1. The subject of the order is delivery for the needs of the II Branch Informat the Gdańsk Court of Appeal, with headquarters in Elbląg at ul. Grunwaldzka 77-79, renewing the manufacturer's support and purchasing additional licenses for the ones held by the Ordering Party, i.e. the VMware license, Dell EMC, Fortinet.

Main Site: The seat of the 2nd IT Department of the Appeal Court in Gdańsk located in Elbląg at ul. Grunwaldzka 77-79.

1. Renewing producer and bonusesp VMware vSphere license:

a. Raising the VMware vSphere Standard license to VMware vSphere Enterprise Plus for 12 processes and extending Basic support for a period of min. 3 years.

The detailed scope and description concerning the subject of the order has been specified for Part 1, Annex N, respectivelyr 2a to the agreement in the column of "Minimum Requirements" Section 3 of the ToR.

2. The Ordering Party requires:

2.1. Licenses offered by the Contractor must be purchased through authorized distribution channels of the producers ; 2.2 as part of the support, the Contractor is obliged to provide technical support and free software upgrade to the latest version available on the marketu at a given moment for a period of at least 36 months (the support period is one of the criteria for the evaluation of offers).

2.3 The contracting authority requires that within 7 days from the date of conclusion of the contract, the Authorizing Party's account on the official website of the manufacturer should have an extension of the services and submission of the purchase of services. This can be confirmed by a screenshot from the official website of the producer.

1. From the proceedings on the pennyno contractor is excluded from the Contractor in relation to which any of the circumstances referred to in art. 24 sec. 1 Public Procurement Law.

2. In addition, the Employer will exclude the Contractor, in relation to which the circumstances referred to in art. 24 section 5 point 1, point 4 and item 8 of the Public Procurement Law - 3. In order to confirm the absence of grounds for exclusion of the Contractor from participation in the proceedings, the Ordering Party requestssubmission by the Contractor of the following documents:

3.1. submitted by the Contractors together with the offer:

1) completed form of the Single European Order Document (EAT), which should be submitted using means of electronic communication within the meaning of the provisions of the Act of 18 July 2002 on electronic services, in accordance with the requirements specified in Chapter VI point 1.1. TOR;

2)documents constituting evidence, in particular the obligation of entities to give the Contractor at the disposal of the necessary resources for the needs of the order - in the case of the Contractor, which relies on the abilities or situation of other entities

3.2. submitted by all Contractors after the opening of offers:

1) a declaration of belonging or non-affiliation to the same capital group.

3.3. skcharged by the Contractor in the proceedings at the request of the Employer:

1) information from the National Criminal Register in the scope specified in art. 24 sec. 1 points 13, 14 and 21 of the Act on Public Procurement Law, issued not earlier than 6 months before the deadline for submitting bids;

2) certificate of the competent head of the tax office confirming that the Contractor is not in arrears with paying taxes, not earlier than 3 months before the deadline for the submission of bids, or other document confirming that the Contractor has entered into an agreement with the competent tax authority regarding repayment of such receivables with possible interest or fines, in particular obtained legally permissible, postponed or spread over installments of overdue payment or suspension in full of the decysy competent authority;

3) a certificate from the relevant local organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the contractor is not in arrears with payment of social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission of tenders, or other document confirming thate the contractor has entered into an agreement with the competent authority regarding the repayment of such receivables, together with any interest or fines, in particular obtained legally permissible, postponement or payment of overdue installments or suspension in its entirety of the competent body's decision; - 4) excerpt from the relevant register or from the Central Register and Information on Economic Activityif separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion under Article 24 (5) (1) of the Public Procurement Law;

5) the Contractor's statement that he has not issued a final court judgment or final administrative decision with payment of taxes, fees or social security or health insurance premiums or in the event of a release-in such a judgment or decision, documents confirming payment of such receivables, including possible interest or fines or conclusion of a binding agreement on repayment of such receivables; - 6) declaration of the Contractor about the lack of a ruling against him as a preventive measure for the prohibition of applying for a public order; Contractors about not paying taxesand local fees, referred to in the Act of 12.1.1991 on local taxes and charges (Journal of Laws of 2016, item 716),

