The subject of the order is the provision of comprehensive shunting service for wagons and train sets "PKP Intercity" S.A. A detailed description of the subject of the contract and the conditions for its implementation is included in the Terms of Reference with attachments.

Comprehensive maneuvering services for wagons and PKP Intercity S.A. trains at the following stations: Świnoujście, Kołobrzeg, Słupsk, and Lębork. A detailed description of the subject of the contract and the conditions for its implementation is included in the ToR with attachments.professional liability, if it results from separate provisions - applies only to part 1. Within the scope of part 1 of the contract, the Awarding Entity will consider that the contractor meets the abovementioned condition if it proves that it has a valid license issued by the President of the Office of Rail Transport for carrying out rail transport of persons and goods, resulting from the Act of 28 March 2003 on rail transport (i.e. Journal of Laws of 2017item 2117 late as amended) In the case of Contractors jointly applying for the award of the contract, the above condition must be met by each of the contractors jointly applying for the order. specifies any requirements in this respect, which the contractor is required to demonstrate in particular.

1. In order to demonstrate the lack of grounds for excluding the Contractor from the procedure in the circumstances referred to in art. 24 of the Public Procurement Law, the Employer requests the Contractor to present the following documents: 1) information from the National Criminal Record in the scope specified in art. 24 paragraph 1 point 13 lit. a-c, point 14 of the Public Procurement Law (in oreferring to the persons indicated in this provision regarding the catalog of offenses referred to in Article 24 para. 1 point 13 lit. a-c of the Public Procurement Law) and art. 24 paragraph 1 point 21 of the Public Procurement Law (in relation to collective entities) issued not earlier than 6 months before the deadline for submitting bids 2) a certificate from the competent head of the tax office confirming that the Contractor is not in arrears with payment afterdonations, issued not earlier than 3 months before the deadline for submission of bids, or other document confirming that the Contractor has entered into an agreement with the competent tax authority regarding the repayment of these receivables together with any interest or fines, in particular, he obtained the exemption, deferral or distribution provided for by law installments of late payments or withholding in fullthe implementation of the decision of the competent authority 3) a certificate of the competent organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with payment of social security or health insurance contributions, issued not earlier than 3 months before the deadline for submitting bids, or other da document confirming that the Contractor has entered into an agreement with the competent authority regarding the repayment of these receivables together with any interest or fines, in particular, he obtained the exemption, deferral or installment of overdue payments provided for by law, or withholding in full the decision of the competent authority 4) an excerpt from the relevant register or from Central Records and Informationon Economic Activity, if separate provisions require an entry in the register or a register in order to confirm the absence of grounds for exclusion pursuant to art. 24 paragraph 5 point 1 of the Pzp Act 5) the Contractor`s statement on non-payment of local taxes and fees, referred to in the Act of 12.1.1991 on local taxes and fees (Journal of Laws of 2018, item 1445 as amended ); 6) statements by Wythe contractor that he has not issued a final court judgment or final administrative decision regarding late payment of taxes, fees or social security or health insurance contributions, or in the event of such judgment or decision being issued - documents confirming payment of these debts together with any interest or fines or conclusion binding agreement onand the repayment of these debts 7) the Contractor`s statement of the lack of a decision against him as a preventive measure forbidding public procurement.

2. The Purchaser informs that pursuant to -2 para. 7 of the Regulation of the Minister of Development of 26.7.2016 on documents that the contracting authority may request from the contractor in the procurement procedure (Journal of Laws of 2016, item 1126, as amended) (hereinafterRegulation), waives the request for submission of statements regarding the conditions for exclusion referred to in Article 24 paragraph 1 item 16-20 of the Public Procurement Law and the statements indicated in item 1 items 5-7 above, because the scope of information covered by the exclusion basis corresponds to the content of information required to be provided by the Contractor in EAT.

3. Contractor with its registered office or place of residence outside the territoryOf the Republic of Poland, instead of the documents referred to in paragraph 2 points 1-4 above submits the documents indicated in -7 of the Regulation and respectively in Chapter IX of the ToR.

4. The Contractor having its registered office on the territory of Poland, in relation to the person residing outside Poland, to whom the document referred to in paragraph 1 point 1 submits the documents indicated in -8 of the Regulation and in Chapter accordinglybut IX SIWZ. 5.
