Cantithe minimum and maximum terms of the framework agreement are in accordance with Annex no. 6 to the specifications.

Frequency of subsequent contracts minimum 4 maximum 10.

Val. of the largest subsequent contract: 1 322 744, 74 RON. 1 must be fulfilled for Lot 1 and Lot 2:

The bidders, associates, third parties and subcontractors must not be found in the situations provided for in art. 164, 165, 167 of the Law no. 98/2016 updated

The way to demonstrate the fulfillment of the requirement: It will be completed: DUAE by the economic operators participating in the award procedure including for potential associates, third parties and subcontractors with the information related to their situation. The supporting documents demonstrating the fulfillment of those undertaken by completing the DUAE-shall be submitted at the request of the contracting authority only by the first, second and third-placed tenderers in the intermediate rankings drawn up at the completion of the evaluation of the tenders.

These documents shall be: - - certificates certifying the absence of debts regarding the payment of taxes, or contributions to the consolidated general budget (local budget, state budget, etc.), diwhich shows that the economic operator has no debts at the time of their presentation (in a legible copy), valid at the time of presentation, - the criminal record certificate of the economic operator and of the members of the administrative, management or supervisory body of the economic operator or those who have power of representation, decision-making or control within it, as it results from the certifying certificate issued by the ONRC / constitutive document (presented in a legible copy) showing that the bidder is not in the situations stipulated by art. 164 of Law no. 98/2016, valid at the moment of presentation, - if necessary, documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Law 98/2016 on public acquisitions, updated, - other editorial documents, as the case may be.

Foreign bidders shall present any editorial documents issued by the competent authorities of the country of origin or of the country where the tenderer is established, prove the fulfillment of requirement no. 1, in accordance with the legislation of the country of origin or country of residence-the bidder is settled. Documents will be presented accompanied by their authorized translation in Romanian.

Requirement no. 2 must be fulfilled for Lot 1 and Lot 2:

Bidders, associates, third parties and subcontractors, as the case may be, must not be found in any of the situations provided by art. 59 60 of the Law no. 98/2016 on public acquisitions, updated;

Opthe economic operator will fill in the appropriate DUAE form in the award documentation, including for potential associates, third parties and subcontractors. The supporting documents: Statement regarding non-compliance with the provisions of art. 59 60 regarding the conflict of interest in Law no. 98/2016, updated - Form no. 1, will be presented with DUAE by everyone(tenderer, associate, subcontractor and third party).

Incorporation in the situation stipulated in art. 59 60 of the Law no. 98/2016 on public acquisitions, it has the exclusion of the tenderer from the procedure applied for awarding the public acquisition contract. The decision-makers within the contracting authority, in respect ofthe organization, running and finalization of the award procedure are:

(a) Considering that the CA will sign the framework agreement only with op. ec. placed in the 1st, 2nd, 3rd place, as the case may be, the way of bidding with equal scores will be done todayhe / she:

1) If the commission finds that more than 2 admissible tenders with equal scores to the first ranked bidders have been submitted / entered into the SICAP, the AC will request the submission of new improved financial proposals (with 2 decimal places) and op. ec. will send their answer to the SICAP, in which case the framework agreement will be awarded to the first three bidders with the highest score;in which the commission finds that more than 2 admissible tenders with equal scores have been submitted by the second rank bidders, the way of their classification will be made by requesting the submission to the SICAP of new improved financial proposals (with 2 decimal places) and op. ec. will send their response so that the bidder ranked first is not affected, ie the new proposal-financial position is not equal to or less than the ranked first place. If the new financial proposal improved as a result of the CA request, it will influence the ranking. this will not be taken into account keeping the initial bid submitted to the SICAP in the proceedings; 3) If the commission finds that more than 2 admissible offers with ega scores have been submittedby the third-ranked bidders, the way they will be settled will be by requesting the submission to the SICAP of a new improved financial proposal (with 2 decimal places), and op. ec. will send their response so that the first and second-placed bidders are not affected, ie the new improved financial proposal presented as a result of the CA request will influence classparagraphs I and II, this shall not be taken into account, keeping the initial bid submitted in the SICAP in the proceedings. Deadlines / dates for submission of new financial proposals will be communicated in the CA request.

(c) The CA will conclude a framework agreement with max 3 ops. ec. with relution of the competition with op. ec. whose offers are admissible and which are in the 1st, 2nd and 3rd place. If there are no 3 ops. ec. with admissible offers the framework agreement will end with 2 ops. ec. If there are no 2 ops. ec. with admissible offers, the framework agreement will end with 1 op. e., (d) Opted in the first, second and third place, which submit a joint tender for the procedure, will present the Legalized Association Act - Form no. 5 before the contract is concluded,

(e) In accordance with prev. art. 160 par. (1) of Law 98/2016, with modif. and completely. ul., the deadline. up to which any op. ec. interested in participation in the public procurement procedure has the right to request clarifications or additional information regarding the awarding documentation is 17 days inwithin the time limit of the tenders. In accordance with prev. 160 par. (2) of L.98 / 2016, with modifi cation and complete ult., AC establishes the deadline in which it will respond to all requests for clarification / information. Extras. is 10 days before the deadline. of dep. a of., AC not going to run the call. addressed by another means of communication or other term than the one established, (f) Penfor subsequent posting tenders, the eval commission. will forward a request for clarification. in the leg. with the offer through the SICAP (section "Questions")

OPEC will send the answers to the clarifications and the possible documents requested during the evaluation of the bids via SICAP (section "Questions") in electronic format, signed with the signature extended electronics.
