Anti-Seal Seals are designed to provide security against unauthorized access to natural gas regulation and metering equipment within control, metering and regulating-metering stations and against unauthorized access to measurement equipment within the facilityof electricity distribution.

The minimum and maximum quantities for both the subsequent contracts and the framework agreement are found in Annex 2 - Minimum / Maximum Required Amounts attached to this Invitation to Participation

The estimated value for the Framework Agreement : min. 605712, 00 RON / max. 2 126 000.00 RON.

Estimated quantity for the framework agreement: min. 996 600 pcs / max. 3 480 000 pcs

Proportion value for the greater contract: min. 201 904, 00 RON / max. 1 009 520, 00 RON.

Estimated quantity for the next successive contract: min. 332 200 pcs / max. 1 661 000 pieces

1) Candidates / tenderers, associations, supporters and subcontractors should notis to find himself in any of the situations provided by art. 177, 178 and 180 of Law no. 99 / 2016.

Means of performance demonstrating the fulfillment of the requirement: the DUAE will be completed according to Notification no. 240/2016 on the DUAE User Guide by the economic operators participating in the award procedure with the information related to their situation. Documents jufiduciary certificates demonstrating the fulfillment of those undertaken by completing the DUAE are required for all selected candidates prior to the submission of invitations for the second stage of the award procedure. These documents may be: (a) certificates of absence of overdue debts in respect of the payment of taxes, duties or contributions to the general consolidated budget (local budget, (b) the criminal record of the economic operator and / or of the members of the administrative, management or supervisory body of the economic operator, or of those having the power to represent, decide or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act,

(c) as appropriate, in which it is demonstrated that the economic operator may benefit from the derogations provided in art. 179 par. (2), art. 180 par. (2), art. 184 of the Law no. 99/2016 regarding the sector acquisitions; 2) The economic operators who are bidding must not be in the situations stipulated in art. 73 (avoidance of conflict of interests) of Law no. 99 / 2016.

For this, all economic operators (bidderassociations, third parties and subcontractors) will complete and submit a "Declaration on non-compliance in the situations stipulated in art. 73 of the Law no. (1) of Law No. 99/2016 are:

Persons approving / signing documents issued in connection with the present procurement procedure are Mariana Fisca, Ana-Maria Gurghian, Izsak Ramona Izabella, Codruta Schwartz, Bogdan Cirstea, Angela Vasile, Alin Urcan, Mihaela Loredana Cazacu, Florin Manea, Sorin Balauta, Stelian Buliga, Ovidiu Romanti, Marius Iuzic, JohnDanut Ungur.

The failure to state the statement with the DUAE (including the associate / third party supporter, subcontractor) entails its rejection as unacceptable.

The following documents will be filed with the DUAE: the firm's firm commitment of the third party, will materialize its support, the subcontracting agreement and / or the association agreement, as the case may be. Ntheir release with the DUAE is the basis for requesting clarification of any inaccurate form of information contained in the DUAE sections of both the candidate / tenderer and the subcontractor / third party, which is necessary to ensure the proper conduct of the award.

Candidates / bidders, third partiesand the subcontractors submitting the application / offer must prove a form of registration under the law of the country of residence, from which it appears that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the establishment and that has the professional capacity to perform the activities covered by the contract. The economic operator will provide information on the global average turnover over the past 3 years. The average total turnover over the past 3 years (2016, 2017, 2018) must be at least: RON 1 009 520.00. The average reference rate of the equivalent RON / other currency set by the National Bank of Romania for each year.

Delgaz Grid provides the electricity distribution service under License no. 1791 granted to E.ON Distributie Romania S.A. by the ANRE President's Decision no. 1170 / 28.5.2015, with subsequent amendments and completionse. Similarly, Delgaz Grid carries out the activities of the gas distribution system based on License no. 1876 granted to E.ON Gaz Distribuţie S.A. by the ANRE President's Decision no. 3219 of 30.10.2013, as subsequently amended and supplemented.

Thus, Delgaz Grid, as holder of License no. 1876, having the exclusive right to perform the servicedistribution of natural gas through the distribution systems licensed to it, in the localities specified in the annexes of the license, enjoys an exclusive right to operate the distribution system, through the provision of some natural monopoly activities, within the meaning of Law 123/2012.

Delgaz Grid benefits from exclusive or special rights, as a concessionaire of thedistribution of electricity and natural gas and holder of licenses for the activity of natural gas distribution and distribution of electricity, and in this respect started the formalities stipulated in art. 162 par. (1) of HGR no. 394/2016 regarding the issuance by ANRE of the decision that Delgaz Grid S.A. has the status of contracting entity, within the meaning of art. 4 par. (1) lit. c) of Law no. 99/2016 on sector acquisitions and that it has the obligation to apply Law no. 99 / 2016.

The contracting entity does not want to limit the number of economic agents. All economic operators who meet the qualification requirements will be selected for stage II of the procedure.

According to Law no. 99/2016 - art. 95 par. (8) - if the number of candidates fulfillingthat the qualification and selection criteria are lower than the minimum number indicated in the invitation to tender procedure according to the provisions of paragraph (4), the contracting entity has the right to opt between continuing the award procedure only with the candidate (s) fulfilling the required requirements and canceling the procedure, under the conditions stipulated in art. 226

Onduring the procurement procedure, the contracting entity will use the e-mail as a way of communicating with the candidates / tenderers. The communications will be sent to the e-mail addresses mentioned by the candidates / bidders on the DUAE forms submitted / forwarding letters.

Note: As the procurement procedure takes place in two stages, the contracting entity requests that in the first(for each candidate / associate / subcontractor / third party supporters), - the Association Agreement (if applicable), - submitting the following documents: - DUAE Form completed with all the information required by the awarding documentation ),

- Subcontracting Agreement (if applicable),

- Suspension Commitment (if applicable),

- Declarationresulting in failure to comply with the situations stipulated in art. 73 of the Law no. 99/2016 on Sector Acquisitions - Form 3 (for each candidate / associate / subcontractor / third party supporter).

The supporting documents demonstrating the fulfillment of the assumed completion by the DUAE will be requested from all selected candidates prior to the submission of the invitations for the second stage of the procedure ofTribu.
