The subject of the order is the renewal of 200 licenses / subscriptions for-antivirus software ESET Endpoint Antivirus Suite with support for it, including the right to update software or delivery of 200 licenses / subscriptions for equivalent software along with support for them, including the right to software updates, for a period of 24 months, from 01/12/2018 year. The description of the subject of the order can be found in the attached draft contract (Annex No. 1to SIWZ). Currently, the European Design Center has 200 licenses for ESET Endpoint Antivirus Suite.

The subject of the order is the renewal of 200 licenses / subscriptions for ESET Endpoint Antivirus Suite antivirus software with support for them, including the right to update the software or delivery of 200 licencji / subscription for equivalent software, including support for it, including the right to update the software, for a period of 24 months, from 1 December 2018. The description of the subject of the order can be found in the attached draft contract (Annex 1 to the Terms of Reference). Currently, the Center for European Projects has 200 licenses for the ESET Endpoint Antivirus Suite antivirus software.

Optimal solutionIt would be a good idea to extend your licenses, but the Employer allows the possibility of offering equivalent products in the scope of new licenses for antivirus software (equivalent software). The equivalence criteria, i.e. the minimum software requirements, are described below. When changing the software, support must be provided by the Contractor or Software Manufacturer on partas the planned implementation by the Employer on all required devices (about 200 devices).

The Ordering Party requires the delivery of software on terms provided by the software producer, hereinafter referred to as: "Manufacturer", for the units they realize public tasks. The delivery of software in accordance with the subject of the Agreement will take place within 7 calendar days from the date of conclusionContracts (delivery date is the criterion for the evaluation of offers). Support for software, including the right to update the software covers the whole period of validity of the contract, that is, 24 months, from 1 December 2018. The Employer shall be entitled to download patches, updates and new versions of the Software for the period until the end of the Agreement in a way that does not violate thein the authors and owner of the copyright and unlimited rights of the Ordering Party to use this Software. By the term "license" the Ordering Party understands the right to use the Software legally under the terms and conditions indicated by the Producer and on the terms specified in the Agreement. - The equivalence criteria described in the Annexiku 1 to SIWZ - OPZ. Software support, including the right to update the software, covers the whole period of the contract, that is, 24 months from 1 December 2018. Deadline for order execution: 1) license delivery maximum 7 days from the date of signing the contract. The indicated date is the maximum deadline for processing the order. The contracting party will evaluate the offers also for offersContractor shorter deadline for the implementation of the order according to the offer evaluation criteria - Order processing time 10%. 2) support service, including access to updates, for a period of 24 months from 1 December 2018.

Applies to item III 1.3) The contractor may apply for the contractor who meets the conditions regarding a) technical or professional capacity: The ordering party will recognize the above condition for spif the Contractor shows that during the last three years before the deadline for submitting bids (and if the period of business is shorter - in this period) he has performed at least three deliveries of a license of at least PLN 10, 000.00 gross each. The ordering party will evaluate each delivery / contract individually. The Contractor may confirm the fulfillment of the conditions for participation inin cases where appropriate and in relation to a particular order, or parts of it, rely on the technical or professional capacity of other entities, regardless of the legal nature of the legal relationship that it has with it. The Contractor, who relies on the abilities or situation of other entities, must prove to the Ordering Party that, in fulfilling the order, he will have the necessarythese entities, in particular by presenting the obligation of these entities to give them the necessary resources for the needs of the order. Contractors, who are not subject to exclusion pursuant to art. 24 sec. 1 and 5, subject to paragraph 8-10 Public Procurement Law. In order to demonstrate the absence of the above-mentioned grounds for exclusion of the Contractory must submit the following declarations and documents with the offer: 1. valid as of the day of submitting bids, referred to in art. 25a para. 1 point 1 of the Public Procurement Law in respect of meeting the conditions for participation in the proceedings and the lack of grounds for exclusion in the form of a single document of the EAT. The pattern of the declaration is specified in Annex No. 3 to the ToR. The Ordering Party informs that in Part IV, EAT must be madeIt is possible to fill in this document only in the section α (alpha) "general declaration" and therefore the contractor does not have to fill in any of the other sections in Part IV of the EO.The uniform European order document (EAT) should be sent in electronic form with a qualified electronic signature together with all the files that will enable unambiguous verificationcorrectness of the complex signature qualified with free software generally available with the indication of the name. Placing the EAT with the offer on a data carrier (eg CD, pendrive) is unacceptable, because it does not constitute its submission using means of electronic communication within the meaning of the provisions of the Act of 18.7.2002 on the provision of electronic services. Encrypted EAT should be sentto the e-mail address: przetargi@cpe.gov.pl. Detailed information on the submission of the statement in the form of EED in an electronic form is included in Annex 3 to the ToR. In the event of a joint application by the Contractors, the declaration is submitted by each of the Contractors jointly applying for the order. Contractor who refers to the resources of other entities in order to demonstrate the lack of existence of wobthat the grounds for exclusion and fulfillment, in the scope in which they refer to their resources, the conditions for participation in the proceedings are submitted by a declaration regarding these entities. The contractor who intends to entrust the execution of a part of the contract to subcontractors, in order to demonstrate the absence of any grounds for exclusion from participation in the procedure, submits a declaration regarding these entities. Contractor in terit will be 3 days from posting information on the website referred to in art. 86 par. 5, provides the orderer with a declaration on belonging to or not belonging to the same capital group. Along with the submission of a statement, the contractor may provide evidence that links with another contractor do not lead to distortion of competition in the contract award procedure (model attachment 4 to-Terms of Reference). Together with the offer of the Contractor, jointly applying for the awarding of the contract, they submit the power of attorney of the consortium. The offer must also include a power of attorney for the person submitting the offer, if the authorization does not result from the register.

