The subject of the Order is Maintenance and repair of fire alarm systems, permanent fire extinguishing devicesgas and water, fire gates and smoke curtains on the I and II lines of the Warsaw Metro and STP Kabaty in the years 2020-2022 - on the conditions indicated in the Technical Specification and its annexes, constituting Annex 1 to this ToR and the contract template constituting Annex 2.

The subject of the Order is Maintenance and repair of fire alarm systems, permanent devices extinguishinggas and water connections, fire gates and smoke curtains on the I and II lines of the Warsaw Metro and STP Kabaty in the years 2020-2022 - on the conditions indicated in the Technical Specification and its annexes, constituting Annex 1 to this ToR and the contract template constituting Annex 2 .

The contractor should have the competence and authority to perform the activities necessary for realicking the subject of the order. The Awarding Entity will consider this condition fulfilled if the Contractor demonstrates that:

A) It has a certificate for the entrepreneur who, according to art. 29 of the Act of 15/05/2015 on substances that deplete the ozone layer and some fluorinated greenhouse gases (i.e. Journal of Laws 2018 item 2221 as amended), "an entrepreneur carryingon the installation, maintenance or servicing (...) of fire protection systems containing fluorinated greenhouse gases ".

B) It has a certificate for personnel referred to in Article 20 of 15.05.2015 on substances that deplete the ozone layer and some fluorinated greenhouse gases for each person carrying out the activities referred to in Article 20 (4) of the abovementioned Act.

C) PosiAda approval of the President of the National Atomic Energy Agency for trading, transport, storage, maintenance, dismantling and utilization of isotope smoke detectors referred to in art. 4 of the Atomic Law of November 29, 2000 (i.e., Journal of Laws 2018.792, as amended) 24 paragraph 1 pkt 12) 13) subpoint a) c), subpoint 14) 23) of the Public Procurement Law, except for the case referred to in art. 24 paragraph 1 point 13 lit. d), and in the case referred to in Article 24 (1) (14), if the person referred to in this provision has been convicted of an offense listed in Article 24 paragraph 1 point 13 lit. d. of the Public Procurement Law

The Employer will also exclude a contractor that meets the conditions set out in Article. 24 paragraph 5 pkt 1 of the Act.

To confirm that the Contractor is not subject to exclusion from the procedure, he is required to submit the following documents:

- Uniform European Contract Document

- Current information from the National Criminal Record in the scope specified in art. 24 paragraph 1 point 13 points a) c) and 14 of the Act issued not earlier than 6 months before the deadline for submission of bids

- Current informationthem from the National Criminal Register in the scope specified in art. 24 paragraph 1 point 21 of the Act, issued not earlier than 6 months before the deadline for submission of bids

- Current excerpt from the relevant register or from the central register and information on business activity, if separate provisions require an entry in the register or the register, in order to confirm the absence of grounds for exclusion on based on art. 24 paragraph 5 point 1 of the Act

- Declaration of the Contractor (in print) on the fact that he has not issued a final court judgment against him or a final administrative decision on arrears in the payment of taxes, fees or social security or health insurance contributions, or in the case of issuing such a judgment or decisions confirming payment of these receivables, including anyinterest or fines or concluding a binding agreement on the repayment of these debts

- Declaration of the Contractor (in print) on the lack of a decision against him as a preventive measure prohibiting him from applying for public contracts.

If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of documents referred to in:

- Paragraph 11.2.1. letter a)11.2.1. (b) ToR - submits information from the relevant register or, in the absence of such register, another equivalent document issued by the competent judicial or administrative authority of the country in which the contractor has its registered office or place of residence or place of residence has the person to whom the information or document relates, to the extent specified in art. 24 paragraph 1 point 13 point a) c), 14 and 21 mouthwy Pzp,

- Pts. 11.2.1. point c) of the Terms of Reference - submits a document or documents issued in the country in which it has its registered office or place of residence, confirming accordingly that its liquidation has not been opened or bankruptcy has been declared,

- Documents referred to in point 11.4.1. and 11.4.2. ToR, should be issued not earlier than 6 months before the deadline for submission of tenders,

- If in the country in whichthe contractor has its registered office or place of residence or the place of residence has a person to whom the document relates, no documents referred to in point 11.2.1 ToR, they are replaced by a document containing a statement of the contractor, indicating the person or persons authorized to represent him, or a statement of the person to whom the document was to relate, submitted before a notary or befored a judicial, administrative or professional or economic self-government body competent for the registered office or place of residence of the contractor or the place of residence of that person. The provision of points 11.3.3 SIWZ shall apply accordingly.

The offer binding period is 60 days from the deadline for submission of offers. 67 section 1 points 6 and 7of the Act. 134 section 6 item 3 of the Act.
