Contractors who can apply for the contract:

1. They are not subject to exclusion from the procurement procedure pursuant to art. 24 paragraph 1 point 12 point 23 of the Act, subject to art. 133 section 4 of the Act.

The offer submitted via the purchasing portal must be accompanied by a current statement as at the date of submission of the offer, constituting a preliminary confirmation that the Contractor is not subject tokeying and meets the conditions for participation in the proceedings. The said Contractor is obliged to submit in the form of a uniform document (Annex 3 to the ToR), in the form of an electronic document, signed with a qualified electronic signature, in accordance with the principles described in Chapter VII of the ToR.

A) In the case of an offer submitted by Contractors jointly applying for award of contractThe requirement to submit a single document applies to each of the Contractors jointly applying for the contract. A uniform document for each of the Contractors jointly applying for the contract must be submitted, otherwise being null and void, in the form of an electronic document, signed with a qualified electronic signature. These documents confirm compliance with the conditionnew participation in the procedure and no grounds for exclusion to the extent that each of the Contractors demonstrates compliance with the conditions for participation in the procedure and no grounds for exclusion.

b) If the Contractor relies on the resources of other entities on the principles set out in art. 22a of the Act, in order to demonstrate the lack of existence of grounds for them to be excluded from participation in the proceedings and compliance with, within the scopein which the Contractor refers to their resources, conditions for participation in the procedure, submits uniform documents regarding these entities. A single document for each of the entities on whose abilities or situation the Contractor relies on the principles set out in art. 22a of the Act, must be submitted, otherwise being null and void, in the form of an electronic document, signed by a qualified signatureelectronic.

c) The Employer does not allow the preparation and transmission of an electronic copy of a single document certified as true copy.

Documents confirming compliance with the abovementioned conditions that will be required on the basis of art. 26 section 1 of the Act:

1) information from the National Criminal Record in the scope specified in art. 24 paragraph 1 item 13, items 14 and 21 of the Act, subject to Art. 133 ust. 4 of the Act, issued not earlier than 6 months before the deadline for submitting bids;

2) a certificate from the competent head of the tax office confirming that the Contractor is not in arrears with tax payments, issued not earlier than 3 months before the deadline for submitting bids, or another document confirming that the Contractor has concluded an agreement with the relevant tax authority in the matterrepayment of these receivables, together with any interest or fines, in particular, obtained by law exemption, deferment or spreading in installments of overdue payments or withholding in full the decision of the competent authority;

3) certificate of the appropriate organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or another document pconfirming that the Contractor is not in arrears with the payment of social security or health insurance contributions, issued not earlier than 3 months before the deadline for submitting bids, or other document confirming that the Contractor has entered into an agreement with the competent authority regarding the repayment of these receivables together with any interest or fines in particular, he obtained a legal exemption, deferment or installment of overdue payments or withholding in full the decision of the competent authority.
