Supply of a specialized storage system for the IT Center of the University of Gdańsk

Reference Number: A120-211-122 / 19 / MP

The subject of the order is the delivery of a specialized storage system, hereinafter referred to as " system ", for the IT Center of the University of Gdańsk.

Main Site: Rectorate Building, Jana StreetBażyńskiego 8, 80-309 Gdańsk, room 123, POLAND.

The system must:

1) be brand new, i.e. not used before delivery (it is required to be free of physical and legal defects), complete, ready for use without additional purchases and investment,

2) be delivered to the Employer together with the instruction manual in Polish in original factory packaging, which were storede that the Employer is not required to keep the guarantee,

3) be marked (including "CE" marking) in accordance with the requirements set out in the Act of 13.4.2016 on conformity assessment systems and market surveillance (consolidated text 2017 item 1398 as amended),

4) if it is an energy-related product within the meaning of Article 2 of the Act of 14.9.2012 on labeling enenergy-related products (consolidated text Journal of Laws of 2016, item 1790, as amended) has:

a) labels attached to the energy-related product in Polish, which will contain information on the energy efficiency class (energy consumption or the impact of this product on energy consumption) and other basic resources (water, chemicals or other substances) consumed by an energy-related product;

b) a card in Polish attached to the brochures or other documentation provided with the energy-related product that will contain a table with technical information about the energy-related product;

c) placed on the label and in the card data in accordance with the technical parameters of the energy-related product;

- in accordance withagencies specified in the abovementioned Act.

The Employer after signing the contract provides for applying for a 0% VAT rate on the basis of art. 83 paragraph 14 point 1 of the Act of 11.3.2004 on tax on goods and services (consolidated text of the Journal of Laws of 2017, item 1221, as amended) - refers to item 3 point 2, 3 (switches).

Ordering Party does not specify in the above scope any requirements which the Contractor shall meetis to be shown in a special way.

The Employer does not specify in this respect any requirements that the Contractor is required to demonstrate in a special way.

The Contractor intending to participate in this procedure must have an account on ePUAP. The Contractor who has an ePUAP account has access to the form for submitting, changing, withdrawing an offer or application, as well as the formularfor communication (https://obywatel.gov.pl/nforms/ezamkuje). Employer under art. 24aa of the Act, will first evaluate the offers in terms of their rejection - art. 89 paragraph 1 of the Act and the criteria for the evaluation of the offers specified in chapter XIV of the ToR, and then will examine whether the Contractor whose tender has been assessed as the most advantageous, is not subject to exclusion, meets the conditions for participation in posshall comply with the requirements set out by the Employer based on the declarations and documents indicated in Chapter VII.

Contractors who are not subject to exclusion from the procedure pursuant to art. 24 paragraph 1 and item 5 of the Public Procurement Law

1. In order to pre-confirm that the Contractor is not subject to exclusion and meets the conditions for participation in the proceedings referred toh referred to in Chapter V, the Contractor shall submit:

1) a current statement as at the date of submission of the offers, made under pain of nullity, in an electronic form with a qualified electronic signature by the person (s) authorized to represent the Contractor, in accordance with the form of representation specified in registration (registration) document appropriate for its organizational form, on the formu uniform European order document, hereinafter referred to as "JEDZ statement" Annex 2 to the ToR, to the extent indicated by the Employer.

In order to confirm that the offered delivery meets the requirements specified by the Employer, the Employer requests from the Contractor:

the technical specifications of the system offered (in Polish or English), confirming compliance with the requirements ofin Annex 1b to the ToR. Manufacturer`s catalogs, manufacturer`s folders, etc., are allowed, in the form specified in item 7.

The Employer requires a bid security of PLN 38, 000.00. Further details regarding the bid security contained in Chapter IX of the ToR.

The offer is:

1) Annex No. 1 to the ToR,

2) Annex No. 1a to the ToR.

The Employer does not require any security on due performance of the contract.The applicant allows the use of subcontractors` services. Further details regarding subcontractors are contained in chapter XVIII of the SETC.

The awarding entity does not provide for the possibility of awarding the contracts referred to in art. 67 section 1 point 7 of the Act.

The Employer does not allow the submission of equivalent offers.

The Employer does not allow the possibility of submitting variants.

The Employer does not intend to grantadvances within the meaning of the provision of art. 151a of the Public Procurement Law
