Requirement No 1.
Information and formalities necessary for evaluating if requirements are met:
1) Tenderers, third-party suppliers and subcontractors must not be re-find the situations provided in art. 177, 178, 180 of Law no. 99 / 2016.
The manner by which the fulfillment of the requirement can be demonstrated: the economic operators participating in the award procedure will be filled in with the information related to their situation.
The supporting documents demonstrating the fulfillment of the assumed by completing the DUAE are to be presented at requestof the contracting authority, only by the tenderer placed on the first place in the intermediate rankings drawn up at the completion of the tender evaluation. These documents are:
(a) certificates showing the outstanding debts relating to the payment of taxes, duties or contributions to the consolidated general budget (local budget, state budget, etc.) at the moment of presentation,
(b)of the economic operator and of the members of the management, management or supervisory body of the respective economic operator, or those having the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / act (c) where appropriate, documents demonstrating that the economic operator can benefitby the derogations provided in art. 179 par. (2), art. 180 par. (2), art. 184 of Law no. (D) any document considered to be edifying in the country of origin or in the country where the tenderer / candidate is established, such as certificates, criminal records, or other equivalent documents issued by the competent authorities of that country
Where, in the country oforigin or in the country where the tenderer / candidate is established, no documents of the nature mentioned above are issued, or the documents do not cover all the situations stipulated in art. 177, 178 and 180, the contracting entity accepts a declaration on its own responsibility or, if in that country there are no legal provisions regarding the declaration on its own responsibility, an alert statementin the case of a notary, of an administrative or judicial authority or of a professional association with competence in this respect.
The manner of accomplishment and the applicability in the procedure: one DUAE document will be completed for each lot by each tenderer, associated offeror, third party, subcontractor with the related informationthey will be requested by the contracting entity upon completion of the evaluation of the tenders, only to the first ranked bidder. Note:
The failure to complete the DUAE document directly with the offer (including the affiliate / third party / subcontractor) entails its rejection as unacceptable.
The failure, together with the DUAE, to firmlythe supportive agreement resulting from the effective manner in which its support, subcontracting agreement and / or association agreement will materialize as the case may be the basis for requesting clarification of any inaccuracy in the form of the information contained in the DUAE sections, the tenderer / candidate and the supporting subcontractor / third party, this lwhich is necessary to ensure the proper conduct of the award procedure.

1) An economic operator may participate in the procedure only if registered in SICAP; 2) Correspondence and all documents submitted by economic operators they will be in limeor Romanian, or accompanied by an authorized translation in Romanian;
3) The awarding documentation shall be posted in full in the tender notice published on the website www.e-licitatie.ro
4) The clarification requests of the potential bidders shall be addressed exclusively in SICAP in the "Requests for clarification / questions / communications" section of the award procedure conducted by mi5) The answers to the clarification requests posted to the SICAP prior to the deadline for submitting the bids will be posted on the 12th day before the deadline for the submission of bids under the heading "Documentation, clarification and decisions "of the participation announcement published on the website www.e-licitatie.ro
The contracting entity will not respond to the requests addressed by other fashion6) The Evaluation Committee will send the clarification requests regarding the submitted offers in the SICAP in the section "Requests for clarification / questions / communications". The economic operators will submit the answers to the clarifications and any requested documents during the evaluation of the bids through SICAP - "Requests for clarification / questions / communications" section i(7) The contracting entity only responds to the clarification requests addressed by the economic operators by the deadline set (art. 29 paragraph (3) H.G. no. 394/2016 modif with H.G. no. 419/2018];
8) If it is found to be moremany of the first-ranked offers with equal prices, the contracting entity will request (via SICAP in the "Requests for clarification / questions / communications" section) the re-submission, by presenting a new financial proposal only to the bidders in this situation, and the winner will be the lowest bidder. The new fine proposalthe application shall be filed only after the request of the contracting entity; 9) The return of the guarantee for participation shall be made in accordance with the provisions of art. 44 of GD 394/2016
10) Information on the association.
In the case of the association, the bidder represented by a group of economic operators will submit together with the tender and the documents accompanying it, the association agreement (the economic operators asowho will specify in the association agreement the part of the contract that each one will execute). In case the tenderer is declared as a winner, the association agreements will be presented in the legalized form until the signing of the contract.

Note: in the case of a group of economic operators submitting a joint tender, this requirement is considered individually by each member of the association for the portion of the contract he / she makes
