The minimum estimated amount of the framework agreement is 12 months.

The maximum estimated amount of the framework agreement is 48 months.

Requirement 1. Bidders, third partiesthe supporters and subcontractors must not find themselves in the situations provided in art. 164, 165, 167 of Law 98/2016. The contracting authority excludes from the procedure any economic operator that is in one of the situations provided for in art. 164 of Law 98/2016. By exception from the provisions of art. 164 para. (1) and (2), in exceptional cases, the contracting authority is entitled to nu excludes from the award procedure an economic operator who is in one of the situations provided for in art. 164 para. (1) and (2), for overriding reasons of general interest, such as public health or environmental protection. The contracting authority excludes from the procedure any economic operator that is in one of the situations provided for in art. 165 (1), (2) of Law 98/2016. The operator isconomic is not excluded from the award procedure if, prior to the exclusion decision, it fulfills its obligations by paying taxes, taxes or contributions to the general consolidated budget due either by other means of extinguishing them or benefiting, according to the law, by their scheduling or by other facilities for their payment, including, if necessary, eventualelor accrued interest or late payment penalties or fines. By exception from the provisions of art. 165 para. (1) and (2), an economic operator is not excluded from the award procedure when the amount of taxes, taxes and contributions to the general consolidated budget due and outstanding is less than RON 10, 000. The contracting authority excludes from the procedure any economic operatorwhich is in one of the situations provided in art. 167 of Law 98/2016. By exception from the provisions of par. (1) lit. b), the contracting authority does not exclude from the award procedure an economic operator against whom the general insolvency procedure was opened when, on the basis of the information and / or documents presented by the economic operator in question, it establishes that it has asthe peace to execute the public procurement contract. This implies that the respective economic operator is either in the observation phase and has adopted the necessary measures to draw up a feasible reorganization plan, which allows the continuation, in a sustainable way, of the current activity, or is within the judicial reorganization phase and is respected. the complete implementation plan of the planu reorganization approved by the court. Modality of fulfillment of requirement 1: DUAE will be completed according to art. 193 of Law 98/2016, by the economic operators participating in the award procedure with the information related to their situation. The supporting documents proving the fulfillment of those assumed by completing the DUAE will be presented, at the request of the contracting authority, by the bidder ranked 1st, in the intermediate ranking drawn up at the end of the bids. These documents will be:

1) certificates of fiscal attestation regarding the lack of outstanding debts regarding the payment of taxes, taxes or contributions to the general consolidated budget (the state budget, etc.) at the time of presentation;

2) as the case, the documents by which it is shown that opthe economic error may benefit from the derogations provided in art. 166 para. (2), art. 167 of Law 98/2016 on public procurement;

3) the criminal record of the economic operator and of the members of the administration, management or supervisory body of the respective economic operator or of those who have power of representation, decision or control within to him, as it turns out diin the certifying certificate issued by the ONRC / the constitutive document;

4) other edifying documents, as the case may be.

Specify the average annual turnover.The average value of the turnover for the last three years (2016, 2017, 2018) should be at least equal to 722 232 RON excluding VAT.

If two or more offers are ranked first, with equal scores, the division it will be done taking into account the score obtained by the evaluation factors in descending order of their weights. In the situation where equality is maintained, the authority cohowever, it is entitled to request new financial proposals and the winning bid will be designated the one with the smallest financial proposal.
