Bidders, subcontractors and third-party supporters should not be in situations provided in art. 164, 165 and 167 of the Public Procurement Act no. 98/2016, they will present the DUAE, according to art. 170 par. (3) andart. 183 par. (1) of the Public Procurement Act no. 98/2016. In the case of an association, each associate (including the leader) is obliged not to fall into any of the situations provided in art. 164, 165 or 167 of Law no. 98/2016 on Public Procurement.

The supporting documents proving the fulfillment of the undertaken by completing the DUAE are to be presented, upon requestcontracting entity, only by the tenderers placed on the first, second and third place, in the intermediate rankings drawn up at the completion of the evaluation of the tenders.

Mode of accomplishment: the economic operators participating in the award procedure will be filled in with the information related to their situation. These documents may be: (a) Establishment certificates for outstanding debtswith regard to the payment of taxes, the lack of debts related to the payment of taxes, duties or contributions to the general consolidated budget (local budget, state budget, etc.) at the time of submission for all work points mentioned in the on-going certificate issued by the ONRC, (b) The criminal record of the economic operator and all members of the management, management or management bodythe supervision of the respective economic operator or of those having the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act; (c) as the case, documents proving the fact that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016 on public procurement; (d) Other editorial documents, as the case may be.

Having regard to the criterion of assigned award if two or more bids show the same lowest price, the bid evaluation committee will ask for clarification through the technical facilities of the SICAP, to load the bidders in question with documents that will contain a new financial proposal. All documents related to the offer are submitted in SICAP signed electronically according to art. 60 62 of GD no. 395/2016. Separate second-placed bidders if they existtwo or more offers with the same lowest price will be made in the following way: the improvement of the offer will be made only up to the level of the price offered by the operator placed on the 1st place. Separation of the ranked bidders in the 3rd place. If there are two or more offers with the same lowest price will be made as follows: the offer will only be improved up to nowthe price offered by the operator located on the 2nd place.
