The bidders, the associated bidders, the supporting third parties and the subcontractors must not find themselves in the situations stipulated in art. 177, 178, 180 of Law no. 99 / 2016.

The manner by which the fulfillment of the requirement can be demonstrated: the DUAE will be completed, according to art. 202 204 of Law no. 99/2016 and according to ANAP Notification no.240/2016, by the economic operators participating in the award procedure with the information related to their situation. Also, with the submission of the DUAE, the bidders will present the commitment of the third party, the association agreement and the subcontracting agreement (if any).

In order to verify the information contained in the DUAE, 205 of the Law no. 99/2016, the contracting entityhas the right to request and the tenderer has the obligation to present supporting documents proving the fulfillment of the assumed by completing the DUAE, namely: - a criminal record for the bidder and for the persons who are members of the administration body, the leading of the respective bidder or who has power of representation, decision-making or control within it, as shown- the certifying certificate regarding the lack of overdue debts, regarding the payment of taxes, duties or contributions to the general consolidated budget (local budget, state budget, etc.) at the moment of presentation, where appropriate, documents demonstrating that the economic operator may benefit from the derogations provided for in the-art. 179 par. (2), art. 180 par. (2), art. 184 of Law 99/2016 on Sector Acquisitions; - Other editorial documents, as appropriate.

For foreign bidders, any document deemed to be edifying in the country of origin or in the country in which it is established, such as self-declarations, certificates, criminal records or other equivalent documents issued by the author• The supporting documents proving the fulfillment of the assumed ones by completing the DUAE are to be presented, at the time of submission, to the competent authorities of the country concerned, accompanied by an authorized translation in Romanian. the request of the contracting entity, only by the bidder whose offer it isranked first after analyzing and evaluating the offer.
