The subject of the order is the task of supplying factory-new equipment and devices that are part of the mechatronics workshop as part of the project entitled" Expansion and reconstruction of the infrastructurewhich the USSR them. W. Witos in Ostr-d together with the purchase of the necessary equipment for the needs of improving the quality of education in the profession of mechatronics technician ", in accordance with the provisions of - 3, technical cards (7 copies) constituting Annex 4a - 4g to SIWZ in the parts from 1 to 7, draft contract (attachment No. 3 to SIWZ) and in accordance with applicable standards and regulationsand regarding the subject of the order are specified in - 3 para. 1 - 5 siwz available on the website http: //bip.powiat.ostroda.pl.

1. The object of the order is the task titled Factory delivery of new equipment and equipment that is part of the mechatronics workshop as part of the project entitled "Expansion and reconstruction of the infrastructure of the ZSR W. Witos in Ostr-d together with the purchase of necessaryequipment for the needs of improving the quality of education in the profession of a technician mechatronics, in accordance with the provisions of - 3, the technical card constituting Annex 4a to SIWZ, the draft contract (Annex No. 3 to SIWZ) and in accordance with applicable standards and regulations. 2. The subject of the order referred to in paragraph 1, in particular, includes:

1) the supply of equipment (devices and equipment) to-workshop in accordance with the technical card (appendix No. 4a to SIWZ), along with its loading, unloading and delivery to the User's seat;

2) bringing in, and setting of individual equipment elements in the rooms and places indicated by the User;

3) assembly (installation ) and launching of devices and equipment (if required by technology);

4) training of persons directly using them-delivered devices and equipment in the scope of their operation and operation, in accordance with the requirements specified in the technical card (attachment No. 4a to SIWZ), on dates agreed with the User, not later than within 14 days after the delivery with the assembly of devices and equipment ;

5) handing the User warranty card and instruction manual in Polish on the delivered devicemedical devices and equipment;

6) providing the User with the operating instructions for the devices and equipment supplied in Polish.

3. Other provisions:

1) Each contractor may submit an offer for one selected part, for several selected parts or for all parts covered by the subject of the order.

2) The orderer requires that the delivered equipment (including all devices and equipment) be brand new(unused). Required production year not earlier than 2017.

3) The equipment supplied (devices and equipment) must comply with all norms and norms specified by applicable law, including permitting indicated devices and equipment for use within the European Union.

4) The Ordering Party requires that the Contractor He has granted a guarantee for the period of the minimum for the executed objectm 24 months.

5) The contractor is obliged to provide warranty and post-warranty service for delivered equipment, as well as specialized equipment and equipment delivered - availability of spare parts for a period of at least 10 years, starting from the date of the final acceptance of the delivery.

6) If in the order description there are any trademarks, patents orsource or a particular process, which characterizes products or services provided by a specific contractor, it should be assumed that the Employer provided a description with an indication of the type and permits submission of irrelevant offers of technical, operational and performance parameters not worse than those specified in the order description . Legal basis: art. 29 para. 3 Public Procurement Laws

7) In the case of introducing new legal regulations regarding the subject of the order during its implementation, the Contractor will be obliged to take them into consideration when providing the service. Social aspects:

1) Based on art. 29 para. 4 of the Public Procurement Law, the Employer requires employment by the Contractor or subcontractor to perform the subject of the order of at least one unemployed person or

2) Employment of at least one unemployed person or disabled person, referred to in point 1, should take place no later than half of the deadline for completing the order.

Further information on the employment of at least one unemployed or disabled person is given in - 3 and in - 10 of the draft contract (attachment No. 3 to Siwz).

