The subject of the orders is to provide public bus services on public transport line No. 636 in accordance with timetables.

Main Site: Orzesze, Ornontowice, Gierałtowice, Knurow.

1. The subject of the order is theon the public transport bus service on public transport line No. 636 in accordance with timetables, on the terms set out in Annex 9 to the Terms of Reference of the contract template - 2. The service is covered by: - a ticket control system for passengers boarding a bus, consisting of passengers picking up the bus at the front door, while presenting the driver with a ticket or otherthe document entitling him to travel without a ticket. Entry to the bus takes place by the front door. Exit from the bus takes place through the rear door,

- by the Silesian Public Service Card system,

- a dynamic passenger information system in vehicles performing services on the above-mentioned the line, including in particular visual and phonic announcements of stops located along the route of the line and-providing passengers with additional information on public transport services.

3. Parameters of the lines being the subject of the order:

- relation: Orzesze Ornontowice School Centrum Gierałtowice Paniowki School Knurow Szpitalna,

- runs: on working days in hours. 4:24 / 21:14, on days off 08:29 / 17: 39,

- daily transport work: working days 567.20 wzkm, free days 154.10 wzkm,

- stopovers: working days 7:59 h, days off 4:18 h,

- average operating speed: working days 22.95 km / h, days off 16.81 km / h,

- average transport speed: working days 33.90 km / h, free days 31.66 km / h,

Predicted total operational work during the contract period for the above-mentioned the line isrolling stock: M = 480, 000 wzkm, including 6, 400 wzkm refers to the possibility of temporarily increasing the material scope of the order related to the need to organize public transport on designated sections of the route in connection with temporary repairs of roads and tracks or in connection with impediments caused by failures the layout of the road network and railroad tracks or for other reasons unenabling the functioning of public transport in a basic shape.

4. The Employer makes available to the Contractors, not used to describe the subject of the order, timetables for the above-mentioned line at the Department of Carriage Organization. The contractor, who will be awarded the order, the Employer will provide a set of timetables before concluding the contract.

5. The Employer has implemented the Silesian Service Card systemg Public (ŚKUP), whose electronic wallet function is used in public transport as an electronic ticket. Direct communication with vehicles is carried out via GPRS / UMTS and WiFi.

6. In the event of a reduction in the material scope of the subject of the order, the Contractor shall not be entitled to a claim for remuneration including the amount of vehicle-kilometers defined above in item 3, ierecorded total operational work during the contract period.

7. The ordering party requires, during the execution of the order, employment on the basis of a contract of employment by the Contractor or subcontractor of bus drivers, i.e. persons performing activities consisting in performing work in the manner specified in art. 22 - 1 of the Act of 26.6.1974 - Labor Code (Journal of Laws of 2018, item 108, as amended).

8.-During the implementation of the order, the Ordering Party will be entitled to perform control activities towards the Contractor or subcontractor regarding the fulfillment by the Contractor of the employment requirement under the employment contract mentioned above. people (bus drivers). The contractor who is allowed to perform the occupation of road carrier, referred to in art. 5 para. 1 of the Act of 6.9.2001 on road transport (Journal of Laws of 2017, item 2200, as amended) or a valid license for road transport, referred to in art. 5 para. 1 or paragraph 2 acts fromon 5.4.2013 on the amendment to the Road Transport Act and the Driver's Working Hours Act (Journal of Laws, item 567, as amended).

The contracting authority shall call the Contractor who submitted the most advantageous offer (offer, which was rated the highest), to submit the following declarations and documents valid as at the date of filing:

1. Permits to pursue the occupation of road transport operatorhim referred to in art. 5 para. 1 of the Act of 6.9.2001 on road transport or a valid license for the performance of road transport, referred to in art. 5 para. 1 or paragraph 2 of the Act of 5.4.2013 on the amendment to the Road Transport Act and the Act on drivers' working time

2. Information from the National Criminal Register in the scope specified in art. 24 sec. 1 items 13, 14 and 21 of the PPL Act, issued bynot earlier than 6 months before the deadline for submission of tenders. Certification of the competent head of the tax office confirming that the Contractor is not in default of paying taxes, issued not earlier than 3 months before the deadline for submission of bids or other document confirming that the Contractor has entered into an agreement with the competent tax authority regarding repaymentsh of receivables with possible interest or fines, in particular obtained legally required exemption, postponement or spreading into installments of overdue payments or suspension in full of the implementation of the decision of the competent authority. Certificates of the relevant organizational unit of the Social Insurance Institution or the Agricultural Social Insurance Fund or other document confirmingstating that the Contractor is not in arrears with paying social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission of bids, or other document confirming that the Contractor has agreed with the competent authority regarding repayment of such receivables with possible interest or fines, in particular he obtained the legally required exemptionsnot, postponing or spreading overdue payments into installments or suspending the implementation of the decision of the competent authority in full.

5. Contractor's statements that he has not issued a final court judgment or final administrative decision against him or her, whether or not he is in arrears with taxes, fees or social security or health insurance premiums, or in the event of such a verdict or decision being issuedo confirming the payment of these claims together with any interest or fines or entering into a binding agreement regarding the repayment of these debts. The pattern of the declaration is Annex 5 to the ToR.

6. Contractor's statements about the lack of a ruling against him as a preventive measure for the prohibition of applying for public orders. The pattern of the declaration is Annex 6 to the ToR.

7. Contractor's statements about non-payment of taxes and local fees, referred to in the Act of 12.1.1991 on local taxes and charges (Journal of Laws of 2018, item 1445, as amended). The pattern of the declaration is Annex 7 to the ToR.

I.

The Contractor should submit before the deadline for submission of tenders specified in point IV.2.2 of the announcement, bid bond in the amount of PLN 40, 000.00 (in words:: forty thousand zlotys 00/100).

II.

III.

If the Contractor, in order to confirmcompliance with the condition of participation in the proceedings referred to in clause 5.1 point 2 or 3 of the ToR, consists in the capacities of other entities, submits: a) in relation to these entities, the documents referred to in points III.1.1 sections 2-7 of the Announcement,

b) documents that specify: - scope of resources of another entity available to the Contractor, - how the Contractor uses the resources of another entity while performingon orders,

- scope and period of participation of another entity in the performance of public order, ,

- whether the entity, on the capacity of which the Contractor relies in relation to the condition referred to in point 5.1 point 2 of the SIWZ announcement, will provide services whose indicated abilities concern .

IV.

1 The Contractor sends to the address zamowienia@kzkgop.com.pl in electronic form with a qualified signature elektroniczne, valid as of the day of submitting bids, a statement constituting preliminary confirmation that the Contractor is not subject to exclusion from the proceedings and meets the conditions for participation in the proceedings referred to in point 5.1 subpoint 1-3 of the Terms of Reference. Declaration The Contractor shall send on the standard form a single European order document, hereinafter referred to as "single document", according to the stateAnnex 2 to the ToR. In Annex 2 to the Terms of Reference, the scope of mandatory information covered by the statement has been specified.

2. If Contractors jointly apply for the order, a single document shall be submitted by each Contractor. The uniform document confirms that the Contractor is not subject to exclusion from the proceedings and meets the conditions for participation in the proceedings in the scope in which each of theonawcow shows their fulfillment.

3. If the Contractor, in order to confirm the fulfillment of the conditions for participation in the proceedings, referred to in point 5.1 point 2 or 3 of the ToR, relies on the capacities of other entities, sends uniform documents regarding these entities in order to demonstrate the lack of grounds for exclusion and fulfillment of the condition for participation in proceedings in the scope in which it is referred-on their resources.
