Based on the framework agreement and the subsequent contracts, services will be provided street sanitation in Timisoara, according to the requirementsIn the framework of the Framework Agreement and the subsequent contracts, street sanitation services will be provided in Timisoara Municipality, in accordance with the requirements set out in the Tender Book and its annexes, part of which will be submitted to the Tender Documentation. The minimum and maximum amounts (both) of the framework agreement and of thethe following contract is highlighted in the Attachment to the Procurement Data Sheet attached to the SICAP (new SEAP) ad published.

Estimated value of the framework agreement: 72 794 318 RON without VAT - Frequency and value of the contracts to be attributed: Duration of this framework agreement: 4 years (48 months), starting on the date of its signature by the parties. Subsequent contracts arewill be concluded annually or according to the needs of the contracting authority and the funds allocated.

Estimated value of the largest subsequent contract: 18 198 579, 50 RON VAT excluded.

Timisoara will exclude at any time of the award procedure of the contract services, any economic operator who is in one of the situations provided by art. 60, 164, 165 and 167 of Law 98/2016 Exclusion reasons will also be applied to the supporters / subcontractors / third parties, as the case may be.

Way to fulfill:

Under the sanction of rejection of the offer as unacceptable, each economic operator participating in the award procedure (bidder, bidder associate, subcontractor, third party, as the case may be) will present with the complete DUAE offerwith the information relating to his / her situation.

You will be presented both the declaration on your own responsibility regarding the non-compliance with the provisions of art. 60 of Law no. 98/2016 and, where appropriate, the firm's firm commitment to the third party, accompanied by documents showing the effective manner in which its support, subcontracting agreement and / or association agreement will materialize.-the supporting documents proving the fulfillment of the assumed by completing the DUAE shall be submitted, only at the request of the contracting authority, by the tenderer placed first after the application of the award criterion on the admissible tenders.

The supporting documents may be:

1) with regard to the payment of taxes, taxes or contributions(2) the criminal record of the economic operator and of the members of the administrative, management or supervisory body of that economic operator or of those having the power to represent them, to the general budget (local budget, state budget, etc); decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act;az, documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. 1) Within the documents attached to the participation announcement published in SICAP, DUAE is made available to economic operators interested in theeditable mat, in order to complete it by the bidders. Participating economic operators will fill in this document with the reasons for the exclusion or the fulfillment of the qualification criteria requested by the contracting authority that have correspondence at the level of the acquisition data sheet (where they are clearly stated) and-they will not have the right to intervene on the DUAE format, respectively on the requirements imposed by the contracting authority; 2) For viewing the attached documents, the economic operators must have a necessary program to view the electronically signed files; 3) Economic operators have the right to submit the offer (DUAE completed, declaration of non-compliance with the provisions of Article 60 din Law no. 98/2016, the Technical Proposal, the Financial Proposal, the Proof of Procuring the Participation Guarantee and, if applicable, the Third Party Support Commitment, Association Agreements and / or Subcontracting) only in electronic format signed with Extended Electronic Signature; 4) Requests for clarification regarding this tender documentation sthey will address exclusively to SICAP, within the award procedure conducted by electronic means, the contracting authority will not respond to the requests addressed by means of communication other than the established one. Requests for clarification (if applicable) will be submitted within the deadline for addressing the requests specified in I.3., II.1.4) of this document, and the adresumed outside of this term will no longer be taken into account. Response to requests will be published in the SICAP in the tender notice; 5) If the contracting authority requests the submission of certain clarifications / completions for the purpose of verifying the compliance of the offer with the required requirements, both the request and the bidder's response shall be transmitted to the SICAP just in forelectronic mat, signed with extended electronic signature. If the bidder's response is posted to the SICAP without the extended electronic signature, its offer will be assimilated to the provisions of Art. 137 par. (2) lit. j) from H.G. 395/2016, being rejected as unacceptable; 6) If, following the application of the award criterion "best value for money", it is found that two or more offersyou are ranked first, with equal scores, the classification will be made taking into account the score obtained in the assessment factors in descending order of their weight. If the equality is maintained, the contracting authority will request new financial proposals, and the winning bid will be the one with the lowest financial proposal.