Applies to parts from 1 to 7: 1. Itemthe order does not require any competences or entitlements to conduct a specific professional activity resulting from separate regulations. 2. The Contractors who are not subject to exclusion can apply for the award of the order: 1) pursuant to Art. 24 sec. 1 point 12-23 of the Act of 29 January 2004 on Public Procurement Law (Journal of Laws of 2017, item 1579, as amended) - hereinafter the Public Procurement Law; 2) in the mode of art. 24 sec. 5 point 1 of the Public Procurement Law. 3. For the preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions for participation in the procedure, together with the offer must submit a current statement as at the day of submitting bids, that it is not subject to exclusion, and that it meets the conditions for participation in the proceedings. The statement referred to in the first sentence should be submitted in the form of a single document EATH STAnnex 2 to SIWZ, drawn up in accordance with the standard form provided for in the European Commission Implementing Regulation issued on the basis of art. 59 par. 2 of Directive 2014/24 / EU and art. 80 ust. 3 of Directive 2014/25 / EU, hereinafter referred to as the "single document or EIN", the Contractor may fill in a single document via the form available on the website:https://ec.europa.eu/growth/tools-databases/espd/filterlang=pl. The Employer makes available on his website the file "App. No. 2 to Siwz EAT (espd-request.xml) ", which should be imported via the above mentioned website (after selecting" I am the contractor "option). After loading the document, go ahead and fill in:

1) part II, sections A, B, C and D; 2) part III of the sectione A, B, C (with the exception of statements regarding the optional grounds for exclusion of the Contractor not specified by the Employer in SIWZ or in the notice of procurement) and Section D; 3) part IV, section α; The contractor in Part IV may limit itself to the completion of section a and does not have to fill in any of the other sections in Part IV, ie A, B, C and D. Appropriate (evidence-based) verification of compliance with certain-by the Awarding Entity, the conditions for participation in the Procurement procedure shall be based on relevant documents submitted by the Contractor, whose offer will be evaluated at the highest, at the request of the Employer; 4) part VI. 4. According to art. 10a paragraph 5 of the Public Procurement Law, EAT is made, under pain of nullity, only in electronic form and is provided with a qualified electronic signature. The Contractor who refers to the resources of other entities, in order to demonstrate the absence of grounds for exclusion and compliance with them, to the extent that he relies on their resources, the condition of participation in the proceedings also submits in electronic form, uniform EIN documents regarding these MARKOtow. 6. In the event of a joint application by the Contractors, a single document of EED in electronic form shall be submitted by each of the Contractors jointly applying for the order. These documents confirm the fulfillment of the conditions for participation in the proceedings and the lack of grounds for exclusion to the extent that each of the Contractors demonstrates fulfillment of the conditions for participation in the proceedings and the lack of grounds-exclusion. 7. At the request of the Ordering Party in order to confirm the circumstances referred to in art. 25 ust. 1 point 3 of the Public Procurement Law, ie in respect of the lack of grounds for exclusion, referred to in para. 2 (§ 5 siwz, paragraph 1, points 1 and 2), the Contractor must submit statements and documents referred to in § 5 points 1, 4, 5, 6 and 10 of the regulation of the Minister of on July 26, 2016 in Sp. types of documents, likethey may be requested by the contracting authority from the contractor in the procurement procedure (Journal of Laws of 2016, item 1126) - hereinafter the ordinance, provided that the declaration referred to in - 5 point 10 of the ordinance, the Contractor submits within 3 days from the date of posting on the Ordering Party's website information referred to in art. 86 par. 1 of the Public Procurement Law.

Applies to parts from 1 to 7: List of declarations-or documents submitted in the proceedings by the Contractor at the request of the Ordering Party in order to confirm the circumstances referred to in art. 25 ust. 1 point 1 of the Public Procurement Law, in terms of meeting the conditions for participation in the proceedings set out in - 5 siwz para. 2 point 2:

- information from a bank or cooperative savings and loan fund confirming the amount of financial resources held or remotelythe Contractor, in a period not earlier than one month before the deadline for submission of tenders; Note:

1) The amount of financial resources held or the creditworthiness of the Contractor should be expressed in the form of a concrete, unambiguous figure.

2) If the amount of financial resources owned or creditworthiness of the Contractor in the currency or foreign currencies is specified, they will be transferredfor the Polish zloty at the current NBP rate as at the date of publication of the contract notice in the Official Journal of the European Union.

2. Reliance on the resources of the third party:

1) The Contractor may, in order to confirm the fulfillment of the conditions for participation in the proceedings, in appropriate situations and in relation to a particular order, or part of it, rely on technical or professional abilitiesh or the financial or economic situation of other entities, regardless of the legal nature of its legal relations.

