1. The subject of the orderis the delivery of server hardware and devices as well as the provision of IT services.

Main Site: Poviat Eldership in Gołdap, ul. Krotka 1, 19-500 Gołdap, POLAND.

The subject of the order is: - Establishment of public e-services with the launch of on-line payment functionality and launch of a geoportal compliant with the WCAG 2.0 standard

Modernization of domain systems

GIS platform - budona geoportalu

The service line integrating ePUAP, EZD and domain systems services

Training for employees in the scope of servicing the e-services implemented.

A detailed description of the part is included in Annex No. 1 to the ToR.

1 The Contractors who do not are subject to exclusion based on:

1) art. 24 section 1 point 12) -23) of the Public Procurement Law;

2) art. 24 sec. 5 point 1), -2), 4) and 8) i.e. in relation to which the liquidation was opened, in the court-approved arrangement in the restructuring proceedings, the creditors' satisfaction is foreseen by liquidation of their property or the court ordered the liquidation of its property pursuant to art. 332 par. 1 of the Act of 15.5.2015 - Restructuring Law (consolidated text of the Journal of Laws of 2016, item 1574, as amended) or whose bankruptcy was announced, with the exception of the contractor who, after the bankruptcy, has concluded an arrangement approved by a final court order, if the arrangement does not provide for satisfying creditors by liquidating the assets of the bankrupt, unless the court ordered the liquidation of its assets pursuant to art. 366 para. 1 of the Act of 28.2.2003 - The Bankruptcy Law (ie, Journal of Laws of 2016, item 2171, as amended.)

B) who in a seriously culpable wayviolated his professional duties, which undermines his integrity, in particular when the contractor failed to perform or improperly performed the order as a result of deliberate action or gross negligence, which the contracting authority is able to demonstrate by means of appropriate evidence; c) who, for reasons attributable to him,, did not execute or improperly executed a prior contract in casesNot a public contract or concession contract, concluded with the ordering party referred to in art. 3 par. 1 point 1-4 of the Act on Public Procurement Law, which led to the termination of the contract or compensation.

D) who violated obligations relating to payment of taxes, fees or social security or health insurance contributions, which the contracting authority is able to demonstrate by means of appropriate evidenceexcept in the case referred to in Article 24 sec. 1 point 15 of the Act on Public Procurement Law, unless the contractor made payment of taxes due, fees or social security or health insurance contributions with interest or fines or has concluded a binding agreement regarding the repayment of such claims. 2 Contractor who is subject to exclusion pursuant to art. 24 sec. 1 items 13 -14 and 16-20 or paragraph 5 of the Act on Public Procurement Law, may provide evidence that the measures taken by it are sufficient to demonstrate its reliability, in particular to prove compensation for damage caused by a crime or fiscal offense, financial compensation for damage suffered or rectified, an exhaustive explanation of the facts and cooperation with the bodies ofto pursue and take specific technical, organizational and human resources that are appropriate to prevent further offenses or fiscal offenses or improper conduct of the Contractor. The regulation referred to in the first sentence shall not apply if the Contractor, being a collective entity, has been the subject of a final court decision prohibiting to apply for-the Contractor is not subject to exclusion, if the Awarding Entity, considering the weight and special circumstances of the Contractor's action, deems sufficient evidence presented on the basis of art. 24 sec. 8 of the Public Procurement Law.

1. By entering into this proceeding, each Contractor is obliged to submit a bid bond, for each of the parts separately in the amount of: - Part No. 1 PLN 6, 000.00 (in words: six thousand PLN 00/100).

Part No. 2 PLN 10, 000.00 (in words: ten zlotys 00/100).

1.1 The Contractor may pay a deposit in one or several of the forms provided for in Article 45 par. 6 of the Act, i.e.: 1) of money,

2) bank guarantees or social and credit union sureties, except that the suretyie cash register is always a cash guarantee,

3) bank guarantees,

4) insurance guarantees,

5) sureties granted by entities referred to in art. 6 b para. 5 point 2 of the Act of 9.11.2000 on the establishment of the Polish Agency for Enterprise Development (ie, Journal of Laws of 2016, item 359, as amended).

2 The contractor is obliged to pay a deposit before the deadline for submission of tenders. Wadium in money should be paid by bank transfer to the Employer's bank account: Bank BGŻ BNP Paribas No. 51 2030 0045 1110 0000 0228 1500.

4 In the case of a security lodged in cash, the deadline for recognizing the amount on the Employer's account is accepted as payment deadline. before the set deadline for submission of tenders, ie before 27/11/2018, at 11.00.

6 For the interiorThe deposit of the bid bond in the form other than money, confirming the payment of the bid bond must be attached to the tender.

7 Failure to pay the bid bond or bring it in an incorrect manner will result in rejection of the offer under Art. 89 paragraph 1 point 7b of the Act on Public Procurement Law.

8 Repayment of the bid bond

1) the orderer returns the bid bond to all contractors immediately after the selection of the offermore often, or cancellation of the proceedings, with the exception of the contractor whose tender was chosen as the most advantageous or invalidation procedure, with the exception of the contractor whose tender was selected as the most advantageous, subject to point 6;

2) contractor whose offer was selected as the most advantageous, the contracting party draws a bid bond immediately after the conclusion of the contract for ordersand 3) the ordering party shall immediately return the tender bond at the request of the contractor, who withdrew the offer before the deadline for submitting bids;

4) the contracting authority requests that the bidder reimburse the bidder who has returned the bid security on the basis of point 1, if as a result of resolving the appeal his offer has been-selected as the most advantageous; the contractor submits the bid bond within the time specified by the ordering party. 5) if the deposit was paid in cash, the ordering party returns it together with interest resulting from the bank account agreement on which it was stored, less the cost of running a bank account and bank commission for transferring money to the account bank indicated by the contractor;

6) zthe entrant shall secure the bid bond with interest, if the contractor in response to the call referred to in art. 26 par. 3 and 3a of the PZP Act, for reasons attributable to him, he did not submit declarations or documents confirming the circumstances referred to in art. 25 ust. 1 of the Public Procurement Law, the declarations referred to in art. 25a para. 1 of the PPL Act, powers of attorney or did not agree to improve omypairs referred to in art. 87 par. 2 point 3 of the Public Procurement Law Act, which meant that the tender submitted by the contractor was not the most advantageous;

7) the contracting party shall retain the bid bond with interest if the contractor whose tender was selected: a) refused to sign the public procurement contract on the terms set out in - b) did not make the required collateral due in(c) the conclusion of a public procurement contract is impossible due to reasons attributable to the contractor
