Collection and management of municipal waste from owners of residential properties located within the Toszek commune and creation and operation of a point selective waste collection

The subject of the ordersia is the performance of services consisting of:
Main Site: Toszek Commune
The subject of the order is to provide services consisting in: - collection of municipal waste from residential real estate located in the Toszek Commune
- management of municipal waste collected from the Toszek commune from the property on which inhabit residents, - create and maintain a selective collection pointodpadow
A detailed description of the subject of the order can be found in chapter III SIWZ
The Ordering Party considers the above-mentioned condition fulfilled if the Contractor shows that he has:
1. Certificate of entry in the register of regulated activities conducted by Mayor Toszek, in the scope of collecting municipal waste from property owners at least with codes:
• all waste with subgroup codes 1501,
• 16 01 03,
• 17 01 01, 17 01 02, 17 01 03, 17 01 07,
• 17 02 01, 17 02 02, 17 02 03,
• 17 03 02 Bituminous mixtures,
• 17 04 01, 17 04 02, 17 04 03, 17 04 04, 17 04 05, 17 04 06, 17 04 07,
• 17 04 11,
• 17 06 04,
• 17 08 02,
• 17 09 04,
• all waste with codes from group 20,
Issued in accordance with the provisions of the Act of 13.9.1996 on maintaining cleanliness and order in communes (Journal of Laws of 2018th item 1454 z zn. Zm.) And meets the conditions of performing activities in the field of receiving municipal waste from property owners in accordance with the provisions of the above Act.
2. It has a valid permit to collect municipal waste at least with codes:
• all waste with codes from subgroup 15 01,
• 16 01 03,
• 17 01 01, 17 01 02, 17 01 03, 17 01 07,
17 02 01, 17 02 02, 17 02 03,
1703 02 Bituminous mixtures,
• 17 04 01, 17 04 02, 17 04 03, 17 04 04, 17 04 05, 17 04 06, 17 04 07,
• 17 04 11,
• 17 06 04,
17 08 02,
• 17 09 04,
• all waste with codes from group 20,
According to the Regulation of the Minister of the Environment of 9/12/2014 on the waste catalog, Dz.U.2014.1923) issued on the basis of art. 41-44 of the Act of 14.12.2012 on waste (Journal of Laws of 2018, item 992, itemn. zm.) with the exception of entities exempt from obtaining permits pursuant to art. 45 w / w of the Act and entry in the register referred to in art. 51 point 1 point 3 of the Act of 14.12.2012 on waste (Journal of Laws of 2018, item 992, as amended)
3. Has an entry in the register of entities transporting waste in the scope referred to in art. 49 and 50 para. 1 point 5 of the Act of 14.12.2012 on waste (Journal of Laws of 2018, itemfrom 992 from zm.) at least with codes:
• all waste with codes from subgroup 15 01,
• 16 01 03,
• 17 01 01, 17 01 02, 17 01 03, 17 01 07,
• 17 02 01, 17 02 02, 17 02 03,
• 17 03 02,
• 17 04 01, 17 04 02, 17 04 03, 17 04 04, 17 04 05, 17 04 06, 17 04 07,
• 17 04 11,
• 17 06 04,
• 17 08 02,
• 17 09 04,
• all waste with codes from group 20.
4. It has an entry in the register of collecting entitiesused electrical and electronic equipment in accordance with the provisions resulting from the Act of 14.12.2012 on waste (Journal of Laws of 2018 item 992 with later amendments).
The Contracting Authority will consider the above-mentioned condition fulfilled if the Contractor shows that he has funds or creditworthiness on account in the amount of at least PLN 300, 000.00 (in words: three hundred thousand zlotys 00/100), which will be confirmed by the relevantinformation from a bank or a social savings and credit union, issued not earlier than 1 month before the deadline for submitting offers.
1.Information regarding the date of order completion:
a) In the collection and management of municipal waste - for a period of 24 months, i.e. 1.3.2019 until 28.2.2021 (if the order is awarded for reasons beyond the control ofThe ordering party after 1 January 2019 is the time of order execution: from the date of the contract to 28.2.2021)
b) In the scope of providing the Ordering Party with the first schedule of waste collection - within 3 days from the date of signing the contract,
c) W in the scope of reporting: - submitting reports for the last quarter of order completion within the 25th day of the next month afterending the quarter (until 25/04/2021)
- submitting the report for the last half of the order, referred to in art. 9n of the Act on maintaining cleanliness and order in communes by the end of the month following the expiration of the half, to which the report pertains, - submitting the annual report referred to in art. 9a and 9nb of the act on maintaining cleanliness and order in communesby 31 January for the previous calendar year.
2. Requirements for employment by the Contractor or Subcontractor under a contract of employment:
a) According to art. 29 para. 3a of the Act on Public Procurement Law, the Employer requires employment by the Contractor or Subcontractor based on a contract of employment for persons who, during the implementation of the subject contract, will perform the following works:- collection of waste,
- conducting the Selective Settlement of Municipal Waste.
B) Documenting the employment of persons performing the activities indicated in point 5.1 will consist in: - - at the offer stage - the Contractor submits a declaration in accordance with Annex 1 to the ToR (Offer Form),
- at the stage of contract performance - Contractor at every written request of the Employer within 5 working dayswill submit to the Employer a report on the status and manner of employment of persons involved in the activities indicated in the SIWZ, ie statements of employed persons on employment contract, and will submit evidence of ZUS social security contributions from employment contracts of employees, - in the case of non-employment timely submission of information referred to in point 5.2 lit. b) Contractorand will pay a penalty of PLN 1, 000.00 each time, - in the event of non-employment in the performance of the required activities on the basis of a contract of employment, the Contractor will be required to pay a contractual penalty to the Ordering Party in the amount of 0.1% of the total remuneration for each a person employed on the basis of a different legal relationship than the employment relationship, - not fulfilling the obligations regardingpersons may be the basis for termination of the contract by the Employer for reasons attributable to the Contractor.
3. Information on the technical dialogue: No technical dialogue was carried out prior to initiating the procurement procedure.
4. List of installations for managing municipal waste: Contractor in accordance with art. 6d para. 4 point 5 of the act on maintaining cleanliness and orderin the municipalities, the Contractor is obliged to indicate in the offer of installations, in particular regional installations for processing waste, to which he will transfer municipal waste received from property owners - Annex No. 9 to the ToR.
5. The contracting authority provides for supplementary procurements referred to in art. 67 sec. 1 point 6) Pzp.
