The subject of the order is the carriage of coal by road transport for Tauron Ciepło Sp. z o.o. District of Heat Generation Olkusz, Zawiercie, Kamienna Gora from the mine: KWK Mysłowice-Wesoła, KWK Murcki-Staszic, KWKROW, KWK Jankowice, KWK Rydułtowy.

The subject of the order is the performance of a coal transport service with a maximum quantity of 21, 000 Mg.

1. Contractors who are not subject to exclusion from the proceedings under Art. 24 sec. 1 Pzp and art. 24 sec. 5 points 1 and 8 Pzp, subject to art. 133 ust. 4 Pzpand meet the conditions set out in Article 22 ust. 1 Pzp, in accordance with art. 22 ust. 1b of the PPL regarding:

1.1. Competences or entitlements to conduct a specific professional activity, if it results from separate regulations, requirements of the Employer are described in point III 1.3.) Announcements

1.2. In economic or financial situation, the Employer does not set any requirements in this respect.

1.3. Technical abilitiesj or professional requirements of the Employer are described in point III 1.3.) Announcements.

2. The Contractor, for the preliminary confirmation that he is not subject to exclusion and meets the conditions for participation in the Proceeding, submits the Single European Order Document (EAT). The electronic communication means used for submitting EAT by the Contractor is e-mail.

3. According to art. 26 par. 1 Pzp ped by ordering, the Ordering Party will call the Contractor whose offer has been the highest rated, to submit within the prescribed period, not shorter than 10 days, valid as of the day of submitting statements or documents confirming the circumstances referred to in art. 25 ust. 1 Pzp.

4. In order to demonstrate the absence of grounds for exclusion, the Contractor should provide the following declarations and documents:

4.1. Information from the National Criminal Register in the scope specified in art. 24 sec. 1 points 13, 14 and 21 of the PPL, issued not earlier than 6 months before the deadline for submission of tenders;

4.2. Certificate of the competent head of the tax office confirming that the Contractor is not in arrears with paying taxes, issued no earlier than 3 months before the deadline for submission of tenders or other document afterclaiming that the Contractor has entered into an agreement with the competent tax authority regarding the repayment of such receivables, together with any interest or fines, in particular obtained the legally required exemption, deferral or installment payment of overdue payments or suspension in full of the decision of the competent authority;

4.3. The certificate of the relevant organizational unit of the PlantSocial Security or Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with paying social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission of tenders, or other document confirming that the Contractor has entered into an agreement with the competent authority in on the repayment of these receivables together with ewentual interest or fines, in particular obtained the legally required exemption, deferral or payment in installments of overdue payments or suspension in full of the implementation of the decision of the competent authority;

4.4. A copy from the relevant register or central records and business information, if separate regulations require an entry in the register or records, in order to be confirmedto the grounds for exclusion under art. 24 sec. 5 point 1 Pzp,

4.5. Declaration of the Contractor about the lack of issuing a final court judgment or final administrative decision on default of payment of taxes, fees or social security or health insurance premiums or in the event of issuing such a verdict or decision documents confirming the payment of these claims together-with interest or fines, if any, or a binding agreement on the repayment of such claims, together with interest or fines, if any, or a binding agreement on repayment of these debts,

4.6. Contractor's statement about the lack of a ruling against him as a preventive measure of the prohibition to apply for a public order;

4.7. Contractor's statement about not being in contact with-paying taxes and local fees, referred to in the Act of 12.1.1991 on local taxes and charges (Journal of Laws of 2016, item 716).

1. Employer based on art. 24. para. 5 point 1 of the PPL provides for the exclusion of the Contractor in relation to which the liquidation has been opened, in the system approved by the court in the restructuring proceedings, it is foreseen that the creditors will be satisfied by the liquidationhis estate or the court ordered the liquidation of his property in accordance with art. 332 par. 1 of the Act of 15.5.2015. Restructuring law (Journal of Laws of 2016, item 1574, 1569, 1948 and 2260) or whose bankruptcy was announced, with the exception of the Contractor who, after the bankruptcy, concluded an arrangement approved by a legally valid court order, if the arrangement does not provide for the satisfaction of creditors by liquidation ofwith the exception of the bankrupt, unless the court ordered the liquidation of his property in accordance with art. 366 para. 1 of the Act of 28.2.2003 Bankruptcy Law (consolidated text: Journal of Laws of 2016, item 2171).

2. Employer based on art. 24. para. 5 point 8 of the PPL provides for exclusion of the Contractor who has violated obligations regarding tax payments, fees or social security or health insurance premiums, which the Employer is ine be demonstrated by means of appropriate evidence, except in the case referred to in Article 24 sec. 1 point 15 of the PPL, unless the Contractor paid the due taxes, fees or social security or health insurance contributions with interest or fines or made a binding agreement regarding the repayment of these receivables.

3. Contractor, within 3 days of posting on the websitej The Contracting Party, as referred to in art. 86 par. 5 Pzp will provide the Employer with a declaration of belonging or non-affiliation to the same capital group as referred to in art. 24 sec. 1 point 23 Pzp. In the case of being part of the same capital group as another Contractor who submitted an offer in the procedure, the Contractor together with submitting a statement may provide evidence thatconnections with another Contractor do not lead to distortion of competition in the proceedings.

4. If the Contractor has a registered office or place of residence outside the territory of the Republic of Poland, he submits documents in accordance with point 3.6. Terms of Reference.
