The subject matter of the order is the Central Layer service for the needs of digital telephone network for prisoners in penit units
The Ordering Party requests from the Contractors to submit a bid bond in the amount of PLN 50, 000.00 (in words: fifty thousand zlotys 00/100).
The Ordering Party demands from the Contractor security of due performance of the contract in the amount of 10% in relation to the price total given in the offer.
1. Forms of performance bond - Collateral may be brought inby the Contractor's choice in one or more of the following forms referred to in art. 148 para. 1 of the Public Procurement Law, ie: 1) money,
2) bank guarantees or social and credit union guarantees, however, the obligation of the cash register is always a monetary obligation;
3) bank guarantees;
4) insurance guarantees;
5 ) sureties granted by entities referred to-in art 6b par. 5 point 2 of the Act of 9.11.2000 on the establishment of the Polish Agency for Enterprise Development (Journal of Laws of 2014, item 1804, as amended)
2. The date and place of performance of the performance bond - 1) The collateral must be lodged before the public procurement contract is signed. The Contractor will provide security on the day of conclusion of the contract.
2) Security inif carried in cash, it must be paid by bank transfer to the Employer's bank account number: 86 1130 1121 0006 5624 2990 0001.
3) The proof of providing security in cash must contain the phrase "Security" - unlimited tender No. ZP / 30 under the heading "title". /KO/18".
4) The security lodged in cash must be recorded in the Contracting Authority's bank accountlater on the day of conclusion of the contract.
5) In the case of providing collateral in a form other than in cash, an original document indicated in art. 148 para. 1 point 2-5 of the Public Procurement Law. The original of the document or its copy certified as a conformity to the original should be attached to the offer and should be prepared in Polish.
6) In the case of payment of a deposit in cash byContractor, provisions of art. 148 para. 4 of the Public Procurement Law, accordingly 3. Changing the form of security for due performance of the contract
In the course of the contract, the Contractor may change the form of security for one or several forms referred to in Art. 148 para. 1 of the Public Procurement Law, and with the consent of the Employer in the cases specified in art. 148 para. 2 Public Procurement Laws. A change in the form of security is madeon keeping the security continuity and without reducing its height.
4. Return of the performance bond - Purchaser shall return the security within 30 days from the date of the order's execution and the Ordering Party's acknowledgment that it has been duly performed, in accordance with art. 151 para. 1 Public Procurement Law.
1. The form of payment of the tender deposit may be brought in one or more of the following forms, specifyin art. 45 par. 6 Public Procurement Law, ie: 1) money,
2) bank guarantees or social and credit union guarantees, however, the surety is always a cash guarantee;
3) bank guarantees;
4) insurance guarantees;
5) sureties granted by entities referred to in art. 6b par. 5 point 2 of the Act of November 9, 2000 on the establishment of the Polish AgenDevelopment of Entrepreneurship (Journal of Laws of 2014, item 1804, as amended).
2. Time and place of payment of the bid security. 1) Bid bond should be submitted before the deadline for submitting bids. 2) Bid bond paid in cash, must be paid by bank transfer to the Employer's bank account number: 86 1130 1121 0006 5624 2990 0001.
3) Proof of payment in money must contain in the "title" the wording frome return: "Wadium - unlimited tender No. ZP / 30 / KO / 18".
4) In the case of payment in cash, the offer must be accompanied by a document confirming the transfer (deposit payment).
5) The bid bond paid in cash must be posted on the Ordering Party's bank account before the deadline for submitting bids.
6) In the case of payment of a bid bond in a form other than in cash, it is requiredsubmission of the original document indicated in art. 45 par. 6 points 2-5 of the Public Procurement Law. The original of the document or its copy certified as a conformity to the original should be attached to the offer and should be made in the Polish language.
7) From the document of the deposit mentioned in the form indicated in art. 45 par. 6 point 2-5 of the Public Procurement Law, the following should result: - a) explicitly guaranteeing payment of debts in a manner notrevocable, unconditional and on first demand within no more than 30 calendar days from the first request of the Employer;
b) that retention of the bid bond will take place in the event of recovery, although one of the circumstances referred to in Art. 46 ust. 4a and para. 5 Public Procurement Law - 8) The bid bond should cover the whole period of being bound with the offer, starting from the date of submitting bids.

The Purchaser retains the bid bond in the cases specified in art. 46 ust. 4a and 5 of the Public Procurement Law - The essential financial provisions and payment arrangements for the parties, which will be introduced to the content of the public procurement contract, are included in the contract template, - PurchaserIt sets specific requirements in this respect, the fulfillment of which the Contractor is obliged to demonstrate. The assessment of compliance with the above condition for participation in the proceedings shall be made by the Employer on the basis of a statement submitted by the Contractor whose model is attached as Annex 3 to Siwz.
