Providing bus vehicle driving services in regular public transport at PKM Sp. z o.o. in Tychy

The subject of the contract are services of driving bus vehicles in public transport, on communication lines established depending on the needs of the Employer, in the province of Silesia, in the amount of 3, 200, 000 wokm.

1. The subject of the order are bus driving services in public transport, on the communication lines established depending on the Employer`s needs, in the Silesian Voivodeship, in the amount of 3, 200, 000 car-kilometers

2. For the implementation of the contractThe Contractor should direct at least 52 drivers with legal qualifications to transport passengers by public transport buses, broken down into:

- working days 6, 591.00 km performed daily with 25 buses,

- Saturdays 3, 709.00 km performed daily with 13 buses,

- Sundays and holidays 797.20 km performed daily by 4 buses.

3.Order subject to be performedwill be with the help of the Employer`s vehicles. as amended) and the Road Transport Act of 6 September 2001 (i.e., Journal of Laws of 2019, item 58 as amended) and in accordance withthe provisions set out in the model contract which constitutes Annex 3 to the ToR. Description of the subject of the contract and the conditions for the implementation of the subject of the contract contains a model contract, constituting Annex 3 to the ToR.

5. Information on anticipated orders referred to in art. 67 section 1 points 6 and 7 of the PPL Act. 5.1 The Purchaser reserves the right to award the orders referred to in art. 67 section 1 pkt 6 in the amount of up to 30% of the value of the basic order. Contracts will consist of the repetition of similar orders as the basic order and will be consistent with the subject of the basic order, i.e. covered by an open tender.

5.2 The condition of awarding the contract will be negotiations with the Contractor.

5.3 The scope of orders referred to in point 5.1 includes services kiusing bus vehicles in public transport, on communication lines established depending on the needs of the Employer in the Silesian Voivodeship.

Not applicable.

To confirm that the Contractor meets the condition of economic or financial situation, the contracting authority requires submission of documents: - civil liability insurance in the field of related activitieswith the subject of the contract for a guarantee sum of at least PLN 200, 000.00.

Confirmation document: a document confirming that the Contractor is insured against civil liability in the scope of conducted activities related to the subject of the contract for the guarantee sum specified by the Employer.

If for a justified reason the Contractor cannot submit the documents required by the Employer, referred to above, the Employer allows the submission of another document which sufficiently confirms the fulfillment of the condition of participation in the procedure described by the Employer. 1 to the ToR;

2) declarations mentioned in item 7.1 7.4ToR (attachment No. 2 to the ToR - EAT - Single European Procurement Document), statement of another entity (attachment No. 2a to the ToR);

3) proof of payment of the bid security;

4) power of attorney or contract of entities appearing jointly indicating that the person acting on behalf of The Contractor is authorized to do so.

II. The Employer provides for the exclusion of the Contractor, pursuant to art. 24 section 1 items 12-23PZP Act (with the exception of Article 24 paragraph 1 item 13 letter d of the PZP Act, and in the case referred to in Article 24 paragraph 1 item 14, if the person referred to in this provision has been convicted of an offense listed in Article 24 paragraph 1 item 13 letter d of the PZP Act) and paragraph 5 item 1) of the PZP Act

III. The Contractor shall within 3 days from the day of posting on the website the information referred to in Art. 86 section 5 paragraphaw PZP, will provide the Ordering Party with a declaration of belonging or not belonging to the same capital group as referred to in art. 24 paragraph 1 point 23 of the PPL Act. Along with submitting the declaration, the Contractor may provide evidence that the links with another Contractor do not lead to a distortion of competition in the procurement procedure.

IV. The Contractor shall remain bound by the offer for a period of 60days.

V. According to art. 24aa PZP, the Awarding Entity will first evaluate the offers and then examine whether the Contractor whose offer has been assessed as the most advantageous is not subject to exclusion and meets the conditions for participation in the proceedings. implementing the order will have the necessary resourcesthese entities, in particular by presenting the undertaking of these entities to make available to him the necessary resources for the needs of the implementation of the contract (Annex 2a to the ToR).

VII. List of statements or documents, confirmation of compliance with conditions for participation in the progress. and no grounds for exclusion

1) EAT, according to points 7.1-7.4 of the SETC.

2). The Awarding Entity, before awarding the order, will call the Contractor, according to section 7.5 of the Terms of Reference for evilwith. tolerated aspect. or documents:

a) information from the NQF in the scope specified in art. 24 paragraph 1 item 13, 14 and 21 of the Act, as per item 7.5.1 of the ToR;

b) an excerpt from the relevant register or from the central register and information on economic activity, in accordance with item 7.5.2 of the ToR;

c) the Contractor`s statement on the lack of issue a final court judgment against him or a final administrative decision on arrears with payment undertaxes, fees or contributions for social or health insurance (...), as per item 7.5.3 of the ToR;

d) the Contractor`s statement that he was not issued a preventive measure against him from applying for public procurement, as per item 7.5 .4 ToR;

e) specified in item 6.1.2 of the ToR.

F). specified in items 7.6-7.9 of the SETC.

3). Declaration of belonging or not belonging to the same group of kadrinking water referred to in art. 24 paragraph 1 item 23 of the PZP Act, in accordance with item 7.15 of the ToR.
