Provision for subcontracting rail transport services

The subject of the order is the provision of transport services for the needs of the rail passenger transport services performed by the Contracting Party the following episodes:

1. The subject matter of the contract is the provision of transport services for the needs of Zdeclaring rail passenger transport services on the following sections:

1) Rzesz-w Głowny - Zagorz - Rzesz-w Głowny (from 9/12/2018 to 19/06/2019 and from 2.9.2019 to 14/12/2019)

2) Rzeszow Main - Łupkow - Rzeszow Głowny (from 20/06/2019 to 1.9.2019)

3) Rzesz-w Głowny - Hrubieszow Miasto - Rzesz-w Głowny (from 9/12/2018 to 14/12/2019)

2. A detailed description of the subject of the orderhas been included in the SIWZ and its annexes, in particular in the model contract.

1. The ordering party specified the requirements for the ability to conduct a professional activity in Chapter VIII para. 2 point 2.1.1. Terms of Reference.

2. In addition to the offer, each Contractor is obliged to submit before the deadline for submitting bids:

1) A statement valid as of the day of submitting bids constituting a preliminary confirmation thatawca:

a) is not subject to exclusion,

b) meets the conditions for participation in the Proceedings.

Ww. statement The Contractor is obliged to submit in the form of a single European order document prepared in accordance with the standard standard form specified in the EC Implementing Regulation issued on the basis of art. 59 par. 2 of Directive 2014/24 / EU in conjunction with from art. 80 ust. 3 of Directive 2014/25 / EU, hereinafter referred to as"Eat." Detailed instructions on how to fill EAT

Ordering is included in Chapter IX of the ToR.Ordering requires submission of EAT by each Contractor.

2) In the case of joint application for contractors, EAT shall be submitted by each of the Contractors jointly applying for the order. these should confirm the fulfillment of the conditions for participation in the Proceeding in the scope in whicheach of the Contractors demonstrates fulfillment of the conditions for participation in the procedure and no grounds for exclusion.

3) Contractor who refers to the resources of other entities in order to demonstrate the absence of grounds for exclusion and compliance with them, to the extent that they refer to their resources, the conditions for participation in the Proceeding are also submitted by the EMS regarding these third parties (each of them).

3. In the PRa reference to the third party resources on the terms specified in art. 22a paragraph 1 of the Public Procurement Law Act, the Contracting Party requests that along with the offer the Contractor should submit a written undertaking (or other documents) of the third party confirming that the Contractor will have the necessary resources of these entities when executing the order. According to art. 22a paragraph 3 of the Public Procurement Law, the Employer will assess whether it is availableContractors, by other entities, technical or professional capacity, allow the Contractor to demonstrate compliance with the conditions of participation in the proceedings and examine whether there are any grounds for exclusion referred to in art. 24 sec. 1 point 13 lit. a-c, item 14 (in the scope of the catalog of offenses referred to in Article 24 (1) (13) a-c of the PPL Act), items 15-22 of the Public Procurement Law and art. 24paragraph. 5 points 1 and 8 of the Public Procurement Law - 5. In order to confirm the absence of grounds for exclusion of Article 24 sec. 1 point 23 of the PPL Act, the Contractor, within 3 days from the date of publishing information on the website referred to in art. 86 section 5 of the Public Procurement Law Act, it provides the Ordering Party (without a separate request) with a declaration of belonging or non-affiliation to the same capital group (within the meaning of-Act of 16.2.2007 on competition and consumer protection (Journal of Laws of 2018, item 798, as amended)). With the submission of a statement, the Contractor may provide evidence that links with another Contractor do not lead to distortion of competition in the procurement procedure. In the case of Contractors who appear jointly, the statement referred to in the preceding sentence is submitted by each of the Contractors.

6. Specific rules for the submission of statements and documents that the Contractor is required to submit at the request of the Employer in accordance with art. 26 par. 1 or art. 26 par. 2f of the Public Procurement Law, the Employer concluded in Chapter IX of the Terms of Reference - 1. A Contractor who is in an economic and financial situation enabling execution of the order may apply for the award of the order:

2. The Contracting Authority will consider that the Contractorand meets the above condition, if it proves that you have current insurance against civil liability in respect of your business related to the subject of the order for an insurance sum not less than PLN 5, 000, 000.00.

3. Details regarding the condition of participation, including documents confirming its fulfillment, are specified in Chapter VIII and IX SIWZ.

1. In order to demonstrate the lack of afterto exclude the Contractor from the proceedings in the circumstances referred to in art. 24 of the Public Procurement Law, the Employer requests submission of the following documents by the Contractor:

1) information from the National Criminal Register in the scope specified in art. 24 sec. 1 point 13 lit. a-c, point 14 of the Public Procurement Law (with reference to the persons referred to in this provision for the catalog of offenses referred to in Article 24 para.-1 point 13 lit. a-c of the Public Procurement Law) and art. 24 sec. 1 point 21 of the Public Procurement Law (in relation to collective entities) issued not earlier than 6 months before the deadline for submitting bids;

2) certificate of the competent head of the tax office confirming that the Contractor is not in arrears with payment of taxes issued not earlier than 3 months before the expiry deadline for submission of bids, or othera document confirming that the Contractor has entered into an agreement with the competent tax authority regarding the repayment of such receivables together with any interest or fines, in particular obtained legally permissible, postponement or payment of overdue payments or full suspension of the implementation of the decision of the competent authority; the appropriate local organizational unitof the Social Security or Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with payment of social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission of bids, or other document confirming that the Contractor has concluded an agreement with the competent authority regarding the repayment of these nliable, including any interest or fines, in particular obtained legally permitting, postponing or spreading overdue payments into installments or suspending in full the decision of the competent authority; - 4) excerpt from the relevant register or central records and business information, if separate provisions require entry in the register or register, in the targetconfirming the lack of grounds for exclusion under Art. 24 sec. 5 point 1 of the Public Procurement Law Act,

5) the Contractor's declaration of non-payment of taxes and local fees, referred to in the Act of 12.1.1991 on local taxes and charges (Journal of Laws of 2017 item 1785 with d.),

6) the Contractor's statement that he has not issued a final court judgment or final administrative decision against himabout the payment of taxes, fees or social security or health insurance premiums, or in the event of such a judgment or decision - documents confirming payment of such claims together with any interest or fines or a binding agreement on repayment of such claims; - 7) statements Contractor about the lack of a ruling against him in the middle ofa preventive prohibition of applying for public orders.

3. Indicated in point II.2.7. the date of commencing the implementation of the order is an indicative term, not a required one. In the event that the date on which it will be possible to conclude a public procurement contract in accordance with Art. 94 par. 1 or art. 183paragraph. 1 of the Public Procurement Law, will fall later than indicated in point II.2.7. the date of commencing the implementation of the order will be the date of conclusion of the contract
