The subject of the order is the provision of services related to: collecting municipal waste

The object of the order is to provide services related to receiveno municipal waste from all property owners from the Kościelisko Commune, inhabited and uninhabited real estate, on which municipal waste is generated and their transport to 1) Regional Municipal Waste Treatment Plant (RIPOK) FCC Podhale Sp. z o.o., ul. Ja-na Pawła II 115, 34-400 Nowy Targ;

2) Regional Municipal Waste Treatment Plant (RIPOK)PUK "Empol" Sp. Z o. O., Os. Rzeka 133, 34-451 Tylmanowa.

Estimated amount: 4, 186.99 Mg

The detailed description of the subject of the order and the schedules are included in Annex No. 10 to the ToR. The Contractor is obliged to:

1 obtain all information necessary for the proper preparation of the offer,

2 check and verify the tender materials and immediately inform the Employer aboutpossible errors or omissions. The ordering party will not take into account any claims and comments due to errors or inaccuracies of the specification of essential terms of the order after the deadline for filing an appeal,

Pursuant to the content of art. 29 para. 3a. Public Procurement Law The Employer requires employment by the Contractor or a Subcontractor based on a contract of employment, persons performing the activityand in the scope of order fulfillment, if the performance of these activities consists in performing work in the manner specified in art. 22 -1 of the Act of 26.6.1974 Labor Code (Journal of Laws of 2014, item 1502, as amended), - The above requirement applies to employees performing activities related to the implementation of the order, including persons collecting property waste, persons servicing garbage trucks .

contractors can apply for the ordering of contractors who have:

- permission to operate in the field of municipal waste transport in accordance with the applicable regulations, ie the Act of 14.12.2012 on waste

- current entry in the register of activities regulated by Kościelisko run by Wojta, in accordance with the provisions of art. 9bof the Act of 13.9.1996 on maintaining cleanliness and order in municipalities

contractors may apply for the award of the order, who will prove that they are insured against civil liability in the scope of their activities related to the subject of the order for a guarantee sum not lower than 150, 000.00 PLN (say: one hundred and fifty thousand zlotys)

1. The Contractor submits the offer via Fthe organizer to submit, change, withdraw the offer or application available on ePUAP and also made available on the miniPortal. The public key necessary to encode the offer by the Contractor is available to contractors on the miniPortal. In the offer form, the Contractor is obliged to provide the ePUAP mailbox address, on which correspondence related to the proceedings will be kept. Offer including attachmentit should constitute an integral part of it, should be drawn up in the Polish language, retaining the electronic form in the format of doc or docx or pdf and signed with a qualified

Electronic signature. The method of submitting the offer, including the encryption of the offer, is described in the Regulations for the use of miniPortal. The offer must be submitted in the original. The ordering party does not allow the submission of a scan byan envelope bearing a qualified electronic signature.

2. The Employer will exclude Contractors from the proceedings, referred to in art. 24 section 1 items 12-23 of the Public Procurement Law; The Awarding Entity also provides for the exclusion from the procedure of Contractors, referred to in art. 24 sec. 5 para. 1 of the Public Procurement Law Act

3. For preliminary confirmation that the contractor can not be excludedand meets the conditions for participation in the proceedings in accordance with 25a para. 2 of the Public Procurement Law, the Employer requires that the Contractor submits a declaration on the uniform European Order Document form (hereinafter referred to as "EED" or "single document") valid as at the day of submitting bids. EAT is a self-declaration on the Need for proceedings for granting a public order. Contents of statementsia EAT should comply with the form made available under this SIWZ (Annex 2 to the Terms of Reference). The EAT may be provided only in electronic form and should be accompanied by a qualified electronic signature of the person authorized to submit such a statement on behalf of the entity WHICH concerns and should be handed over to the Ordering Party in accordance with the provisions of this SIWZ in such a way that the document reaches the Ordering Party before the deadline for submission of offers. - the detailed rules for the submission of EEDs have been specified in the ToR.

4. The contractor, who relies on showing the fulfillment of the conditions for participation in the procedure for the professional capacity, financial or economic situation of other entities, must prove that during the execution of the order he will behe provided the necessary resources to these entities. As evidence, he must submit a written commitment of these entities to provide him with the necessary resources to fulfill the order.

5. The ordering party shall call the Contractor whose bid has been best assessed for submission, in a period not shorter than 10 days, valid as at the date of submission, documents or declarations inthe lack of grounds for exclusion

6. The contracting authority shall call the Contractor, whose tender has been best assessed to submit, in a period not shorter than 10 days, valid as at the submission date, documents or statements regarding the fulfillment of the conditions for participation in the procedure - 7. The offer should be made in Polish, subject to electronic form and signeda qualified electronic signature
