On the possible requirement of an official decision on the permissibility the exercise of an activity in Austria as well as the obligation according to -- 21or 194 of the Federal Procurement Act 2018 is expressly pointed out. Sections 21 and 194 of the Federal Public Procurement Act 2018 oblige applicants or tenderers who are resident in the territory of another contracting party to the EEA Agreement or in Switzerland and who must obtain an official decision regarding their professional qualification for the purpose of doing business in Austriaas soon as possible, but in any case before the expiry of the offer period. For regulated trades (- 94 of the Trade Regulations 1994), reference is made in this connection to -- 373a to 373e of the Trade Regulations 1994.
