Rehabilitation and reconstruction of streets and sidewalks and their facilities and accessories on the territory of Municipality Bproject under the project 12/07/2/0/00508 under the RDP 2014-2020, divided into two distinct positions:

Main Site: Gr. Berkovitsa, Berkovitsa Municipality, Montana District, the Subjects under the Building Permit No 42 of 28.10.2016 by Chief Executive Officer architect of the Municipality of Berkovitza - Construction and Reconstruction of Rehabilitation and Reconstruction of Streets, Pavements and Facilities and Accessories on Berkovitsa, Berkovitsa, -as follows:

- sub-project № I - "Rayko Daskalov" St. from 993 to 382a, quantity: 2 769 m asphalt pavement and 260 m sidewalks, - subsoil № II - Kestenyrska str. : 1 291 m asph. pavement and 391 m sidewalks,

- sub-project № III - "Dame Gruev" Str., from Ot233a to OT605, quantity: 2 070 m asphalt pavement and 513 m sidewalks, - sub-№ IV - Zaryaniza Str. OD8, quantity:4 040 m asph. pavement and 405 m sidewalks,

- Subiect № 10 - Timok Street from Ot939 to Ot313a, quantity: 1 750 m asphalt pavement and 186 m sidewalks, - subsection № VI - Musala str., quantity: 3 006 m asph. pavements and 602 m sidewalks

The total length of the street network is 2 234 lm

Building works for rehabilitation and reconstruction of streets and sidewalks and their facilities and accessories on a territoryBerkovitsa Municipality on lot 1 is to improve and restore the transport-performance and load-bearing capacity of the pavement in order to ensure conditions for traffic safety and good drainage of streets and surrounding areas. Replace existing curbs and damaged pavements. Ensure an accessible environment. The project development beforesees rehabilitation of the streets that currently have asphalt pavement in extremely poor condition, new asphalt layers will be laid out, will be done where necessary reconstruction of the sidewalks, as well as a complete replacement of the adjoining curbs. When the rehabilitation of the streets is carried out, the borders of the pavement areas will be preserved from the adjacent properties. Modifiedcurrent regulations are not foreseen. • Full information on the scope, volume and requirements for the performance of the public procurement is detailed and regulated in the technical specifications for lots and investment projects approved under No. 35 of 28.10.2016, under Building Permit No. 42 of 28.10.2016, as approved under Art. 142, para. 1 and Art. 144, Art. 145 of the Territory Arrangement and by Ch. architect of the Municipality of Berkovitsa, an integral part of the documentation for participation in the procedure

Applicable for both lots: the participants should have a registration in the Central Professional Register of the Builder according to the Construction Chamber Act for the execution of constructions with a second group scope, minimumm fourth category in the sense of Art. 5, para. 6, item 2.4.1. of the Regulations for the procedure for registration and keeping of the TSRC, issued by the Chairman of the Regional Chamber of Commerce, prom. SG no. 101 of 22.11.2013, which allows him to carry out the works, subject of this order, and for the foreign persons, according to art. 60 of the Public Procurement Act in analogous registers under the law of the Member State in which they are establishedIn the case of a grouping participant that is not a legal entity, the requirement applies to the participant (s) who will carry out the construction activities.

Where the participant envisages the participation of subcontractors, the compliance with the selection criterion is also proved by them, according to type and share of the order they will perform and for which there are no grounds for disqualification.

When submitting the tender, the participant declares the fitness for professional activity by completing Section A: "Fitness", Part IV: "Selection Criteria" by the Single European Public Procurement (EEDOP) in electronic form. In the case of unions which are not legal entities, compliance with the selection criterion is evidenced by the participating association, and When the participant uses subcontractors, they must meet the relevant selection criterion according to the type and the share of the order in the respective lot item they will perform and for them there are no grounds for removal from the procedure

2. Participants must have Professional Liability insurance of the participants in the construction worksArt. 171 of the Spatial Development Act covering the minimum insurance sum for group 2, fourth category constructions, in accordance with the Ordinance on the Terms and Procedures for Compulsory Insurance in Design and Construction or a corresponding valid equivalent document - The requirement does not apply to a person from a Member State of the European Union Union, or from another State party to the European Economic Agreementwhich is established in the territory of the Republic of Bulgaria and has provided equivalent professional indemnity or guarantee insurance in another Member State of the European Union or in a party to the Agreement on the European Economic Area

When the provided insurance or guarantee covers only partially the risks, the contracting authority may require an additional one-insurance or guarantee covering uncovered risks, in accordance with Art. 173, para. 2 and Art. 174, para. 1 of the TDA and observing the requirements of Art. 27, para. (3) of the Law on Service Activities.

In the case of unions which are not legal entities, the selection criterion shall be proved by the participating association and not by any of the persons included in it, except in the case ofaccording to the distribution of the participation of the persons in the implementation of the activities stipulated in the contract for the formation of the grouping it is stipulated that these persons will execute the construction.Each of the persons carrying out the construction must have the relevant insurance.- When the participant uses subcontractors, of the relevant selection criterion according to the type and share of pthe hand in the respective lot they will perform and for them there are no grounds for removal from the procedure

Requirements for the participants:

1. A participant who meets the conditions under Art. 10, para. 1 of the Public Procurement Act and the requirements of the contracting authority. The assignor removes from participation in the procedure for which a participant is present or has arisen before or during-the grounds for removal under Art. 54, para. 1, items 1-7 and Art. 55, para. 1, item 1, item 3, item 4 and item 5 of the Public Procurement Act, the conditions under Art. 107 of the Public Procurement Act, the circumstances under Art. 3, item 8 of ЗИФОДЮПРСРС, as well as participants, for whom there are restrictions under Art. Art. Related parties, within the meaning of - 2, item 45 of the Supplementary Provisions of the Public Procurement Act, in - 1, items 13 and 14 of the Supplementary Provisions of the Public Offering of Securities Act, may not be independent participants-in the procedure for the respective lot.

The guarantee for execution of the project is submitted by the participant, designated as contractor, upon signing it, amounting to 5% of the value of the VAT without VAT. The guarantee shall be released in stages and in proportion to the individual sub-fund amounts up to 30 (thirty) days after the date of the drafting of the Finding Act for the acceptance of the construction(Annex 15 to Article 7, paragraph 3, point 15 of Ordinance No 3 of 31 July 2003, for the preparation of acts and protocols during construction) for each of the sub-units of the respective lot. The guarantee is in one of the following forms: cash amount, bank guarantee, insurance of the contractor's choice

Guarantee for advance payment. The assignor foresees an advance payment for the execution of the contract in-up to 30% of the total amount under the contract for performance of the contract. In connection with the anticipated advance payment, the contracting authority, on the grounds of Art. 111, para. (1) of the PPL requires the designated contractor to provide a guarantee to secure the advance provided. The guarantee, which provides advance funds, is up to the amount of these funds and is released within three days of-reimbursement or drawdown of the anticipated advance. In the event that the contractor does not avail himself of the opportunity provided to him to receive an advance payment, the unpaid and due payments under the contract for actually performed activities will be paid to the interim and / or final payments under the contract. The guarantee is provided in one of the following forms: cash amount, bank guarantee, insurance of choice-contractor. The guarantee in the form of a sum of money or a bank guarantee may be provided on behalf of the contractor on behalf of a third party guarantor. The participant designated as a contractor shall choose the form of the guarantee for performance of the contract and for the advance. The conditions for the detention and release of the guarantee for the performance of the contract and for the advance funds are laid down in the contract-for the award of the public contract
