1) Documents from the carit is clear that the tenderer and the associate / subcontractor / third party (as the case may be) do not fall within the scope of: (a) art. 177 of Law 99/2016,

(b) art. 178 of Law 99/2016,

(c) art. 180 of Law 99/2016, presented by the DUAE. (see Article 202 of Law 99/2016), 2) Statement on non-compliance with the provisions of Art. 73 of Law 99/2016 on conflict of interest, the decision-makers within the authority for this procedure are:

The statement will be presented with the DUAE by all the participants in the procedure (bidder, associate, subcontractor, third party).

Initially, the tender will be submitted to the DUAE, and the bidder ranked firstthe completion of the evaluation of the tenders at the request of the contracting entity will have to provide:

(a) Certificate regarding the payment of local taxes and duties, showing the lack of overdue debts regarding the payment of local taxes and taxes at the time of their filing in original, authenticated or legible copy with the reference "according to the original",

(b) Certificate pmaking the payment of taxes and social security contributions to the budgets of the general consolidated budget that would result in the lack of outstanding debts regarding the payment of taxes and social security contributions to the budgets of the general consolidated budget at the moment of their deposit, in original, legalized / authenticated copy-(c) The judicial record of the economic operator and the members of the administrative, management or supervisory body of that economic operator or of those having the power of representation, decision-making or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act and, as the case may be, documentswhich demonstrates that the economic operator may benefit from the derogations provided in art. 179 par. (2), art. 180 par. (2), art. 184 of the Public Procurement Act 99/2016, in order to prove the non-compliance in the situations of exclusion stipulated in art. 177, 178 and 180 of Law 99 / 2016.

Foreign legal / natural persons, initially when submitting bids, after the evaluation of the tenders has been completed, at the request of the contracting entity, the tenderer ranked first. may submit supporting documents in accordance with the provisions of art. 177, 178, 180 and 181 of Law No 99/2016. According to art. 181 of Law 99/2016, will be provided with editorial documents issued by the competent authorities of the country in which they are resident, such as the certificatecriminal records, criminal records or other equivalent documents issued by the competent authorities of that country. 1) The economic operators submitting the tender must prove a registration according to the law of the country of residence, it should appear that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the constitution-as well as the fact that it has the professional capacity to perform the activities that are the subject of the contract.

Mode of accomplishment: Completion of the DUAE, as the supporting document, respectively the ONRC certificate or, for foreign tenderers, an equivalent document issued in the country of residence, requesting the contracting entity only by the tenderer ranked firstevaluation of tenders. The subject of the contract must have a correspondent in the CAEN code of the certifying certificate issued by the ONRC. The data entered in the Certificate of Attestation must be actual / current when presenting the documents

According to art. 22 par. (6) of H.G. 394/2016, economic operators can access the DUAE for completion at the following link: https://ec.europa.eu/growth/ Tools, databases / ESPD / filter. The contracting entity has the right to request the tenderers, in exceptional circumstances, before the expiry of the period of validity of the offer, to extend this period. The tenderer has the obligation to communicate to the contracting entities whether or not he agrees to the extension of the period of validity of the tender. The bidder who disagrees with the prolongthe period of validity of the offer is deemed to have withdrawn its offer, without this losing the guarantee of participation. Language of the offer - Romanian. All certificates and documents issued in a language other than Romanian will be accompanied by their certified translation into Romanian. In the event that a notice or appeal is lodged, as appropriate, applyLaw no. 101/2016. Requests for clarification of potential bidders will exclusively address SEAP in the "Questions" section of the award procedure conducted by electronic means and the responses to them will be published in SEAP, in the "Documentation and Clarification" section of the tender notice, the contracting entity not to applycommunicated by means of communication other than that established in accordance with the provisions of art. 78 par. (1) of the Law no. 99/2016 for post-submission submissions. The evaluation committee will submit the clarification requests regarding the submitted offers in the SEAP in the "Questions" section. The economic operators will send the answers to the clarifications and the possible documentsare requested during the evaluation of the offers through SEAP (section "Questions"), fully in the section corresponding to the respective request, in the form of one or more separate documents signed with the extended electronic signature. If it is found that the first ranked offers places have equal prices, in order to divide the bids, contracting entity vask them to re-submit by submitting a new financial proposal. The new financial proposal will be submitted only and only following the request of the contracting entity
