License agreement and annual maintenance license for the ERP / SAP Transaction Reporting and Registration System

Purchase of new licenses, version ECC 6.0 (or equivalent), with the possibility of upgrade to the SAP S / 4 Hana Financial Accounting Platform and the SAP-HANA database as well asannual maintenance services related to these licenses for the ERP / SAP Transaction Reporting and Registration System for a period of 36 months, the detailed description of which is provided in the Product Specification. Deadline until which clarifications can be requested in the awarding documentation: 13 days before the deadline for submitting bids. The contracting authority will-clearly and completely answer the clarification requests / additional information regarding the awarding documentation until the 10th day before the deadline set for the submission of the tenders in the tender notice

Requirement 1:

Statement at your own risk that the economic operator is not in any of the exclusion situations mentioned to art. 164, 165 and 167 of Law no. 98/2016. We specify that bidders, third parties and subcontractorsactants should not be found in the situations provided by art. 164, 165, 167 of Law no. 98 / 2016.

DUAE will be completed in accordance with art. 193 195 of Law 98/2016, the supporting documents being submitted only at the request of the contracting authority, before the award of the contract, to the bidder ranked first after applying the award criterion (according to art.196 par. (See Article 168 of Law 98/2016): any document considered to be edifying from this point of view in the country of origin or in the country where the tenderer / candidate is established . Examples: certificates (tax certificate issued by the tax administration body of the territorial administrative unit from which the companyhas its headquarters for the payment of the obligations to the state budget, the certificate on the payment of local taxes and fees, etc.), the criminal record of the economic operator and the members of the administrative, management or supervisory body of the respective economic operator or those having the power representation, decision or control within it, as evidenced by the certificatedetection liver issued by the ONRC / constitutive act; as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided for in art. 166 par. 2) For viewing the awarding documentation uploaded in SEAP, economic operators must have a program required to view electronically signed files;

3) Bidders are required to confirm electronically receiving the communication on the outcome of the procedure;

4) The contract form will be submitted with possible proposals for modifiersof the specific contractual clauses, proposals which will be accepted only to the extent that they will not obviously be disadvantageous to the contracting authority. In case of non-submission, the bidder is deemed to accept the terms stipulated in the tender documentation; 5) In order to submit the clarification requests regarding the awarding documentation, the economic operatorsbut they will register in SEAP (www.e-licitatie.ro) as an economic operator according to the provisions of art. 5 par. (1) of H.G. no. 395/2016 and will transmit the requests having regard to the contracting authorities' terms of reference provided for in art. 160 161 of Law no. 98/2016; 6) If two or more bids are ranked first, with equal scores, the tie will be made withtaking into account the score obtained with the valuation factors in descending order of their weight. If the equality is maintained, the contracting authority has the right to request new financial proposals and the winning bid will be the one with the lowest financial proposal.