2) The Contractor, which relies on the capacities of other entities, must prove to the Employer that while performing the order, he will have the necessary resources of these entities, in particular presenting commitment of these entities to give him at his disposal necessaryresource resources for the needs of the order. The content of the document or documents to confirm that the Contractor will have the necessary resources to the extent that the public order can be properly performed and to assess whether the relationship between the Contractor and these entities guarantees real access to their resources, should clearly and unambiguously indicate:es available to the Contractor of resources of another entity,

b) manner of using resources of another entity, by the Contractor, while executing the order,

c) scope and period of participation of another entity when executing the order,

3) The obligation referred to in point 2 should be submitted in original with offer.

4) The contractor, which relies on the financial or economic standing of other entities, is jointly and severally liable-with the entity that committed to provide resources, for the damage suffered by the Ordering Party arising from the non-availability of these resources, unless the lack of access to resources is not at fault.

A list of statements or documents submitted in the proceedings by the Contractor at the request of the Employer to confirm the circumstances referred to in Article 25 ust. 1point 2 of the PPL Act: Not applicable. 2. Other documents required along with the offer: 1) A completed and signed offer form adequate to the selected or selected parts - Annex No. 1a 1g to SIWZ (7 copies). 2) A completed and signed technical card adequate to the selected or selected parts - appendix No. 4a - 4g to SIWZ (7 copies). 3) In the case of joint application for a contract by several contracts- the Contractor should attach to the offer a power of attorney signed by all entities jointly applying for the order, submitted in the form of an original or notarized copy. The power of attorney model is attached as Appendix 5 to SIWZ. 4) If the Contractor establishes an attorney, the offer must be accompanied by the original power of attorney or by a notarial monstererased his copy. From the content of the power of attorney must clearly indicate the scope of authorization to activities related to the public procurement procedure, in particular to sign and submit an offer. 3. Documents of foreign entities: 1) If the Contractor has his registered office or place of residence outside the territory of the Republic of Poland, instead of the documents referred to in - 6a para. 2-siwz: a) point 1 lit. a shall submit information from the relevant register or, in the absence of such a register, another equivalent document issued by the competent judicial or administrative body of the country in which the Contractor has its registered office or place of residence is the person concerned by the information or document, to the extent specified in art. 24 sec. 1 items 13, 14 and 21 of the Public Procurement Law, b) point-3 - submits a document issued in the country in which the Contractor has its registered office or place of residence, confirming that its liquidation has not been opened or bankruptcy has been declared.2) Documents referred to in point 1 lit. a and b, should be issued not earlier than 6 months before the deadline for submission of offers. 3) If in the country in which the Contractor has his seat or place of residence or placethe person concerned is present, the documents referred to in item 1 are not issued, they are replaced by a document containing the Contractor's declaration, indicating the person or persons authorized to represent him, or a statement of the person to whom the document was to be submitted, submitted notary or before a judicial, administrative or self-regulatory body-or economic proper due to the seat or place of residence of the Contractor or place of residence of that person. The provision of point 2 shall apply.4) In case of doubts as to the content of the document submitted by the Contractor, the Employer may apply to the competent authorities of the country in which the Contractor is established or domiciled or domiciled by the person whomnt applies for providing the necessary information regarding this document. 5) Contractor established in the territory of the Republic of Poland, in relation to a person residing outside the territory of the Republic of Poland, which concerns the document referred to in - 6a para. 2 point 1 lit. a siwz, submits the document referred to in - 6a para. 11 point 1 lit. a siwz, to the extent specified in art.24 sec. 1 point 14 and 21 of the Public Procurement Law. If in a country where the person concerned has a place of residence, document does not appear, it is replaced by a document containing a statement of that person made before a notary or before a judicial, administrative or professional self-government or economic authority competent for the place residence of that person. przepis point 2 shall apply. 4. The Contracting Authority provides for the possibility of applying the procedure referred to in art. 24aa paragraph 1 of the Public Procurement Law
