Personal situation of economic operators, including requirements relating to enrollment on professional or trade registers:

— in the last 5 years there was an effective conviction for participation in criminal organization, corruption, fraud or money laundering,

— there is minor penalty that prohibits participation in procedures for public announcement, awarding contracts on public procurements and contract for public-private partnership,

— there is effective conviction for temporary or permanent prohibition to perform certain activity,

— has initiated open bankruptcy procedure or liquidation procedure,

— has unpaid taxes, contributions and other public fees, except if the economic operator has deferred payments for those taxes, contributions and other public fees in accordance with the special regulations and the same are regularly paid,

— there is effective conviction by which infringement sanction has been imposed on - interdiction for professional activities, activities or duties, i.e. temporary interdiction of separate activity realization and,

— provides false information or does not submit the information requested by the Contracting Authority.

For proving personal standing, the economic operator submits the following documents:

— statement of economic operator that in the last 5 years there was no effective conviction for participation in criminal organization, corruption, fraud or money laundering,

— certificate that any competent authority has initiated no open bankruptcy procedure,

— certificate that any competent authority has initiated no open liquidation procedure,

— certificate for paid taxes, contributions and other public payments by competent authority in the country where the economic operator has been registered in,

— certificate from the Register of penalties for crimes committed by legal persons that there is no minor penalty that prohibits participation in procedures for public announcement, awarding contracts on public procurements and contract for public-private partnership,

— certificate from Register of penalties for crimes committed by legal persons that there is no effective conviction for temporary or permanent prohibition to perform certain activity,

— certificate that there is no effective conviction by which infringement sanction has been imposed on— interdiction for professional activities, activities or duties, i.e. temporary interdiction of separate activity realization.

Ability for professional activity performance:

— in order to prove the ability for professional activity performance, the economic operator needs to submit the following:

— document for registered activity as evidence that the same is registered as physical person or legal entity for performing the activity related to the subject of the public procurement contract or evidence that the same belongs to certain professional association according to the regulations of the county where the same is registered

— Document for registered activity (DRA form) as evidence that it is registered as a legal entity for performing the activity related to the subject of the contract or proof that they belong to a professional association in accordance with the regulations of the country where it is registered,

— Decision for wholesale medical supplies trade under the Law on Medicines and Medical Supplies.
