The current identity card is to be replaced by a new generation of products. A suitable general contractor is to be evaluated and mandated with the production and delivery of blank cards (optionally with electronic storage system), the provision of all the means of production (manufacturing equipment for personalisation and shipping), services (project management, development, implementation, approval, training, maintenance, servicing and support) and delivery of all the associated documentation. The basic service includes general contracting services, 6 000 000 blank cards, 2 dispatch and personalisation systems each and one production control system.

The following proof of suitability must be confirmed or enclosed and met in full and without any reservation or modification along with the tender itself; otherwise, the tender will not be considered.

EC 01: The tenderer must in principle accept the draft framework agreement C including the associated annexes without any amendments or reservations; in particular, the applicable General Terms and Conditions of the Confederation and the associated derogations.

Note:

The tenderer is asked to submit questions within the framework of the Q&A session or with the offer or, in exceptional cases, to submit proposals for amendments to a few individual provisions of the framework agreement C and its annexes. No general reservations shall be entered into.

EC 02: The tenderer and the major subcontractors which provide the main services must be suited to the performance of the contract (see Art. 6a of the Federal Identity Documents Act and Art. 16 of the identity documents ordinance).

The term major subcontractor is used to refer to: (unless the provider provides these services personally).

— the manufacturer of blank cards,

— the manufacturer of the storage system (chip and software),

— the manufacturer of the personalisation systems,

— the manufacturer of the shipping systems,

— the manufacturer of the control system.

EC 03: The tenderer must have sufficient sound expertise and practical experience in the field of identity documents (projects, products, technologies, standards and guidelines, see Art. 6a of the Federal Identity Documents Act and Art. 16 of the identity documents ordinance) for the fulfillment of the contract.

EC 04: The tenderer and the important subcontractor responsible for the delivery of blank cards must have a certified quality management system (ISO 9000 or other systems recognised as equivalent, see Art. 6a of the Federal Identity Documents Act and Art. 16 of the identity documents ordinance).

EC 05: The tenderer must be financially sound and have the financial resources required for the fulfillment of the contract (see Art. 6a of the Federal Identity Documents Act and Art. 16 of the identity documents ordinance).

If the tenderer is part of a group of companies, this requirement also applies to its parent company, which provides a performance guarantee in accordance with the framework agreement.

EC 06: There are no pending collections of taxes or social security contributions and no seizures or bankruptcy proceedings against the provider or any of the major subcontractors (see EC-02) in progress (see Art. 6a of the Federal Identity Documents Act and Art. 16 of the identity documents ordinance).

EC 07: The tenderer and the major subcontractors must have appropriate human resources with a faultless reputation for the fulfillment of the contract in accordance with Art. 6a para 2 of the Federal Identity Documents Act (see Art. 6a of the Federal Identity Documents Act and Art. 16 of the identity documents ordinance).

Similarly, beneficial owners, holders of shares, members of the board of directors or another comparable body, members of the management and other persons who have or may have a significant influence on the tenderer, an important subcontractor or the production of ID cards must have a good reputation.

If the provider is part of a group or group of companies, these requirements apply in particular to the parent company, which provides a performance guarantee in accordance with the framework agreement.

EC 08: The manufacturer responsible for the delivery of blank cards (provider or important subcontractor) must have obtained certification as a "High Security Management System for Secure Printing" in accordance with CWA 14641:2009, or be certified to "Governmental Level" in accordance with ISO14298:2013.

EC 09: The tenderer accepts that all contracts with the client shall be governed by Swiss law and that their place of jurisdiction shall be Bern.

Terms of business: The framework agreement C including the GTC of the Confederation and derogations shall be decisive for the provision of services. Any reservations for compelling objective reasons must be specified in detail in the tender. If these reservations cannot be settled by negotiations, the procurement entity reserves the right to exclude the relevant tenderer.

Negotiations: Remain reserved. The awarding entity will not conduct any price negotiation rounds. Tenderers will only be given the opportunity to adapt their prices if so warranted by special circumstances such as the clarification or specification of the requirements and if the awarding entity exceptionally and explicitly permits it with invitations to possible negotiations. The awarding authority reserves the right to resolve any reservations to the framework agreement C by negotiation.

Basic procedural principles: The client awards public contracts for services in Switzerland only to tenderers guaranteeing compliance with workplace health and safety provisions and employee working conditions, as well as equal pay for men and women. If the place of performance is abroad, the tenderer must guarantee compliance with at least the core conventions of the International labour organization in accordance with Annex 2a of the PPO. The self-declaration of the Federal Procurement Conference (FPC), "Tenderer's self-declaration concerning compliance with minimum social requirements" is to be signed and enclosed with the tender.

Additional information: Subject to the procurement maturity of the project and the availability of budget. Successful tenderers agree to adapt their prices accordingly if there is a fall in market prices in the course of the procurement period. The decision as to whether or not prices have fallen will be based on the time of full or partial delivery. The contracting authority reserves the right to issue another invitation to tender if, in the course of time, the selected tender is no longer the most economically advantageous. The contracting authority reserves the right to have the awarded services provided additionally to other entities requiring these services within the federal administration, as well as to procure the services defined as optional in their entirety, in part or not at all.

Procedures for appeal: Pursuant to Art. 30 of the federal act on public procurement, an appeal against this publication may be filed within 20 days since notification in writing in an official language of Switzerland to the Federal Administrative Court, Postfach, 9023 St.Gallen. The appeal petition must be submitted in duplicate and must contain the application, the grounds of appeal with details of the evidence and the signature of the appellant or his agent; a copy of the present publication and documents cited as evidence must be attached, provided they are in the appellant's possession.
