1 The subject of the order is the delivery of two buses (mini class) with equipment and diagnostic software under the project: "Comprehensive Integration of the low-emission city transport system in the City of Nowy Targ and the Nowy Targ and Szaflary Communes "under the priority axis 4 Regional energy policy, measure 4.5 Low-emission urban transport, sub-measure 4.5.2 Low-emission urban transport SWP, Project No .: RPMP.04.05.02- IZ.00-12-0358 / 17.
2 General requirements:
1 / on delivery day, the bus offered must have an actunequal entry into service according to the regulations specified in the Regulation of the Minister of Infrastructure of 31.12.2002 on technical conditions of vehicles and the scope of their necessary equipment (Journal of Laws of 2016 item 2022), and in the case of a different regulation in force on the day of delivery legal regulations must meet the requirements of this regulation,
2 / each of the buses offered must be brand new, i.e., productionnot covered earlier than 6 months before the delivery date, previously unrecorded,
3 / bus offered must have valid (valid) type of Vehicle Type Approval Certificate or EC Vehicle Type Approval Certificate as per the delivery date, as defined in the Regulation of the Minister of Transport, Construction and Maritime Economy on 25.3.2013 on type approval of automotive vehicles andtrailers and their equipment or parts items (Journal of Laws from 2015 item 1475), and in the case of a different legal regulation valid on the day of delivery, it must meet the requirements of this regulation,
4 / offered bus on the day of delivery, in accordance with the regulation of the President of the Council Ministers of 10.5.2011 regarding other than the price of obligatory criteria for the evaluation of offers for certain types of orderspublic procurement (Journal of Laws No. 96 item 559), must meet the following conditions: in terms of NOx, PM particulate matter and THC hydrocarbon emissions, it must meet the exhaust gas purity requirements, at least at EURO 6, 5 / offered the bus should be adapted to the ON fuel supply,
6 / the bus must have a structure allowing for trouble-free and long-term operation in temperaraces around the air from 30 C to 50 C,
7 / bus is to be able to carry a minimum of 38 people at one time, including a minimum of 14 seats, including a maximum of 4 fold-out seats (tilt),
8 / offered bus should have a length of 7, 0 8.0 m, width min. 2.15 m,
9 / offered bus is to be a low-floor vehicle, with an entry height no greater than 340 mm from thewill clear the road. For the purposes of this order description, a low-floor bus is a vehicle with no intermediate steps, i.e. steps (stairs) in the middle passage or any bus door,
10 / the bus offered is to be made of parts, teams and materials with all permits and certificates comply with European Union law and Polish law producedh not earlier than 1 year before delivery of the bus and contractors available in the service network,
11 / the structure should be made of anti-corrosive materials,
12 / exterior painting in accordance with the colors applicable to the ordering party (RAL1023),
13 / towing hook at the front vehicle,
14 / in Annex 3 to the Terms of Reference have been described requirements related to information devices andservice for passengers, monitoring, ticketing machines and passenger counting system,
15 / offered buses should be covered by the guarantee:
a) full truck load over a minimum period of 36 months, (preference is given in the form of additional points to provide a 48-month full vehicle load),
b) bodywork and chassis frame structure as well as perforation of external covers and window seals during periodse 60 months of operation,
c) paint coatings in the period of 60 months of operation.
Purchaser does not define a detailed description of how to assess the fulfillment of this condition.

2. I. The offer must be accompanied by a declaration on the day of submitting bids regarding the fulfillment of the conditions for participation in the procedure and a declaration in the form of a completed and signed Single European Procurement Document Annex No. 3 to the ToR.
II. The ordering party, prior to the order being awarded, will call the contractor whose offer has been rated the highestshe, to submit within the prescribed, not shorter than 10 days, the current date as of the day of submitting the following declarations or documents:
1 / list of services performed, in the last 3 years before the deadline for submission of bids, and if the period of business is shorter in this period, together with their value, subject, dates of completion and entities for which the services have beenmade and attached with proofs indicating whether these services were performed properly or are performed properly,
2 / current information from the National Criminal Register in the scope specified in art. 24 sec. 1 point 13, 14 and 21 of the Public Procurement Law issued not earlier than 6 months before the deadline for submission of tenders,
3 / statements of the contractor about the lack of a final court judgment issued against him or the last onean administrative decision on defaulting payment of taxes, fees and social security or health insurance contributions,
4 / the contractor's statement about the lack of a ruling against him as a preventive measure to prohibit applying for a public order,
5 / certificate of the competent head of the tax office confirming that the contractor he is not in arrears with paying taxes, issued not earlymore than 3 months before the deadline for submission of tenders,
6 / certificate of the relevant organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the contractor is not in arrears with paying social security or health insurance contributions, issued not earlier than 3 months before the deadline for submissionoffers in proceedings,
7 / statements on non-payment of taxes and local fees, referred to in the Act of 12.1.1991 on local taxes and charges,
8 / excerpt from the relevant register or from central records and information on activities if separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion based onArt. 24 sec. 5 point 1 of the Public Procurement Law - III. The Contracting Authority informs that it does not provide for the possibility of providing the ones indicated in art. 67 sec. 1 point 7 orders.
According to art. 24aa paragraph 1 of the act, the contracting authority will first evaluate the offers and then (if the procedure is not annulled) will examine whether the contractor whose tender has been rated as the most advantageous, is not subject to exclusion and meets the conditionki participation in public procurement proceedings.
V. The selection criteria for the contractor:
1. Price - 60%
2. Full truck warranty period - 30%
3. Number of one-off passengers carried on the bus - 10%
VI. Each offer must be secured with a security deposit of PLN 10, 000.00 (ten thousand zlotys).
VII. The Awarding Entity does not allow variant bids to be submitted.
VIII. The orderer does not anticipate the useelectronic auction.
IX. The ordering party does not intend to establish a dynamic purchasing system
X. The Contracting Authority does not intend to conclude a framework agreement
