of removing the damage, and the method of link implementation. If the declaration is not completed in relation to:

- the offered transmission speed, the Employer accepts that the Contractor has offeredminimum speed i.e. 30 Mb / s,

- time to remove the damage The Employer assumes that the Contractor has offered the maximum time to remove the failure, i.e. 24 hours,

- the method of link implementation (column 4 of Annex No. 1 to the Terms of Reference) offer will be rejected as not compliant with the ToR ...

1. Contractors who can apply for the contract:

1.1. are not excludedon the basis of:

a) art. 24 paragraph 1 point 12 23 of the Public Procurement Law,

b) Art. 24 paragraph 5 points 1 and 8 of the PPL Act.

To confirm that there are no grounds for exclusion, the Awarding Entity requests:

(1) pursuant to art. 25a section 2 of the Public Procurement Law Act to attach to the offer a statement (a uniform European order document, hereinafter EAT) about the lack of grounds for exclusion in accordance with the template constituting Annex 5 to the ToR,

(2) pursuant to art. 26 section 1 of the Public Procurement Law, the submission by the Contractor whose bid is the highest rated, at the request of the Employer, statements and documents regarding the lack of grounds for exclusion listed in Chapter IV B of the ToR.

1.2. meet the conditions for participating in the procedure regarding the competence or entitlement to conduct a specific professional activity, provided that it results from separatethese provisions. The Contractor will meet the condition if he demonstrates that he has a current certificate of entry in the register of telecommunications undertakings issued by the President of UKE, referred to in art. 10 and art. 11 of the Telecommunications Law of July 16, 2004 (i.e. Journal of Laws of 2019, item 2460, of 2020, item 374).

To confirm that the condition has been met, the Employer requests:

(1) pursuant to art. 25a section. 2 of the Public Procurement Law Act to attach to the offer a statement (a uniform European order document, hereinafter EAT) on meeting this condition in accordance with the specimen constituting Annex 5 to the ToR.

(2) pursuant to Art. 26 section 1 of the Public Procurement Act, the submission by the Contractor whose bid is the highest rated, at the request of the Employer, of documents regarding the fulfillment of the conditions for participation in thecited in chapter IV B of the ToR. Please be advised that:

3. Your personal data will be processed for the purpose / purposes of preparing and carrying out the public procurement procedure and implementing this contract;

4. the legal basis for the processing of your personal data is the Act of 29 January 2004 Public Procurement Law, hereinafter referred to as the "Public Procurement Law";

5. the recipient of your datapersonal may be the Public Procurement Office, moreover, to the extent specified in the Public Procurement Law, the data can be published on the website http://bip.katowice.kwp.policja.gov.pl, https://slaska-policja.eb2b.com. pl and other entities authorized pursuant to separate provisions;

6. Your data will not be transferred to a third country, international organization;

8. you have the right to request the Administrator to access data regarding your person, rectify, limit processing and object to the processing of personal data to the extent specified by law;

10. providing data is a statutory requirement;

11. in the event of failure to provide data, it will not be possible to participate in the procurement procedure;

12. Your personal data is not subject to automated decision making, including profiling.

13. The Contractor shall ensure the protection of personal data provided in accordance with the Data Protection Actpersonal data and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter the GDPR). The obligation to inform subcontractors, third parties and the consortium member about the processing of personal data lies with the Contractor. Statement will Performon fulfilling the obligations arising from art. 13 or art. 14 GDPR towards natural persons from whom personal data was obtained, directly or indirectly, in order to apply for this order submitted in Annex 1 to the ToR, offer form.
