(18069) 532 Command support base (BAC), telephony service rental

The DDPS civilian field currently has about 30, 000 telephone connections and impersonal special systems based on analogue or ISDN technology which will have to be replacedby IP systems. As part of the TelCiv DDPS monitoring project, these connections will have to be migrated to IP telephony, resilient or replaced by other technologies.

CDQ 1: Economic / Financial Capability

The bidder has the economic / financial capacity to fulfill the mandate.

CDQ 2: Workplace

Provision to accept the Berne region as a place of work. The work place is provided by the adjudicator. The precise place is definedin the order;

CDQ 3: interlocutor

The tenderer provides a contact person (SPOC) responsible for the follow-up in case of problems related to the orders and has the power to take decisions. The requesting service ensures through the SPOC that it is always the same person who is the interlocutor of the principal adjudicator;

CDQ 4: authorization for the rental of services

Certification that the tenderer is in possession of the cantonal authorization for the rental of services (LSE).

The lessor of services is only liable to the mission firm for the careful selection of the proposed collaboratorsto the adjudicator. In addition, the lessor of services is not responsible for slight negligence or damage intentionally caused by the collaborator to the mission company or in the course of its activity in the service of the mission company. Chapter C of the GC does not apply to the subject of this invitation to tender.

General Conditions: Performance pursuant to the General Conditions (GC) of Confederation for IT Services (October edition 2010). These can be consulted under https: //www.beschaffung.admin.ch/bpl/en/home/auftraege-bund/agb.html The points of the CG relating to the guarantee (number 12 CG) and to the responsibilities (number 20 CG) are adapted to the particularities of the renting of services for the present market: in the case of a service-renting enterprise, the lessor of services is only responsible for the choice of workers which he proposes to the contracting authority. In addition, the bailleur services does not respond to damage caused intentionally or negligently by the worker, both within the company that is a tenant of services and in the context of the tasks it performs for that company. Chapter C of the GC does not apply in this market.

Negotiations: are reserved. The adjudicator does not engage in price negotiations. Bidders do not-may change the prices indicated in their tender only in special circumstances (for example where the requirements need to be clarified or specified) and where the tenderer explicitly authorizes them in his invitation to participate in negotiations.

Conditions governing the procedure: adjudicator awarding public contracts for services in Switzerland onlywho guarantee compliance with the provisions on the protection of work and working conditions and equal pay for women and men. If the service is performed abroad, the tenderer shall at least comply with the fundamental conventions of the international labor organization mentioned in Annex 2a of the PCO. The form of the Conference ofConfederation Cats (CA) must be signed and attached to the offer.

Other indications: the tender is established in accordance with Chapter 3 of the Public Procurement Order (OMP). This contract covers the leasing of services (see the Federal Act of 6.10.1989 on the employment service and the leasing of services [LSE, RS 823.11] and the related ordinance [RS 823.11]). The-renting of services is not subject to the PPL (see the judgment of the Federal Administrative Court B-1687/2010 of 21.6.2011), but in the third chapter of the PCO, that is to say that it there is no legal protection. As a result, no indication of legal remedies is included in the invitation to tender. The acquisition will be subject to the state of progress of the project and the availability of the credentialsicts. The purchase and the demand are done systematically by competition between the bidders.

The requesting service has no obligation to purchase. The successful tenderer reserves the right to be awarded the services awarded to other requesting departments of the Federal Administration and to accept or refuse in whole or in part the services provided as an options.