Cd. item III 1.3) The Ordering Party shall call the Contractor whose bid has been best assessed before submitting the order, to submit in the fixed term, not shorter than 10 days, other, valid as at the date of submitting statements or documents confirming the circumstances referred to in art. 25 ust. 1 of the Act, ie: 1) excerpt from the relevant register or from the central register and information on economic activity, if separate regulations require an entry in the register or records, in order to confirm the lack of grounds for exclusion based on Art. 24 sec. 5 point 1 of the Act. performerand is not obliged to submit the said document if the Employer can obtain it by means of free and publicly available databases, in particular public registers within the meaning of the Act of 17.2.2005 on computerization of entities performing public tasks (Journal of Laws from 2014 r. item 1114 and from 2016 item 352), and the Contractor shall indicate in the offer the internet address ofthe Employer is to download it; 2) information from the National Criminal Register in the scope specified in art. 24 sec. 1 items 13, 14, 21 of the Act and regarding a conviction for a prison sentence, to the extent specified by the Awarding Entity pursuant to art. 24 sec. 5 points 5 and 6 of the Act, issued not earlier than 6 months before the deadline for submission of tenders; 3) the certificate of the proper head of the office pnotifying that the Contractor is not in arrears with paying taxes, issued not earlier than 3 months before the deadline for submission of bids or other document confirming that the contractor has concluded an agreement with the competent tax authority regarding the repayment of such receivables with possible interest or fines, in particular legally exempted, deferrede or spreading overdue payments into installments or suspending the implementation of the decision of the competent authority in full; 4) a certificate of the relevant local organizational unit of the Social Insurance Institution or the Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with paying social security and health insurance contributions, issued not earlierthan 3 months before the deadline for submission of bids, or other document confirming that the Contractor has entered into an agreement with the competent authority regarding repayment of such receivables with possible interest or fines, in particular obtained legally permissible, postponement or installment payment of overdue payments or suspension in the full implementation of the decision of the competent authority; 5) oproviding the contractor with the lack of a ruling against him as a preventive measure for the prohibition of applying for public procurement (model appendix 6 to the Terms of Reference); 6) the contractor's statement on not paying taxes and local fees, referred to in the Act of 12.1.1991 on local taxes and charges (template Attachment 6 to the Terms of Reference); 7) the contractor's statement about the lack of a final release issued to him-a court judgment or final administrative decision on default of taxes, fees or social security or health insurance premiums, or in the event of issuing such a verdict or decision documents confirming payment of such claims together with any interest or fines or a binding agreement regarding repayment of such debts ( template attachment 6 to SIWWITH); 8) the contractor's statement about the lack of a final conviction of a conviction court for violation of liberty or a fine in the scope specified by the Awarding Entity on the basis of Art. 24 sec. 5 (model appendix 6 to the ToR). 9) the contractor's statement about the lack of a final administrative decision against him in breach of the obligations under labor law, environmental protection lawdocumentation or provisions on social security to the extent specified by the Awarding Entity pursuant to art. 24 sec. 5 point 7 of the Act (template attachment No. 6 to the Terms of Reference);

1. The amendment of the Agreement is acceptable to the extent and under the conditions provided for by the provisions of art. 144 Public Procurement Law, in particular:

1) The parties are entitled to make changes with a total value not exceeding 10% of the total remuneration indicatedgo in - 4 para. 1 of the Agreement, regardless of other cases of changes authorized by PPL. A change made in accordance with this provision, irrespective of its value, may not change the nature of the Contract, in particular to replace the subject of the Agreement with another type of subject;

2) The Parties are entitled to introduce non-substantial changes to the Contract, other than changes definedin art. 144 para. 1e Pzp;

3) pursuant to art. 144 para. 1 point 1 of the PPL, the Contracting Authority provides for the following changes to the Agreement: a) in the event of withdrawal from the market in the Republic of Poland of the license covered by the Agreement, the Employer allows a change consisting in the delivery of a replacement product with parameters meeting the requirements specified in the ToR and the price indicated in the Offere can not be increased; b) in the event of a change in the law, published in the Official Journal of the European Union, Journal of Laws, Polish Monitor or Official Journal of the relevant Minister, the Ordering Party allows changes in the manner of performance of the Agreement or change of the Contractor's services enforced by such amendments to the law ;

2. All changes to the Agreement require a written form in the form of an annexu under pain of nullity, subject to the provisions of - 11 para. 4 of the Contract.

The Purchaser informs that in the present proceedings after examining the offers in terms of errors referred to in art. 87 par. 2 of the Act and the abnormally low price intends, pursuant to art. 24aa of the Public Procurement Law, first evaluate the offers and then examine whether the contractor whose offer was rated as the bestis not subject to exclusion and meets the conditions for participation in the proceedings
