The Contracting Authority shall remove from participation in the procedure a participant for whom any of the circumstances referred to in Article 54 (1), Article 55 (1), Items 1, 3, 4, 5 and Article 107 of the PPA as well-and a participant who does not meet the selection criteria or fails to fulfill another condition specified in the contract notice or in the documentation or who has submitted a tender which does not meet the pre-announced terms of the contract and in any way included somewhere in his offer outside the "Price range offered" item related to the price and / or price offeredparts of it. The Contracting Authority shall remove from participation in the procedure the participant whose proposal for fulfillment of the contract does not fulfill all the conditions of the technical specification has not submitted the justification under Art. 72, para. 1 of the Public Procurement Act or its offer is not accepted according to Art. 72, para. 3-5 of the PPA, as well as when in its price proposal it has indicated a total value excluding VAT for performance of the ordera, which exceeds the total estimated value specified in section II.1.5 of the contract notice and / or has made an arithmetical error or rounding error in the price proposal. Where a participant in the procedure is a consortium which is not a legal person, a copy of the document shall be required showing the legal basis for the formation of the grouping and the rights and obligations of the participantsthe division of responsibility between the members of the grouping, the activities that each member of the grouping will carry out in connection with this contract. The guarantee for the performance of the public procurement contract is 5% (five per cent) of its value excluding VAT.
