Removal and management of waste stored on real estate at ul. Szosa Okrężna 11 in Toruń

The subject of the order is the removal of waste from the municipal property located at ul. sOkrężna 11 in Toruń (part of plot No. 97 and 141/2, round 21) and their management in accordance with the requirements resulting from the provisions of the Act of 14.12.2012 on waste (Journal of Laws of 2019, item 701).

1. The subject of the order is the removal of waste from the municipal property located at ul. Szosa Okrężna 11 in Toruń (part of plot no. 97 and 141/2, round 21) and their headquarterssettling in accordance with the requirements resulting from the provisions of the Act of 14.12.2012 on waste (Journal of Laws of 2019, item 701).

2. Removal of waste will take place as part of the substitute implementation procedure carried out by the Employer based on the provisions of the Act of 17.6.1966 on enforcement proceedings in administration (Journal of Laws of 2018, item 1314, as amended). 3. Intended to removeWaste is of undetermined origin chemical substances, being waste most probably from the paint industry, production or use of paints, adhesives and organic compound processing. According to the expert's opinion, the collected wastes mostly consist of organic compounds belonging to groups of alcohols, acids, esters, ethers, diols (glycols) and ketones.and should be classified according to the waste catalog as hazardous waste with codes: - - 07 04 04 (Other organic solvents, washing solutions and mother liquids), - - 08 01 11 (Waste paint and varnish containing organic solvents or other dangerous substances),

- 08 01 14 (sludges from removing paints and lacquers other than those mentioned in 08 01 13).

On account of the fact thatthe source of origin is allowed to qualify these waste as waste of other codes, in accordance with the provisions of the Ordinance of the Minister of the Environment of 9/12/2014 regarding the waste catalog (Journal of Laws of 2014, item 1923), including waste code:

- 16 81 01 (Wastes with hazardous properties)

4. A detailed description of the subject of the order is included in point 1 of the ToR and modelcontracts - Contractors must demonstrate that they meet the conditions regarding competences or entitlements to conduct a specific professional activity, if it results from separate regulations:

1) they are entitled to transport waste pursuant to the provisions of the Act of 14.12.2012 on waste (Journal of Laws of 2019, item 701).

2) have permits to process waste indicated in point 1.3 of the ToR on the basis ofof the Act of 14.12.2012 on Waste (Dz.Uz 2019, item 701).

The Contracting Party, before awarding the contract, will call the Contractor whose tender has been the highest rated, to submit the current deadline within not more than 10 days. on the day of submitting statements or documents confirming the circumstances referred to in art. 25 para. 1 of the PPL Act, i.e. concessions, licenses or licensesa document confirming that the contractor is registered in one of the professional or trade registers kept in a Member State of the European Union in which the contractor is established or domiciled, i.e. a) confirming the entry into the register of entities introducing products, products in packaging and managing waste referred to in the provisions of the Act of 14.12.2012 on waste in the area of waste transport with the codes indicated in point 1.3. SIWZ.

B) permission for processing of waste indicated in point 1.3 of the ToR.

Based on the provisions of the Act of 14.12.2012 on waste (Journal of Laws of 2019, item 701).

Not applicable

1 . Contracts may be applied for by contractors who:

1) are not subject to exclusion

2) they meet the following conditions of participation.

2. In order to sweatthe fulfillment of the conditions for participation in the proceedings and demonstration of the lack of grounds for exclusion, the contractors submit the following documents with the offer: - 1) original EAT in electronic version, - 2) obligation of the entities to give the Contractor at the disposal of the necessary resources for the order fulfillment, if the Contractor relies on the ability technical or professional or financial situationor the economic nature of other entities, regardless of the legal nature of the legal relationship that links them with them, - 3) the contractor's statement on whether or not to belong to the same capital group.

3. In order to assess whether the contractor, relying on the abilities or situation of other entities under the principles set out in Article 22a of the Act, will have the necessary resources to the extent possibledue to the proper execution of the public order and the assessment of whether the relationship between the Contractor and these entities guarantees effective access to their resources, the contracting authority requests documents that specify in particular: a) the scope of resources available to the Contractor of another entity, b) how to use the resources of another entity, by the Contractor, while performing the public order; - c) scope and durationother entities in the performance of a public order, d) whether entities, on the capacities of which the contractor relies in terms of participation in education proceedings, professional qualifications or experience, carry out construction works or services whose indicated capacities relate to - 4. Other documents:

- Contractor's statement, which of the information contained in the offer nand pages from ... to ... constitute a trade secret in the sense of the provisions of the Act on Combating Unfair Competition and as such they can not be made available to other participants of the proceedings. In the event of reservation of information by the contractor, he is obliged to show that the proprietary information is the trade secret, - the Contractor's statement as to which part of the order he intends toto subcontract and provide subcontractors,

- proof of payment of a bid bond.

Purchaser, in accordance with art. 25 para. 1 of the Act, will call the Contractor whose offer has been rated the most, to submit in the designated, not shorter than 10 days, the current filling of declarations or documents: - - confirmation of entry in the register of entities introducing products, products in packagingand waste management facilities with the codes indicated in point 1.3. SIWZ,

- permits to process waste indicated in point 1.3 of the ToR,

- Information from the NQF in the scope specified in art. 24 sec. 1 points 13, 14 and 21 of the Act issued not earlier than 6 m before the deadline for submission of bids,

- Declaration of the contractor about the lack of a final court judgment or final administrative decision against himon the payment of taxes, fees or social security or health insurance premiums or - in the event of such a verdict or decision - documents confirming the payment of such claims together with any interest or fines or a binding agreement on repayment of such claims, - Statement contractors about the lack of a judgment against him in the title ofpreventive measure of not applying for public orders,

- List of services, list of persons

5. The list of documents and statements to be provided by the domestic contractor or the contractor having its registered office or place of residence outside the territory of the Republic of Poland can be found in clauses 4.3.7 to 4.3.10 of the SETC-6. If the Contractor relies on the abilities or situation of other entities on specific termsin art 22a of the Act presents, with reference to entities, the document mentioned in point 4.3.2 of the ToR and the statements referred to in clauses 4.3.3 and 4.3.4 of the SETC-7. The ordering party will use the reversed procedure, pursuant to art. 24aa of the Public Procurement Law
