Acquisition of energy coal transport services, from the Berbesti and Alunu Deposits, up to the download stations belonging to CET Govora according to the specificationof tasks and Annex no. 1. The acquisition of the transport services for the railways of the energy coal, from the Berbesti and Alunu Deposits, until the docking stations belonging to CET Govora according to the specifications. and Annex no. 1.

The bidders, the third-party supporters and the subcontractors must not find themselves in the situations provided in art. 73, art. 177art. 178, art. 180 of Law no. 99 / 2016.

The manner in which the requirement can be demonstrated: the DUAE will be completed by the economic operators participating in the award procedure with the information related to their situation. The supporting documents proving the fulfillment of those assumed by completing the DUAE will be presented, at the request of the contracting entity, only becausethree bidders ranked on the first 3 places in the intermediate ranking prepared at the end of the evaluation of the bids. These documents can be:

(a) certificates confirming the lack of outstanding debts regarding the payment of taxes, taxes or contributions to the consolidated budget (local budget, state budget) at the time of presentation;

(b) the criminal record of the economic operator and to a memberof the administrative, management or supervisory body of the respective economic operator or of those having power of representation, decision or control within it, as it results from the certificate issued by the ONRC / the constitutive document;

(c) as the case may be, documents proving that the economic operator can benefit from the derogations provided in art. 179 para. (2), art.180 paragraph (2) and art. 184 of Law 99/2016;

(d) other edifying documents, as the case may be.

Special warnings:

1) The non-submission of the DUAE with the offer (including for the associate / third party supporter) attracts its rejection as unacceptable;

2) The following documents will be submitted with the DUAE: the firm commitment of the third party supporter from the carit is the effective way in which its support will be materialized, the subcontracting agreement and / or the association agreement, as the case may be.

Not submitting them together with the DUAE is the basis for requesting clarifications for any inadvertent form of the information contained in the DUAE sections, both of the bidder, as well as of the supporting subcontractor / third party, this being the casenecessary to ensure the proper conduct of the award procedure.

1) The economic operators who submit the offer must prove a form of registration according to the law of the country of residence, stating that the economic operator is legally constituted, that it is not in none of the situations of cancellation of the constitution and the fact that it has the professional capacity toperform the activities that are the subject of the contract.

The supporting documents proving the fulfillment of those assumed by completing the DUAE, respectively the certifying certificate issued by ONRC (which containe real information, valid at the time of presentation) or in the case of foreign bidders, equivalent documents issued in the country of residence will be presented, at the request of the contracting entity, only by the bidders ranked on the first 3 places in the intermediate ranking prepared at the end of the evaluation of the bids;

(a) The way in which DUAE can be accessed in order to be completed by the interested economic operators isthe following: DUAE is configured by the contracting entity directly in the SEAP when defining the award documentation. The answers to the DUAE of the economic operators participating in the procedure will be completed in SEAP directly, after authentication, by each participant, signed with the electronic signature and uploaded to the corresponding section. Details regarding the preparation of DUAEyou will find, after authentication in the system, in the section "DUAE Information" DUAE completion guide. The supporting documents proving the fulfillment of those assumed by completing DUAE will be presented, at the request of the contracting entity, only by the bidders ranked in the first 3 places in the ranking intermediary drawn up at the end of the evaluation of the offers;

(b) Entity contrthe act will conclude the framework agreement with all the bidders ranked on the first 3 places in the ranking (there will be no separation of the bidders if it is found that 2 or more offers that ranked on the first 3 positions in the ranking have equal prices);

( c) For the transmission of the requests for clarifications regarding the award documentation, the economic operators will be registered in the SEAP.the economic time interested in the procurement procedure that requires further clarification or information in relation to the attribution documentation related to it, will send the request through SEAP, until the deadline specified in section II.1.4) by accessing the section "Questions" from the procedure detail. assignment / lot in progress

To receive answer to sthe clarification requests, the economic operator interested in the procurement procedure will take into account the response times of the contracting entity provided in section II.1.4).

The answer to the clarification requests will be posted in SEAP in a document attached to the award documentation. Responses to clarification requests are an integral part of the award documentation;

(d) Forvisualization of the attribution documentation uploaded in the SEAP, it is necessary for the economic operators to own / install on the workstation the application that allows the verification of the electronic signature and the visualization of the electronically signed documents (available on the websites of the electronic signature providers);

(e) All documents the bid submitted by the bidders will be signed with himExtended electronics, based on a qualified certificate, issued by an accredited certification service provider. The maximum allowed size of SEAP files is max. 40 Mb, their number being unlimited.
