The manner in which the requirement can be demonstrated: the DUAE will be completed by the economic operators participating in the award procedure with the information related to their situation. The supporting documents proving the fulfillment of those assumed by completing the DUAE will be presented, at the request of the contracting authority, only by the tenderer clplaced in the first place in the intermediate ranking prepared at the end of the evaluation of the offers. These documents can be:

- certificates confirming the lack of outstanding debts regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc.) at the time of presentation,

- the criminal record of the economic operator and of the members of the bodyadministration, management or supervision of the respective economic operator or of those who have the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive document;

, as the case may be, documents by which demonstrates that the economic operator can benefit from the derogations provided in art. 166 para. (2), art. 167 para.(2), art. 171 of Law 98/2016 on public procurement,

- other supporting documents, as the case may be.

"The procedure for awarding the public procurement contract is initiated under the scope of this suspension clause, meaning that the conclusion of the public procurement contract is conditioned by the allocation of credits. budgeting with this destination, the signing of the contract being done in compliance with dexhibitions related to the commitment of the expenses from the budgets that fall under the legislation on public finances.

In view of the provisions of Law no. 98/2016 on public procurement and H.G. no. 395/2016, with subsequent amendments and completions, the contracting authority specifies that it will conclude the contract with the tenderer declared the winner only insofar as the funds nExemption from the acquisition will be ensured by allocating budgetary credits to this destination. In case, for whatever reasons, the budget credits will not be allocated, the contracting authority, after receiving the notification regarding the failure to grant the financing, reserves the right to cancel the award procedure, provided that there is no other source of financing, as providederile art. 212 paragraph (1) lit. c) thesis 2 of Law 98/2016 with subsequent amendments and completions, being impossible to conclude the public procurement contract.

The bidders in this procedure understand that the contracting authority cannot be held liable for any damage in case of cancellation of the award procedure, regardless of its nature and whether the authorthe contracting authority was notified of the existence of such damage. The bidders in this procedure accept the use of the special conditions above / the suspension clause, assuming their full responsibility in relation to the possible damages that they could suffer in the described situation ".
