2. The Employer provides for the exclusion of the Contractor pursuant to Article 24 paragraph 5 item 1 of the Act.or documents submitted by the Contractor in the procedure at the request of the Employer to confirm the circumstances referred to in art. 25 paragraph 1 point 1 of the PPL (meeting the conditions for participation in the procedure or selection criteria):

1. To confirm that the contractor meets the conditions for participation in the procedure or selection criteria regarding the economic or financial situation, orderThe requesting party requires the following documents:

confirming that the contractor is insured against civil liability in the scope of conducted activity related to the subject of the contract for the sum insured specified by the contracting authority.

2. To confirm compliance by the contractor with the conditions for participation in the procedure or selection criteria regarding technical or professional capacity by orderingy may request the following documents:

1) a list of services rendered, and in the case of periodic or continuous services also performed, within the last 3 years before the deadline for submission of tenders, and if the period of business activity is shorter in this period, together with their value, the subject, dates of implementation and entities for which the services were rendered, and attaching dinformation specifying whether these services have been performed or are being carried out properly, the evidence referred to are references or other documents issued by the entity for which the services were performed, and in the case of periodic or continuous services are performed, and if for a justified reason of an objective nature, the contractor is unable to obtain these documentscontractor training; in the case of periodic or continuous benefits, references or other documents confirming their proper performance should be issued not earlier than 3 months before the expiry of the time limit for the submission of tenders or requests to participate. (according to the model presented by the Employer);

2) list of persons referred by the contractor to the implementationpublic procurement, in particular those responsible for the provision of services, quality control or management of construction works, together with information on their professional qualifications, rights, experience and education not necessary to perform the public procurement, as well as the scope of their activities and information on the basis to dispose of these people. (according to wzoru presented by the Employer).

II. List of statements or documents submitted by the Contractor in the procedure at the request of the Employer to confirm the circumstances referred to in art. 25 paragraph 1 point 3 of the Public Procurement Law (no grounds for exclusion):

In order to confirm that there are no grounds for excluding the contractor from participation in the proceedings, the documents specified in -5 point 1), 4), 5 should be submitted), 6), 10) of the Regulation of the Minister of Development of 26.7.2016 regarding the types of documents that the contracting authority may request from the contractor in the procurement procedure.

To meet the condition it is required to show that the Contractor is insured against civil liability in activities related to the subject of the contract for a guarantee sum of not less than 100, 000, 00 PLN.

1. The Contractor shall provide as part of his offer a deposit in the amount of PLN 4, 000 (say: four thousand zlotys).

2. When choosing the most advantageous bid, the Employer will be guided by the following bid evaluation criteria:

Price 60%

Experience of the laboratory service team manager 40%

3. Refers to section IV.2.6): The offer validity period is 60 days. The period beginswith the deadline for submission of bids.

4. The contract award procedure is expected to be annulled if the funds which the contracting authority intended to spend on financing all or part of the contract have not been awarded.

5. Invoices will be payable within 30 days of their delivery to the Employer.

6. In the case of contractors jointly applying for the contract, Contractors appoint a proxy to represent them in the procurement procedure or to represent them in the procedure and to conclude the public procurement contract.

7. The awarding entity does not envisage the award of orders pursuant to art. 67 section 1 item 6 of the Public Procurement Law

9. The contractor may entrust the implementation of part of the contract to subcontractors.

10. Employer in accordance with art. 24aa. paragraph. 1 of the Public Procurement Law, in these proceedings, it will first evaluate the offers and then examine whether the contractor whose offer has been assessed as the most advantageous is not subject to exclusion and meets the conditions for participation in the procedure.

11. Fromdue to the limited number of characters, the detailed requirements for qualification criteria, award criteria, as well as statements and documents that the contractors are required to provide in order to demonstrate the lack of grounds for exclusion and confirmation of compliance with the conditions for participation in the procedure have been specified in the Terms of Reference.
