Regeneration of granular activated carbon from six coal filters of the Intermediate Ozonation and Filtration Station in Hungarylu Active Central Unit - SUW "Filters"

1. Contractors, who:

1.1 meet the conditions for participation in proceedings regarding the possession of competences or entitlements to conduct a specific professional activity, may apply for the award of the contract, if this obligation results from separate regulations. Not applicable.

1.2 are not subject to exclusion under Article 24 paragraph 1 items 12-23 of the Act on the Procurement Lawpublic (Journal of Laws 2018, item 1986, as amended) hereinafter referred to as the "Act" or "PPL" (from the provision of Article 133 paragraph 4 of the PPL) and pursuant to art. 24 sec. 5 points 1, 4-8 Pzp.

2. The assessment of meeting the conditions for participation in the proceedings (according to the formula "meets - does not meet") and no grounds for exclusion will be made, based on: a) the initial statement of the Contractor contained in the single European ordering documentia "EAT" - in relation to all Contractors who submitted offers, and - b) documents and statements confirming the fulfillment of conditions for participation in the proceedings and no grounds for exclusion regarding the Contractor whose offer will be the highest rated.

3. The Contracting Authority requests submission of:

3.1a) At the stage of submitting bids from all Contractors:

a) The offer as per the content of the Offer Form, stipulatesAnnex 1 to the IDW, Part I of the ToR,

b) Uniform European Order Document (EAT);

c) In order to confirm that the deliveries offered (for each Task) meet the requirements of the Employer, the Contractor is obliged to attach to the offer: d) Safety data sheet for the fresh coal offered in accordance with Annex II of the Commission Regulation (EU) No 830/2015 of 28/05/2015 amendingRegulation (EC) No. 1907/2006 of the European Parliament and of the Council on the Registration, Evaluation, Authorization and Application of Chemical Restrictions (REACH); e) Contractor's statement that the fresh coal offered meets the requirements of Regulation (EC) No. 1907/2006 Of the European Parliament and of the Council of 18.12.2006 on the registration, evaluation, authorization and restrictions applicablefrom it in the field of chemicals (REACH);

f) The current hygiene attestation of the body authorized to issue approvals within the meaning of - 25 para. 4 points 1 of the Regulation of the Minister of Health of 7/12/2017 on the quality of water intended for human consumption allowing the fresh coal offered to treat water intended for human consumption;

g) Technical specification of the coal offered(coal parameters according to the methodologies in PN-EN 12915-1 and PN-EN 12902) along with a graph of pressure losses and the deposit expansion curve;

h) Contractor's statement that the reactivation will be carried out using the thermal method only in installations intended for the reactivation of coals in the processes of water treatment and purification of food products;

i) Description of technologies and technical conditions of reactivationof coal consumed with the determination of the place of its execution and the method of removing the subsoil from the reactivated carbon, as well as information on its own external equipment and devices, which will be used in the SUW "Filtry" (Task No. 1) / SUW "Praga" (Task No. 2) for extracting a coal deposit with filters, unloading / loading big bags from / on the means of transport and refilling the filtero with active charcoal;

j) Documents referred to in item 6.5 of the IDW;

k) other statements and documents as indicated in the SIWZ, that they should be attached to the offer.

3.1 b) Ordering prior to the order being awarded, The contractor whose offer will be evaluated as the most advantageous, to submit within the prescribed, not shorter than 10 days, the current date as of the day of submitting the declarations or the dockmentors confirming the circumstances referred to in art. 25 para. 1 Pzp, ie documents referred to in item 6.1b) and 6.1d) IDW.

3.1 c) Each Contractor, in accordance with art. 24 sec. 11 PPL, is obliged to submit within 3 days from the date of posting on the website of the Employer information referred to in art. 86 par. 5 PPP, i.e. the document referred to in item 6.1.c) IDW.

3.1 d) Contractor havingregistered office on the territory of the Republic of Poland, in relation to persons who reside outside the territory of the Republic of Poland, to whom the document specified in item 6.1b) sub-item a) of the IDW applies, submits relevant documents in accordance with the guidelines contained in IDW.

4. In order to confirm the fulfillment of the condition referred to in point 1.1 of 1.1 above, the Contractor whose tender will be evaluated as the most advantageous will present: Not applicable.

5.The Awarding Entity will assess (if applicable) whether the technical or professional capacities made available to the Contractor by other entities or their financial or economic situation allow the Contractor to demonstrate compliance with the conditions of participation in the proceedings and examine whether the subject of exclusion referred to in art. 24 sec. 1 point 13 22 of the Act (subject to Article 133 paragraph 4 ofawy) and art. 24 sec. 5 points 1, 4-8 of the Act. The Awarding Entity shall request relevant documents referred to in item 6.1.b) of the IDW to be provided to these entities.

1. If for justified reasons, the Contractor can not submit the documents required by the Awarding Entity in point III.1.3 sub-point 2 of the announcement, the Contracting Party allows the Contractor to submit other relevant documents for the purpose of confirmationand fulfillment of the conditions for participation in the procedure set out in point III 1.3 item 1.1 of the notice

2. Refers to item III.1.3 respectively): The Contractor may, in order to confirm compliance with the conditions of participation in the proceedings, in relevant situations and with reference to the order or parts thereof, rely on technical or professional capacity or the financial or economic situation of othersentities, irrespective of the legal nature of the legal relations that it has with it, on the principles specified in the IDW (item 6.5 of the IDW, including the obligation to submit the documents indicated therein).

3. If the Contractor has his registered office or place of residence outside the territory of the Republic of Poland, he shall submit an appropriate document or documents in accordance with the principles set out in item 6.6. IDW.

4. The period of binding the offer: 60 days.

5. Zamthe entrant does not provide for the order referred to in art. 134 sec. 6 point 3 of the Act

6. The offer should be made in Polish. Documents in a foreign language should be submitted along with a translation into Polish.

7. The offer together with the required documents should be prepared and submitted in accordance with the rules set out in the announcement, IDW and applicable law, including the RegulationThe Minister of Development of 26.7.2016 on the type of documents that the Employer may request from the Contractor in the proceedings for the award of the order and Pzp.
