Pursuant to Article 24aa, paragraph 1, the contracting authority in the proceedings will first evaluate the offers and then examine, whether the contractor whose offer has been evaluated as the most advantageous, is not subject to exclusion and meets the conditions for participation in postępowaniu. According to art. 26 par. 1 Pzp ordering prior to the order being awarded, calls the contractor whose offer will be the highest rated, to submit in the designated period, not shorter than 10 days, valid as at the day of submitting statements and documents confirming compliance with the conditions of participation in the proceedings and no grounds for exclusion. the order is excludedthe Contractor based on art. 24 sec. 1 and par. 5 Public Procurement Law (Journal of Laws from 2017, item 1579 with later amendments), the grounds for exclusion are described in part 5.4. and 5.5 of the ToR.

In order to confirm the absence of grounds for excluding the contractor from participation in the proceedings, the contracting authority requests the documents specified in par. 5 of the Minister of Development of 26.7.2016 on the types of documents that can be requestedfrom the contractor in the proceedings for the award of the contract (Journal of Laws of 2016, item 116), the documents were specified in part 6.3. 6.9. Terms of Reference.