4. In the case of the Contractor, which relies on the abilities or situation of other entities under the terms of art. 22a of the Public Procurement Law, the Contractor submits the documents listed in item 3.3 above. in relation to these entities

1. In order to confirm fulfillment by the Contractorconditions for participation in the proceedings, regarding the economic or financial situation, ensuring the execution of the order. The Contracting Authority requests the following documents:

1) a document confirming that the Contractor is insured against civil liability in the scope of activities related to the subject of the order. If, for a justified reason, the Contractor can not submit documents regardingThe financial or economic situation required by the Employer may be submitted by another document, which sufficiently confirms fulfillment of the condition of participation in the procedure described by the Employer. The contractor, in accordance with art.22a of the Public Procurement Law, may rely on: - technical or professional ability, - the economic or financial situation of other entities, regardless oflegal background of its legal relationship with it.

1.1. In such a situation, the Contractor is obliged to prove to the Ordering Party that while performing the order, he will have resources to the extent necessary to properly execute the order, presenting the commitment of these entities to provide him with the necessary resources to fulfill the order.

1.2. The contractor assesses whether I will make it availablethe Contractors, by other entities, technical or professional capacity or their financial or economic situation, allow the Contractor to demonstrate compliance with the conditions for participation in the proceedings and examine whether there are any grounds for exclusion referred to in Article 24 paragraph 1 point. 13-23 and section 5 items 1, 4 and 8 of the Public Procurement Law

2. Contractor having its registered office in the territory of the Republic of PolandPoland, in relation to a person residing outside the territory of the Republic of Poland, which is referred to in the document indicated in Chapter VI, point 1.3. point. 1) SIWZ, submits the document referred to in item 3 below, in the scope specified in art.24 par.1 point.14 and 21 of the Public Procurement Law. If in the country where the person whose document was to be residing is domiciled, such a dock does not appearment, it is replaced by a document containing a statement of that person made before a notary or before a judicial, administrative or professional body competent for the place of residence of that person. Records of item 4 below. the first sentence applies.

3. If the Contractor has his registered office or place of residence outside the territory of the Republic of Polandinstead of the documents referred to:

3.1. in section III.1.1) of the notifications of sub-paragraphs 1) submit information from the relevant register or, in the absence of such register, another equivalent document issued by the competent judicial or administrative body of the country in which the Contractor is established or domicile or resides of the person concerned by the information or document, in the scope ofspecified in art. 24 sec. 1 points 13, 14 and 21 of the Act on Public Procurement Law,

3.2. in section III.1.1) of the notifications of sub-paragraphs 2) -4) submits a document or documents issued in the country in which the Contractor has his registered office or place of residence, confirming that: a. he is not in arrears with taxes, fees, social security or health insurance contributions or that he has entered into an agreement with the competent authorityanem regarding the repayment of these receivables, together with any interest or fines, in particular obtained legally permissible, postponement or payment of overdue payments into installments or suspension of the execution of the decision of the competent authority in full,

b. its liquidation was not opened or bankruptcy was declared. Documents referred to in item 1.3 above. and 3.2. lit.b. they should be exposede not earlier than 6 months before the deadline for submission of tenders. The document referred to in point 3.3. lit.a. it should be issued not earlier than 3 months before the deadline for submission of offers. If in the country in which the Contractor has his registered office or place of residence or place of residence has the person concerned, the documents referred to in item 3 above are not issued, -it is replaced by a document containing the Contractor's declaration, indicating the person or persons authorized to represent it, or a statement of the person to whom the document was to be submitted, before a notary or before a judicial, administrative or professional self-regulatory or economic authority with regard to the seat or place Contractor's residence or place-residence of that person.
