Purpose of the services: realization of studies by a qualified expert in polluted soil management - framework contract.

Investigation of the quality of soil and water onvarious BEP Environnement sites in the Province of Namur.

The present market is a framework service contract for the investigation of the quality of soil and water, including the performance of preliminary studies (historical studies), on different BEP Environnement sites, in accordance with the decree of 1.3.2018 on soil management and sanitation and the CWBP (Walloon codegood practices).

Different orders may be placed with the successful tenderer on the basis of the items defined in the technical clauses, depending on the needs of the contracting authority.

These orders include:

- the realization of comprehensive and CWBP-compliant preliminary and historical studies to identify potential sources of contamination,

- ifs potential sources are identified at the preliminary study stage, completion of full orientation studies in accordance with the Reference Guide for the Orientation Study (GREO), including all field work, sampling and analyzes,

- if contamination is detected at the stage of the EO, the realization of full characterization studies, consistent with the Guide reference for the characterization study (GREC) including risk studies; including all field work, sampling and analyzes,

- completion of complete sanitation projects, in line with the Reference Guide for the Sanitation Project (GRPA),

- the drafting of the technical clauses intended to select a company to carry out sanitation works- monitoring of any remedial work and establishment of a final site in accordance with the GREF (Reference Guide for Final Evaluation),

- monitoring and monitoring of groundwater that could to be requested by the administration; including sampling and analysis,

- basic reporting under the EDI Directive.

These different studies arewill mainly be written in the following frameworks:

- renewal of environmental permits for the various recyparcks and waste transfer center (if these activities are included as a risk in the execution decree),

- introduction of a single permit for infrastructure extension projects (waste transfer center or recyparcs) when the sites are taken over by the BDES (Bstate of the land) and that the works have an impact on the soil,

- the realization of basic report for the IED sites,

- the realization of soil studies for communes which would establish conventions specific with BEP Environment,

- cessation of activities on certain recyparcs,

- acquisition / sale of possible land.

These studies should ultimately lead to the acquisitionon a request from the contracting authority, the successful tenderer shall define the quantities presumed necessary for the site to be investigated and the needs, on the basis of the items defined in the technical clauses of the present contract. In the event of a request for a supplement by the administration (Soil Remediation Directorate) following the submission of a study, no additionalfees may not be claimed for a CWBP-compliant study.

In the event of a change in the law before the end of the contract, the tenderer will be required to comply with the instructions of the administration as to whether whether the mission can be continued under the old regime or whether it must comply with the new legislation. The DUME, whereby the tenderer declares that he satisfies the following selection criteria:

1) the tenderer must provide evidence thatit has sufficient economic and financial resources to be able to provide the services in accordance with the requirements laid down in the technical clauses and in accordance with the payment schedule defined in these specifications.

The following documents must therefore be provided in order to justify the the tenderer's financial and economic capacity:

1) aturnover relating to the services to which the market refers (EO, EC, PA, sanitation monitoring), carried out during a period covering the last 3 financial years.

If for a justified reason, the supplier can not provide the requested references, it is allowed to prove its economic and financial capacity by any other document considered appropriate byr the contracting authority.

The tenderer may, where appropriate, assert the capabilities of other entities, irrespective of the legal nature of the links between themselves and these entities. In that case, he must prove to the contracting authority that, for the performance of the contract, he will have the necessary means by producing the undertaking of those entities to put such resources in place.available.
