The subject of the order is the transport of disabled people to Community Self-Help Houses along with the transport of these people to their place of residence in the commune of Miejska Krakow. The subject of the contract covers the transportation of approximately 120 disabled persons each day of providing services. A detailed description of the subject of the contract contains a model contract (including attachments), constituting Annex 9 to the specification of the essential terms of the contract (hereinafter referred to as "SIWZ").

1. In these proceedings, communication takes place using the miniPortal https: // miniportal.uzp.gov.pl/, ePUAPu https://obywatel.gov.pl/nforms/ezamowania and e-mail. The details regarding the method of communication between the Employer and Contractors are specified in item 8 of the ToR.

2. Identification of the recipient (Ordering Party) in the ePUAP forms: Krakow City Commune - city for repairs of the poviat (31-004 Krakow, Lesser Poland voivodeship). EPUAP mailbox address: / UMKr / SkrytkaESP. Electronic mail addresstroniczna: info@um.krakow.pl.

3. The Employer does not require the implementation of the order by sheltered workshops.

4. The Purchaser does not allow submission of variants.

5. The Awarding Entity does not envisage conducting an electronic auction.

6. The Employer requires employment by the Contractor (or subcontractor) during the implementation of the contract, on the basis of an employment contract, persons performing activities, aboutreferred to in point 3.9. Terms of Reference.

7. The contracting authority provides for the possibility of awarding contracts referred to in art. 67 section 1 item 6 of the Act in an amount not exceeding 100% of the value of the basic order. These orders will consist in repeating similar services in relation to those described in this procedure in the model agreement with attachments. Given in section II.1.5) and section II.2.6) Szathe estimated value of the contract includes the orders referred to in art. 67 section 1 point 6 of the Act in the amount of PLN 1 851 851.85 net.

8. The Employer allows the contractor to implement the subject of the contract using subcontractors on the principles set out in the ToR.

9. In these proceedings, the procedure referred to in art. 24aa of the Act.

10. Contractor before the end ofthe bid submission deadline is obliged to pay a deposit in the amount of: PLN 30, 000.00. The rules for paying the bid bond are set out in point 12 of the ToR.

1. Contractors who meet the conditions for participation in the procedure, determined on the basis of art. 22 paragraph 1 point 2 of the Act regarding competence or authorization to conduct specific professional activities:

1.1. have a valid permitradio frequency for the use of radiocommunication transceivers operating in dispatcher-type mobile land radiocommunication networks issued by the Office of Electronic Communications (UKE) or have another means of communication ensuring constant contact between cars, dispatch and emergency services;

1.2. have a valid license to perform krajowy road passenger transport, in accordance with the Act of 6 September 2001 on road transport (i.e., Journal of Laws of 2019, item 58 as amended).

2. The Contractor submits with the offer and on the principles set out in points 6 and 8 of the Terms of Reference, in order to pre-confirm that he meets the abovementioned conditions:

2.1. Declaration of non-exclusion and compliance with the conditions for participation in the proceedings in the form of a uniform Europeanorder document (EAT) - current as at the day of submitting the offers. The Contractor submits separate statements regarding:

2.1.1. the Contractor himself or each of the Contractors jointly applying for the contract;

2.1.2. other entity (s) whose technical or professional ability relies on the Contractor to confirm compliance with the conditions for participation in the procedure - only inon the part of Part II, Section A and B and Part III of the EAT form - if applicable.

2.2. Obligation of other entities to make available to the Contractor the necessary resources for the purposes of the contract, as proof of reliance on the technical or professional abilities of other entities, in relation to the specific condition of participation in the procedure referred to in item 1 above, if applicable.

3.To confirm compliance with the abovementioned the Contractor is obliged to submit at the request of the Employer and on the principles set out in points 6 and 8 of the Terms of Reference

3.1. current radio permit for the use of radiocommunication transceivers operating in dispatcher-type mobile land radiocommunication networks issued by the Office of Electronic Communications (UKE) or a confirmation statementhares that it has at its disposal another means of communication ensuring constant contact between cars, dispatch room and emergency services;

3.2. current license to carry out national road transport of persons, in accordance with the Act of 6.9.2001 on road transport (i.e. Journal of Laws of 2019, item 58, as amended).

1. The Contractor submits the offer via the "Form for submission, amendment, withdrawal of an offer or application "available on ePUAP and also made available on the miniPortal. The Contractor is required to attach to this form:

1.1. for successful submission of the offer:

1.1.1. Offer form, according to the template constituting Annex No. 1 to the ToR;

1.1 .2 Power of attorney to represent the Contractor in the proceedings or to represent the Contractor in the proceedings and concludeda contract, if the person representing the Contractor in the procurement procedure is not indicated as authorized to represent him in the relevant register or in the Central Register and Information on Economic Activity.

1.2. in order to fulfill the obligations in the scope of processing personal data in accordance with the GDPR, referred to in point 24 of the Terms of Reference: a declaration of compliance with the obligationsof information provided for in art. 13 or art. 14 GDPR, in accordance with the content of Annex 3 to the ToR.

2. Contractors who are not subject to exclusion from the procedure pursuant to art. 24 paragraph 1 point 13-23 of the Act (subject to Article 24 paragraph 7 of the Act). In addition, the Employer will exclude from the proceedings a Contractor who "for reasons attributable to him, failed to perform or failedaleycie significantly completed the previous public procurement contract or concession contract concluded with the contracting authority referred to in Art. 3 clause 1 points 1-4 of the Act, which led to the termination of the contract or the award of compensation ", in accordance with Article 24 paragraph 5 point 4 of the Act. Contractors in order to confirm the absence of grounds for exclusion are required to submit the documents specified in point 6 of the ToR andon the principles set out in points 6 and 8 of the ToR:

2.1. declaration of not being excluded and meeting the conditions for participating in the procedure in the form of a Single European Order Document (EAT) - current as at the date of submission of tenders;

2.2. Contractor`s statement on belonging or not belonging to the same capital group as any of the other Contractors who submitted inseparate offers;

2.3. information from the National Criminal Register in the scope specified in art. 24 paragraph 1 point 13, 14 and 21 of the Act, issued not earlier than 6 months before the deadline for submitting bids;

2.4. Contractor`s statement that he has not issued a final court judgment or final administrative decision regarding late payment of taxes, fees or insurance premiumssocial or health care or - in the event of such a verdict or decision - supporting documents will pay the amounts due together with any interest or fines or conclude a binding agreement on the repayment of those amounts;

2.5. Contractor`s statement that he has not been awarded a preventive measure against the use of public procurement3. The list of statements and documents, as well as the forms and rules for their submission are described in detail in items 6 and 8 of the ToR.

4. The ToR also contains information on the principles of submitting documents by: entities jointly applying for the award of the contract, Contractors having their registered office or place of residence outside the territory of the Republic of Poland (RP) and a person residing outside the territoryrium RP.

5. Refers to item IV.2.6) of the announcement - correct wording: The Contractor submitting the offer remains bound for 60 days from the deadline for submission of tenders.
