The eligibility criteria to be met by the participants is applicable irrespective of whetheris applied for one or more lots. Participants, subcontractors and / or members of a consortium who will carry out public transport of passengers shall hold a valid license to carry passengers on the territory of the Republic of Bulgaria or a license to carry out international passenger transport - a Community license under the requirements of Art. 6 of the Authentic Act(valid international passenger transport licenses, valid internal passenger transport licenses) kept by the Automobile Administration Executive Agency, and for foreign persons in analogous registers under the law of the Member State in which they are registered. The Contracting Authority does not set minimum economic and environmental requirementsfinancial status of the participants. The Contracting Authority shall withdraw from participation in a procedure for awarding a public procurement a participant, for whom there are circumstances under Art. 54, para. 1, items 1-7 of the Public Procurement Act and Art. 55, para. 1, item 1, 3, 4 and 5 of the Public Procurement Act. Participant for whom there are grounds under Art. 54, para. 1 of the Public Procurement Act and the circumstances specified by the Assignor under Art. 55, para. 1 of the Public Procurement Act has the right to present evidencethat he has taken measures to ensure his reliability, despite the existence of the appropriate ground for remedy. Participation in the procedure is not allowed and a participant, to whom the hypothesis of Art. 3, item 8 of the Economic and Financial Relations Act with the companies registered in preferential tax jurisdictions, the persons controlled by them and-their actual owners, unless the provision under Art. 4 of the same law. Where the participant is a consortium which is not registered as an independent legal entity, then a copy of a document showing the legal basis for the formation of the grouping and the following information in relation to the particular procurement shall be submitted to the tender: rights and obligationsof the participants in the unification; agreeing joint and several liability for the performance of the public procurement contract; the activities that each member of the group will perform.

Changes in the composition of the grouping are not allowed after the deadline for submitting the tender. Where there is no provision in the contract establishing an association that guarantees the fulfillment of the above conditions or compositionthe merger has changed following the submission of the tender, the participant will be removed from participation in the award procedure of this tender. Where a participant has indicated that it will use the capacity of third parties to demonstrate compliance with the selection criteria or that it will use subcontractors, each of these persons shall be provided with a separate EEDOP containing the informationbut on the lack of grounds for removal and compliance with the selection criteria. In the case of unions which are not legal entities, compliance with the selection criteria shall be demonstrated by the participating grouping and not by any of the persons included therein, except for the relevant registration, presentation of a certificate or other condition necessary for the performance of the order, as requiredthe quantification of a normative or administrative act and the distribution of the participation of the persons in the implementation of the activities provided for in the agreement establishing the grouping.
