The validity of the participation guarantee will be at least equal to the minimum period of validity of the offer, 90 days from the deadline for submission of tenders. Form of establishment: according to the provisions of art. 36 of H.G. no. 395/2016:
a) by bank transfer or through- a guarantee instrument issued under the law by a bank or an insurance company that is not in special situations regarding authorization or supervision, under the terms of the law. The guarantee must be irrevocable, to provide that the payment of the participation guarantee will be executed unconditionally, ie at the first request of the beneficiary, on the basis of his / her statement regarding�at the guarantor of the guarantor; b) OP (Treasury account RO57TREZ2315005X000377, Trez Constanta), fiscal code 14810074;
c) depositing the amount at the cashier of the unit, if its value is less than or equal to RON 5 000.
In any event, proof of the establishment of the participation guarantee must be submitted no later than the closing date and time limit for the submission of tenders. The date for which it is determinedthe lei / currency equivalent is the date of the publication of the participation notice.

With the offer, the economic operators participating in the procedure have the obligation to complete and submit:

The supporting documents proving the fulfillment of the assumed by the DUAE shall be presented at the request of the contracting authority, (a) Will be presented to Romanian legal / natural persons: - - certificates of non-payment of debts, taxes or contributions to the budget general consolidated (local budget, state budget, etc.) at the moment of presentation,
- criminal recordof the tenderer and of the members of the administrative, management or supervisory body of that tenderer or of those having the power of representation, decision or control within the bidder, as evidenced by the certifying certificate issued by the ONRC / - documents demonstrating that the tenderer may benefit from the derogations provided for in art. 166�par. (2), art. 167 par. (2), art. 171 of Public Procurement Law 98/2016 (if applicable), - other editorial documents (if applicable) b) Required for foreign legal / natural persons: - Declaration on own responsibility or, if in the respective country there are no legal provisions regarding the declaration on your own responsibility, an authentic statement given to a notary, �an administrative or judicial authority or a professional association with competence in this respect, if documents in the country of origin or in the country where the tenderer is established are not issued.
Note: The contracting authority excludes from the the award procedure an economic operator where it can demonstrate by any appropriate means that rthe respective economic operator has breached its obligations regarding the payment of taxes, duties or contributions to the consolidated general budget, according to art. 165, 166 of Law 98/2016. The economic operators submitting the tender must prove a form of registration under the law of the country of residence, from which they appear that they are legally constituted, that they are not in any of the situationsas well as the fact that they have the capacity to perform the activities that are the object of the contract. The way in which the fulfillment of the requirement can be demonstrated: the DUAE will be filled in by the economic operators participating in the award procedure (including by the third party / subcontractor, if applicable) with the information related to their situation.the proof of registration will be presented at the request of the contracting authority only by the tenderers placed on the first 3 places in the intermediate rankings drawn up at the completion of the evaluation of the tenders.
For the proof of the registration: - for the Romanian legal / physical persons: founder issued by ONRC from which the object of activity of the operato is derivedeconomy. The object of the contract must have a correspondent in the CAEN code of the certificate issued by the ONRC.
In the case of a group of economic operators submitting the joint offer, each member of the group must prove that for the part of the contract he has a correspondent in the NACE code from the certificate issued by ONRC

editorial documents proving a form of registration as a legal person or registration / attestation or membership from a professional point of view, according to the legal provisions in the country where the candidate / tenderer is resident, accompanied by an authors translationin Romanian. The object of the contract must have correspondence between the fields of activity listed in the documents submitted.
