The contract aims to purchase the rehabilitation and modernization works of DJ 131 county road, located in Covasna county., between the town of Baraolt and the boundary with Harghita county, on the portion between km 22 830-38 564.

The project envisages the rehabilitation and modernization of a 15, 734 km portion of the county road DJ 131, located in Covasna county, between Baraolt and the boundary with Harghita county, on the portion between km 22 830-38 564, thus ensuring indirect connectivity with the TEN-T network, through DN 13A.

InstructionDUAE Completion: DUAE is a declaration on the economic operator`s own responsibility, according to which he is not in one of the situations of exclusion provided by the national legislation and fulfills the qualification and selection criteria specified by the contracting authority / entity at the level of the registration form. data of the acquisition.

Fitting in the situation provided in art. 164 of Law no. 98/2016 attracts the exclusion of the bidder from the procedure applied for awarding the public procurement contract;

2. Declaration regarding the non-classification in the situations provided in art. 165 of Law no. 98 / 2016.

The sole bidder / the associated bidder / the subcontractor / the third party sustinator must prove that it does not comply with the provisions of art. 165 of Law no. 98 / 2016. In this respect, the sole bidder / the associated bidder / the subcontractor / the third party will complete the DUAE.

The supporting documents will be presented only by the bidder ranked in the first place in the intermediate ranking drawn up at the end of the evaluation of the offers, at the request of the contracting authority.rm art. 196 paragraph (2) of Law no. 98 / 2016.

The following documents will be requested:

- fiscal certificate issued by the Public Finance Administration attesting the lack of outstanding debts at the time of its submission, in original / legalized copy / legible copy with the mention "according to the original";

- certificate tax issued by the local public authorities to attest the absence of the remaining debtsante at the time of its submission, in original / legalized copy / legible copy with the mention "in accordance with the original";

- documents demonstrating that the economic operator can benefit from the derogations provided in Article 166 paragraph (2) of Law 98 / 2016 regarding public procurement;

- other edifying documents, as appropriate.

Foreign legal entities will present edifying documentse (certificates / equivalent documents issued by the competent authorities of the respective country) from which the lack of outstanding debts to the local budget, the state budget, etc. can be obtained.

The documents will be presented by an authorized translation in Romanian. 165 of Law no. 98/2016 attracts the exclusion of the tenderer from the procedure applied for awarding the contract dis public procurement;

- other edifying documents, as the case may be.

The following documents will be required: the certifying certificate issued by the National Trade Register Office in original / colegalized market / legible copy with the mention "in accordance with the original", stating the main object and the secondary areas of activity of the company. Non-resident (foreign) economic operators will priceentity documents proving a form of registration / certification / authorization or professional membership or any other equivalent documents, issued (in accordance with legal requirements) in the country of residence. The documents will be presented with their authorized translation into Romanian.

Annual general turnover. Total annual turnover for the last three years(2017, 2018, 2019). The bidder must demonstrate that the total annual turnover was at least RON 12 000 000 in each of the financial years for 2017, 2018 and 2019.

If two or more offers are ranked first with equal scores, the division will be done taking into account the score obtained on the evaluation factors in descending order of the pontheir duties. In case the equality is maintained, the contracting authority has the right to request new financial proposals and the winning bid will be designated the one with the smallest financial proposal, according to the provisions of art. 139 para. (3) of the GD no. 395/2016, with the following additions and modifications.
