Elaboration of technical project execution details, technical verification of project, technical assistance during execution execution of the objective "Modernization of roads local interest in Micestii de Campie commune, Bistrița-Năsăud county ". Deadline for receiptof the requests for clarifications: no later than 10 calendar days before the deadline set for the submission of offers. from:

(a) the value of the design and technical assistance services (chapter 3 of the work quote) = RON 1, 730 159.16 excluding VAT,

(b) the value of the workr of construction = 29 423 368.06 RON, excluding VAT, of which:

- value of construction works 28 988 539.97 RON (line 4.1. Constructions and installations from work quotation),

- value of site organization: 434 828, 10 RON (line 5.1.1. Construction works site construction from a quotation).

The bidder, the third party promoters or the subcontractors are not in one of the situations provided in art. 164, 165, 167 of Law no. 98/2016 regarding public procurement. Method of fulfillment: the DUAE will be completed by the bidder and separately from the subcontractors / third party supporter. At the request of the contracting authority, only the tenderer ranked in the first place in the ranking prepared following the application of the award criterion will be presented, supporting documents proving the fulfillment of thosehumane by completing the DUAE:

1) Romanian legal persons:

(a) the criminal record of the economic operator and of the members of the administration, management or supervision body of the respective economic operator or of those who have the power to represent, decide or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive document,

(b) the certificateof fiscal attestation from which the absence of the outstanding debts, regarding the payment of the contributions to the consolidated general budget, at the time of presenting them,

(c) the certificate of fiscal attestation from which the absence of the outstanding debts, regarding the payment of taxes and duties at local budget, at the time of presentation. The certificates of fiscal certification will be presentednd the fulfillment of the obligations of payment of taxes, taxes and social security contributions at all the premises and work points for which there are payment obligations,

(d) as the case may be, documents demonstrating that the economic operator can benefit from the derogations provided for in art. 166 para. (2), art. 167 para. (2) and art. 171 of Law 98/2016 on public procurement,

(e) other edifying documents, as the case may be;

2) foreign legal persons may present a declaration on their own responsibility or, if in the respective country there are no legal provisions regarding the declaration on their own responsibility, an authentic statement given in front of a notary, of an authority administrative or judicial or a professional association that has competence in this regard for the situationtiles described in art. 164, 165 and 167 of Law no. 98/2016 regarding public procurement.

Note: the requirement must also be met by associates, third parties and subcontractors, in the situation where they exist, in order to complete the DUAE.

Request no. 2: the bidder must not comply with the situations provided in art. 59 and art. 60 paragraph (1) of Law no. 98/2016 regarding the procurement of pubshigh schools (avoiding conflict of interests). Method of fulfillment: the DUAE will be completed by the bidder and separately from the subcontractors / third party supporters; at the request of the contracting authority, the bidder will be presented on the first place after applying the award criterion:

1) Form no. 1 declaration regarding the non-classification in the situations provided in art. 59 and art. 60 othersn. (1) of Law no. 98/2016 regarding public procurement (avoiding conflict of interests). For this declaration, the persons holding decision-making functions within the authority regarding the organization, the development and the completion of the award procedure within the meaning of the mentioned article are the following:

- Becan Ioan mayor,

- Oltean Mihai vice-mayor,

- Mitroi Florin supplier of serfauxiliary procurement tools from Leader Architects & Engineers SRL

Information and formalities necessary for evaluating compliance with the mentioned requirements: the tenderer must be legally constituted, not be in any situation of cancellation of the constitution, have the right to carry out the related activity the object of the contract, and its activity is authorized by the authoritiesthe competences based on art. 15 of Law no. 359/2004. In the case of the offers located on the first place, with prices that are equal, requests will be submitted for the submission of new price offers, until a single offer is split.

Attention:

1) Requests for clarifications will be completed exclusively in SEAP at the "Questions" section, and the answers to these will be published in SEAP For any request for clarification regarding the award documentation, the economic operators must register in the SEAP (www.elicitatie.ro) as an economic operator and as a participant in the award procedure. The evaluation commission will send the clarification requests regarding the offer submitted in SEAP under the "Questions" section. The economic operators will submit the answers to the clarifications and any documents requested in SEAP, in electronic format, signed with the electronic signature, according to the provisions of the Law n.r. 455/2001 regarding electronic signature;

2) Responses to clarifications will be published exclusively on SEAP (www.e-licitatie.ro). The risks of not accessing clarifications fall to the economic operator.
