The object of the order is performance by the Contractor for the Ordering Party modernization of the system of continuous emission measurements to the air from emitters E3 (K8 and K9), E4 (K1 and K2), E5 (Ep1 and Ep2) at EC Siekierki to comply with the requirements of the BAT

The subject of the order is the performance by the Contractor for the Ordering Party of the modernization of the system of continuous emissions to air from emitters E3 (K8 and K9), E4 (K1 for the electrostatic precipitator and K2 for the filter installation wor), E5 (E5p1 and E5p2 after MIOS absorbers) ("CEMS", "Emission measurement system", or "Installation") at Siekierki's EC, in order to adapt to the requirements of Commission Implementing Decision (EU) 2017/1442 dated 31.7.2017 laying down the Best Available Techniques (BAT) Conclusions for large combustion plants in line with the Directive of the European Parliament and of the Council 2010/75 / EU in the scope of monitoring concentration emission of dust-gas contaminants from emitters E3 (K8 and K9), E4 (K1 and K2), E5 (Ep1 and Ep2) and adaptation of emission reporting systems to modernized CEMS installations at EC Siekierki, which formal application will be the settlement of emissions from emitters E3 (K8 and K9), E4 (K1 and K2), E5 (E5p1 and E5p2) with the Office of the Marshal of Wojewodztwa Maz oo and the Voivodship Inspectorate for Environmental Protection, in accordance with the regulations in force. - The Contractor shall provide the Ordering Party with a copy of the relevant register or central records and business information, if separate regulations require entry in the register or records in order to confirm the absence of grounds for exclusion based on art. 24 sec. 5 point 1 of the Act

1.Contractors excluded from the proceedings: - did not show compliance with the conditions for participation in the proceedings, or did not show no grounds for exclusion, - a contractor who is a natural person who has been convicted of a crime: - a) referred to in art. 165a, art. 181 188, art. 189a, art. 218 221, art. 228 230a, art. 250a, art. 258 or art. 270, 309 of the Act of June 6, 1997. The Penal Code (Journal of Laws - Dz.U. pos. 553, from d.) or art. 46 or art. 48 of the Act of 25.6.2010 on Sport (Journal of Laws of 2016, item 176),

b) of a terrorist character, referred to in art. 115 - 20 of the Act of June 6, 1997. Penal Code, - c) treasury, - if a member of its management or supervisory body, a partner of a company in a registered partnership or partnership or a general partner in the limited partnershipe. or a limited joint-stock partnership or a commercial proxy were convicted for the offense referred to in art. 24 sec. 1 point 13 (excluding the conviction of this person for the offense listed in Article 24 (1) point 13 (d) of the Act Article 133 (4) of the Act), - to which a final court judgment or final administrative decision on payment was settled taxes, fees or insurance premiumsif the Contractor has made payment of taxes, fees or social or health insurance contributions with interest or fines, or has entered into a binding agreement regarding the repayment of such claims,

- who, as a result of intentional action or gross negligence, has misled the Employer when presenting information that it is not subject to exclusion, spthe conditions for participation in the procedure or objective and non-discriminatory criteria, hereinafter referred to as "selection criteria", or who has concealed this information or are unable to produce the required documents, - which as a result of carelessness or negligence, provided misleading information to the Ordering Party that could have significant influence on decisions made by the Ordering Party in the ou proceedingsdividing the order, - which unlawfully influenced or attempted to influence the actions of the Ordering Party or obtain confidential information that could give him an advantage in the procurement procedure, - who participated in the preparation of the procurement procedure or whose employee, as well as the person performing work on based on a contract of mandate, work, agency or other contract for the provision ofservants, participated in the preparation of such proceedings, unless the resulting distortion of competition can be eliminated in other ways than by excluding the Contractor from participation in the proceedings, - which - with other Contractors has concluded an agreement to distort competition between Contractors in the procurement procedure what the Employer is able to demonstrate with the appropriatein the evidence medium,

- being a collective entity, against which the court has ruled that it is prohibited from applying for public orders, - against which a preventive measure was banned from applying for public orders, - Contractors who, in the same capital group, submitted separate offers, offers, unless they show that the links existing between them do not lead to the disruption of kocompetition in the award procedure, - in relation to which the liquidation was opened or whose bankruptcy was announced, with the exception of the Contractor who, after the bankruptcy, concluded an arrangement approved by a valid court order.

Purchaser pursuant to Art. 24aa paragraph 1 of the Public Procurement Law, may first evaluate the offers, and then examine whether the contractor, whose offer was rated as the highestmore advantageous, it is not subject to exclusion and meets the conditions for participation in the proceedings.

The offer under pain of nullity should be prepared in electronic form and submitted via the Bidding Platform at https://termika.eb2b.com.pl/. The offer, together with all attachments, is submitted in electronic form with a qualified electronic signature or a certified copyfor compliance with the original by submitting a qualified electronic signature by the Contractor. All documents prepared in a foreign language must be submitted together with the translations into Polish.

The offer with attachments must be signed by the person / s authorized to represent the Contractor. Authorization (power of attorney) to sign the offer should be attached to the offer, if notit results from other documents attached by the Contractor.

By submitting its tender, the Contractor accepts in full and without reservations the terms of ordering specified in the Terms of Reference (hereinafter referred to as "SIWZ") with all attachments constituting its integral part. that the Contractor is not subject to exclusion and meetsparticipation in the proceedings, the Contractor encloses to the offer valid on the day of submitting offers a declaration in the form of a single document available in an editable form posted on the Employer's website. Contractor who refers to the resources of other entities, to demonstrate the absence of grounds for exclusion against them, and fulfillment, in so far as it relies on themthe asylum, conditions for participation in the proceedings, submit in electronic form also uniform documents relating to these entities, signed by the entity whose documents relate.

In the case of joint application for contractors, a single document shall be submitted electronically to each of the contractors jointly applying for the order. These documents confirmmeeting the conditions for participation in the proceedings and the lack of grounds for exclusion to the extent that each contractor demonstrates fulfillment of the conditions for participation in the proceedings and no grounds for exclusion.

The Contracting Authority initiated this procedure after cancellation of proceedings 19DOZZ041 for Modernization of the system of continuous emissions to air from emitters E3 (K8 and K9), E4 (K1 and K2), E5 (Ep1 and Ep2) in ECSiekierki to adapt to the requirements of the BAT conclusions.

Pursuant to art. 43 par. 2a of the Public Procurement Law, the Awarding Entity set the deadline for submission of tenders 15 days from the date of publication of the notice of procurement to the Publications Office of the European Union due to the urgent need for the order resulting from the BAT conclusions coming into force. In addition, the shortening of the deadline for submitting bids is justified bythat the conditions for participation in the procedure and the scope of the order did not change significantly compared to those determined in the annulled proceedings 19DOZZ041, which were conducted in an open tender procedure in accordance with the Public Procurement Law.
