The minimum and maximum estimated quantities for the duration of the framework agreement and for each subsequent contract (year I, year II, year III and year IV) are in accordance with Annex A of the Tender Specifications

To demonstrate the fulfillment of the criteria / requirements the qualification will be presented:

For each batch, the Tenderer / Tenderer / Tenderer / Tenderer must prove that it does not comply with the provisions of Art. 164, 165, 167 of Law no. 98/2016, as subsequently amended and supplemented.

In this regard, the Tenderer / Associate / Subcontractor / Supplementary Tertiary will complete the DUAE - Part III "Exclusion Reasons" - Section A "Reason"Section B" Reasons for Paying Taxes or Social Security Contributions ", Section C" Insolvency, Conflicts of Interest or Professional Misconduct ".

Also, for each lot, the tenderer ranked first after application of the award criterion, on admissible tenders, prior to the award of the agreement-asshall present, at the request of the Contracting Authority, the following supporting documents proving / confirming non-compliance with the situations referred to in art. 164, 165, 167 of Law no. 98/2016, both for the sole offeror / the Associate Bidder and for the Supported Subcontractor / Terter stated in the offer:

- the criminal record of the economic operator and the members of the management bodymanagement or supervision of the respective economic operator, or those having the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / Act of incorporation, - a certificate of tax attestation regarding fulfillment of obligations to pay taxes, duties or contributions to the general consolidated budget, of whichto reveal the lack of overdue debts at the moment of presenting this certificate,

- certificates / records / editing documents proving / confirming non-compliance with the situations stipulated in art. 167 par. (1), both for the sole offeror / Associate Bidder and for the Supported Subcontractor / Tenderer stated in the offer,

- editorial documents demonstrating that the bidder-Unique / Associated Offeror as well as for the Supported Subcontractor / Territory declared in the offer is in compliance with the provisions of art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016 on public procurement (if applicable), - other editorial documents, as appropriate.

Foreign legal persons shall present any editorial documents issued by the authorized institutions of the country(fiscal attestation certificates, criminal records, other equivalent documents, etc.) to prove that he has fulfilled his obligations to pay taxes, duties or contributions to the general consolidated budget in accordance with the national law of the country of the sole offeror / associated offeror / subcontractor / third party or country inwhich the sole tenderer / associated offeror / subcontractor / third party is established. The undersigned Bidder / Subcontractor / Tenderer shall present a Statement of Conflict of Interests in accordance with the provisions of Art. 60 par. (1) lit. a), lit. d) and lit. e) of Law no. 98/2016 on public acquisitions, with subsequent amendments and completions. Form No. 3 of the "Forms" Section of the Awarding Documentation, stamped and signed by the legal representative of the tenderer and submitted by the Single Tenderer / Associated Tenderer / Subcontractor / Supplementary Territory, together with the DUAE.-Persons holding decision-making positions within the Contracting Authority as well as persons within the Contracting Authority who may influence the content of the awarding documentation and / or the award procedure are:

The bidder must show that the average annual turnover over the last 3 years (2015, 2016, 2017), for each lot, was as low as: Lot 1 DRDP BUCURESTI = 9.180.000 RON Lot 2 -DRDPCRAIOVA = 3.740.000 lei

1) The duration of the framework agreements is 48 months, at signing by both parties;

4) A person who considers himself / herself injured by an act of the contracting authority may refer to the Cons.in order to annul the act of the contracting authority, to oblige it to issue an act or to take remedial measures, as well as to recognize the claimed right or legitimate interest, within the term stipulated by the legislation .. Note 1: The contracting authority recommends to any interested economic operator of the ongoing procurement procedure to transmit requestscountries of clarification / contestation regarding the awarding documentation through SEAP, by the deadline for submitting bids.
