Reviewing compressor aggregates TG Jeleniow II

2. The detailed description of the subject of the Order contains Annexes 1 to SIWZ Project Agreement.

4. Where the Specification and Annexes to the Specification contain a reference to a specific type of standards, the Employer accepts equivalent standards. Contractor who, in order to demonstrate the fulfillment of the requirements of the Order subject to the subject matter of the Order, invokes the equivalent solutions described byThe Employer is obliged to show that the subject matter of the Order meets the requirements specified by the Employer.

5. The Employer allows the possibility of making a local inspection by Contractors, at least 3 days before the deadline for submission of offers. In this situation, the Contractor is obliged, at least 2 days before the date of the vision proposed by him, to be submittedby means of electronic means within the meaning of the Act of 18.7.2002 on the provision of electronic services (ie Journal of Laws of 2017 item 1219, hereinafter referred to as "Act on the provision of electronic services ") or via fax to the Ordering Party with a request to set a date (day and time) to make a local visa with the reservation that the visionand local can take place from Monday to Friday, excluding public holidays, from 9: 00-14: 00. The fact of participation of the Contractor in the local inspection will be confirmed with annotation about participation, date and signature of the Contractor on the application referred to in the second sentence.

6. The Contractor is obliged to read and apply the recommendations resulting from the Code of Conduct for Dostawcow of the Gas Transmission Operator Gaz-System S.A. (The Code of Conduct for Suppliers of the Gas-System Operator S.A. is available on the Employer's website: http://www.gaz-system.pl/przetargi/kodeks-postepowania-dla-dostawcow/).

7. Prior to the initiation of the procurement procedure, a technical dialogue was carried out. As part of the technical dialogueThe dialogue organizer obtained information that formed the basis for estimating the value of the order for reviewing compressor aggregates for TG Jeleniow II, as well as preparing the final description of the subject of the order, the draft contract and the Essential Terms of Orders in a manner that takes into account the possibilities of entrepreneurs in terms of optimizing the requirementszz Organizer of technical dialogue.

Contractors who can apply for the award of the Order:

1. They are not subject to exclusion from the Proceedings for granting the Order on the basis of art. 24 sec. 1 point 12) point 23) of the Act, subject to art. 133 ust. 4 of the Act

2. The Procurer will exclude the Contractor based on art. 24 sec. 5 point 1), point 2) and point 8) of the Act

1. To oYou must enclose the current statement as of the day of submitting the offer, constituting preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions for participation in the Proceedings. The Contractor is obliged to submit this statement in the form of a single document (Annex 2 to the Terms of Reference), in the form of an electronic document, signed with a qualified electronic signature, in accordance withthe courts described in Chapter VII of the ToR above.

Note:

a) In the case of an offer submitted by Contractors jointly applying for the award, the requirement to submit a single document applies to each of the Contractors jointly applying for the award. A single document for each of the Contractors jointly applying for the award must be submitted, submiedthe invalidity, in the form of an electronic document, signed with a qualified electronic signature. These documents confirm compliance with the conditions of participation in the Procedure and no grounds for exclusion to the extent that each of the Contractors demonstrates compliance with the conditions of participation in the Proceeding and no grounds for exclusion. B) If the Contractor relies on the resources of other entities on the terms ofspecified in art. 22a of the Act, in order to demonstrate the lack of grounds for exclusion from participation in the Procedure and compliance with them, to the extent that the Contractor relies on their resources, the condition of participation in the Procedure, submits uniform documents concerning these entities. A single document for each of the entities on whose capacity or situation the Contractor is based on the principles ofin Article 22a of the Act, must be submitted, under pain of nullity, in the form of an electronic document, signed with a qualified electronic signature. - Documents confirming compliance with the conditions that will be required under Art. 26 par. 1 of the Act: According to the text of section XI, item 2, point 1) to 11)

Note:

1. Information on the method of communication with the Employer with the Contractorsand the submission of declarations and documents as well as the submission of the EED are contained in Chapter VII of the ToR.

2. Note to Section IV.2.6) of the announcement: The Contractor is bound by the offer for 60 days.
