CPV Description: No. 98/2018: Open public international electronic competition, for the designation of a contractor of the student-galley-restaurant, the University Students Club of Aristotle University of Thessaloniki.

Subject of the contract, is the exploitation of the student galley - restaurant (student manufacturing and distribution facilities), UniversityThe Guarantee Letters of the paragraphs are issued by credit or financial institutions legally operating in the Member States of the Union or the European Economic and Social Committee of the Aristotle University of Thessaloniki. Area or GPA member states and have this right in accordance with the applicable provisions. These guarantees include at least the following elements:

(a) the date of issue

(b) the issuer. (c) the contracting authority to which they are addressed, (d) the guarantee number, (e) the amount covered by the guarantee, (f) the full amountname, NFP and the address of the economic operator in favor of whom the guarantee is issued (in the case of a union, all the above shall be stated for each member of the association); (g) the conditions that: aaa) the warranty is irrevocably and unconditionally granted, and the issuer waives the right divorce and dissolution; and (bb) that in the event of a divestiture, the amount of the destitution is subject to(i) the date of expiry or the term of validity of the guarantee; (j) the undertaking by the issuer of the guarantee to pay the amount of the guarantee in whole or in part within 5 days following a simple written notice to the person to whom it is addressed; and (k)the contracting authority shall communicate with the issuers of the letters of guarantee in order to establish their validity.

For the purpose of facilitating economic operators, and not binding, models of guarantors letters of participation and good execution in Annex VIII of the DeclarationIn order to participate in the process of concluding this contract, a guarantee letter of participation, amounting to one hundred and twenty four thousand, seven hundred ten euros (124 710, 00 EUR) is deposited by the participating economic operators (tenderers) ( Annex VIII).

In the case of an association of economic operators, the participation guarantee also includes the condition that-the guarantee covers the obligations of all economic operators participating in the association.

The participation guarantee must be valid for at least 30 days after the end of the tender period, ie until 14.4.2019, otherwise the offer is rejected. The contracting authority may, before the offer expires, ask the tenderer to extend before the end of the tender, the period of validity of the tenderThe guarantee of participation is returned to the other bidders after:

(aa) the expiry of the time limit for bringing an action or the adoption of a decision on an appeal against the defendant. (bb) the expiry of the time limit for the application of an injunction or(c) completion of the pre-contractual audit by the Court of Auditors.

For the previous stages of the award, the Participation Guarantee shall be returned to the Participants in the event of rejection of their bid and if there has been no intra-corporate appeal or legal remedy; the time - limit for bringing an action or legal remedy has expired; or-the guarantee for participation is forfeited if the offeror withdraws his tender during this period of validity, provides false information or information, fails to provide in due time the proofs provided in this document or not present in time for signing the contract.

Performance guarantee.the performance of the performance of the contract is subject to the provision of a performance guarantee in accordance with Article 72 (1) (b) of Law 4412/2016, amounting to 5% of the value of the contract, excluding VAT. and submitted before or at the time of signing the contract.

The performance guarantee must, in order to be accepted, include as a minimum the elements referred to aboveand in addition the number and title of the relevant contract. Its content conforms to the template in Annex VIII of this Invitation and the provisions of Article 72 of Law 4412/2016. The performance guarantee provided will be of an indefinite duration.

The performance guarantee for the contract covers a total and non-discriminatory application of all the terms of the contract.and any claim by the contracting authority to the contractor.

In the event of a modification of the contract under paragraph 4.5, which entails an increase in the contract value, the contractor shall be required to provide, prior to the modification, a supplementary guarantee amounting to 5 % of the amount of the increase, excluding VAT.

The performance guarantee is forfeited in case• The performance guarantee is reimbursed in its entirety after the definitive quantity and quality of the contract has been received. If the final qualitative and quantitative receipt protocol contains observations or there is a delayed delivery, the repayment of the above guarantees is made after the comments have been dealt with.This contract is financed by credits from the regular budget of the World Bank.
