The economic operator participating in the procedure, regardless of its quality (bidder with individual offer, affiliate bidder, subcontractor, supporter), shall not be subject to the provisions of art. 164, 165 or 167 of Law no. 98/2016 which determines the exclusion from the award procedure.

" 1: In accordance with the provisions of Article 196, paragraph (2) of Law 98/2016, the contracting authority shall decidein the first place after applying the award criterion, present updated supporting documents demonstrating that all the qualification and selection criteria are met, according to the information contained in the DUAE.
The following supporting documents will be requested and presented:
1. Establishing certificates for the lack of overdue debts with respect tothe payment of taxes, duties and contributions to the consolidated general budget (local budget, state budget, etc.) at the moment of presentation; The criminal record of the economic operator, namely the criminal record for each of the members of the administrative, management or supervisory body of the respective economic operator, respectively persons having the power of representationdecision, or control, as it results from the certificate issued by the Ministry of Justice - Trade Register Office / Establishing Act of the economic operator; Where appropriate, other documents by which the economic operator demonstrates that he / she falls within exceptional situations that do not lead to exclusion from the procedure provided for in art. 165 par. (3), art. 166, art. 167 par. (2) and Art. 171 of Law 98 / 2016.
4. Where appropriate, any other equivalent editorial documents, in accordance with Art. 168 par. (1) of the Law no. 98 / 2016.
The persons with decision-making positions at the level of the contracting authority, within the meaning of the provisions of art. 60 and art. 167 lit. e) of Law no. 98/2016 are:

Third Party Support. In the case of the existence of third parties, along with the DUAE form, the tenderer has the obligation to present a firm commitment regarding the financial support of the bidder, as it is mentioned in Section Formular no. 10.
Association (Form No. 4 and Form No. 5) In the case of submitting a joint tender, along with the DUAE form, the tenderer has the obligation to specify information on the association, as they are mentioned in the Form Section Form no. 4, as well as the Association Agreement, as it is mentioned in Section Forms Form no. 5.
Note requirement 1
Requirement 1 - Ciaverage annual business. The Authority considers it important to establish and apply for a qualification requirement for the average annual turnover of the bidder for the last 3 years (2015, 2016, 2017) of at least RON 1, 500, 000.00.
SPECIAL WARNINGS
1 ) If two or more bids are ranked first, with equal scores, the tie will be made taking into accountthe floor obtained in the evaluation factors in descending order of their weight.
