The subject of the orders covers the period from 1 January 2019 (the planned start date is provided) until 30/11/2020r. regular transport services performed as part of local public transport on bus lines operating within the public transport system connecting the area of Wieliszew Commune with Warsaw, numbering 1 243 250 (in words: one million two hundred forty three thousand two hundred fifty) 10% / - 10% (plus ten / minus ten) wozokilometrow, also referred to as "wozokm."

1. Services will be provided on routes:

2.Assumptions for timetables, mileage and list of stops are attachments to the contract (Annex 4 to the Terms of Reference - Model contract with attachments).

3. The contracting authority provides for the possibility of ordering, referred to in Article 134 sec. 6 Public Procurement Law. The scope of these orders will not exceed 50% of the value of the basic order and may include the extension or extended serviceat the basic number of vehicle kilometers during the contract period. The Ordering Party shall provide supplementary orders on conditions not worse for the Employer than the basic order. The price of one vehicle-kilometer can not be higher than indicated in the contract concluded as a result of resolving this tender.

Chapter A: Conditions for participation in the procedure

1. The Contractor may apply for the contractwho:

1) are not subject to exclusion on the basis of Art. 24 sec. 1 of the Public Procurement Law, with the exclusion of the case specified in art. 24 sec. 1 point 13 lit. d of the PPL, and in art. 24 sec. 1 point 14 of the Public Procurement Law, if the person who the speech in this provision was convicted of an offense. in art 24 sec. 1 point 13 lit. d of the Public Procurement Law, and are not subject to exclusion on the basis of Art. 24 sec. 5 points 1, 2, 4 and 8 of the Public Procurement Law;2) meet the conditions of participation in the scope of: a) competence or entitlements to bring a specific professional activity, if it results from separate regulations: - the Contractor meets this condition if he proves that he has a license referred to in art. 5 of the Act on road transport (ie the Journal of Laws of 2017, item 2200) granted for the period covering the date of execution of the order;

Chapter B: The grounds for exclusion-contractors referred to in art. 24 sec. 5 points 1, 2, 4 and 8 of the Public Procurement Law (optional premises)

Additionally, the Awarding Entity foresees the exclusion of the Contractor:

1. in relation to which the liquidation was opened, the court approved in the restructuring proceedings is expected to satisfy the creditors by liquidating its assets or the court ordered the liquidation of its assets pursuant to art. 332-paragraph. 1 of the Act of 15.5.2015. Restructuring law (Journal of Laws of 2015, item 978, 1259, 1513, 1830 and 1844) or whose bankruptcy was announced, with the exception of the Contractor who, after the bankruptcy, concluded a system approved by a legally binding decision court, if the agreement does not provide for the satisfaction of the creditors by liquidation of the bankrupt's assets, unless the court ordered the liquidation of its assets in tribunale art. 366 para. 1 of the Act of 28 February 2003 Bankruptcy Law (Journal of Laws of 2015, item 233, 978, 1166, 1259 and 1844),

2. who in a manner of serious misconduct has violated his professional duties, which undermines his integrity, in particular when the Contractor, as a result of deliberate action or gross negligence, failed to perform or improperly performed the order, which the Purchaser is able to demonstrate by means ofaverage evidence,

3. which, for reasons attributable to him, did not perform or improperly performed, to a significant extent, an earlier contract regarding a public order or a concession contract, concluded with the ordering party referred to in Art. 3 par. 1 point 1-4, which led to the termination of the contract or award damages,

4. who violated obligations regarding tax payments, fees or ssocial insurance or health insurance, which the Employer is able to demonstrate by means of appropriate evidence, except in the case referred to in paragraph 1 point 15 of the Public Procurement Law, unless the Contractor has made payments due to Taxes, fees or social security or health insurance contributions with interest or fines or has entered into a binding agreement regarding the repayment of such receivablesChapter C: Declarations and documents confirming that the Contractor meets the conditions for participation in the proceedings and no grounds for exclusion

1. Each Contractor must enclose with the offer a statement as of the day of submitting bids in the scope indicated in Annex 3 to the ToR. The information contained in the statement will constitute a preliminary confirmation that the contractor is not subject to exclusion, andmeets the conditions for participation in the proceedings. According to art. 25a para. 2 Public Procurement Laws if the value of the order is equal to or exceeds the amounts specified in the regulations issued on the basis of art. 11 para. 8, the statement referred to in Chapter X.1 of this SIWZ, the contractor submits in the form of a single document drawn up in accordance with the specimen of the standard form specified in the Implementing Regulation KEuropean Omission issued on the basis of art. 59 par. 2 of Directive 2014/24 / EU. For this purpose, the following steps should be taken:

a) from the Ordering Party's website where the document SIWZ has been made available, download the XML file called 'EAT'

b) go to https://ec.europa.eu/growth / tools-databases / espd / filter lang = en

c) choose the appropriate language version (in the case of a pre-fieldof the EAT form in a language other than the Polish version should be accompanied by a translation signed by the person (s) authorized to submit it. d) select the "I am the contractor" option (this option should also be ticked if the EJSE form is filled in by the entity on which resources are referenced by the Contractor)

e) import the previously downloaded file

f) fill in the form EED

g) generate the document elektroniczny EAT in the form .xml or .pdf and save it on the disk

h) sign the above document by qualified electronic signature

i) secure the above document with an access password or put it in an archive with an access password (eg 7zip). Warning!!! The Contractor shall provide a password to access the EJF file in the content of his offer, submitted in writing.

1. The contracting authority provides for the use of the procedurereferred to in Article 24aa of the Public Procurement Law. The Awarding Entity will first evaluate the offer and then examine whether the Contractor whose tender has been rated as the most advantageous is not subject to exclusion and whether he meets the conditions for participation in the proceedings. If the Contractor, whose offer will be evaluated as the most advantageous, will avoid concluding the contract or will not bring the required securityThe contracting party will examine whether it is not subject to exclusion and whether it meets the conditions for participation in the proceedings. The Contractor who submitted the highest bid was evaluated among the other offers. According to art. 36a paragraph 2 point 1 of the Public Procurement Law Act (Journal of Laws of 2017, item 1579), the Employer reserves the obligation of the Contractor to perform personally the key parts of the order, i.e. transport servicesabove. Other activities may be entrusted to subcontractors.

3. The Contractor will be bound by the offer for a period of 60 days. The period of being bound by the offer starts as soon as the deadline for submission of tenders expires
